RELATING TO INSURANCE.

Authorizes the Attorney General to bring a civil action in the name of the people of the State as parens patriae against any responsible party to recover certain costs or obtain certain relief, including costs and losses incurred by the Hawaii Property Insurance Association, Hawaii Hurricane Relief Fund, or other state entities, resulting from climate attributable harm or costs for risk of future climate attributable harm. Authorizes the Hawaii Property Insurance Association and Hawaii Hurricane Relief Fund, or any private insurer licensed in the State to bring a civil cause of action against a responsible party to recover its costs and losses resulting from climate attributable harm.

RELATING TO TAX HAVEN ABUSE.

Part I: Effective 1/1/2027, requires corporations to include in their income the income of all foreign subsidiaries to the State; applies the State's apportionment formula to determine the share of reported profits subject to the appropriate tax, which shall be deposited into the state general fund; and requires corporations to report all profits, losses, revenues, and inter-company transactions made and all taxes paid in other states. Part II: Establishes within DOTAX a Corporate Tax Law Task Force to annually review the State's corporate tax laws and recommend updates to close tax loopholes.

RELATING TO PUBLIC LANDS.

Establishes new requirements for the disposition of public lands, including requiring two-thirds approval of each house of the Legislature via concurrent resolution and with a supporting resolution from the Office of Hawaiian Affairs, and applies this requirement to the disposition of public lands to public utilities and renewable energy producers as well. Limits the duration of public land disposition to the United States military to twenty-five years. Requires any new land disposition to the United States military to be accompanied by a clean-up and remediation bond from the United States military to be deposited into the state treasury. Prohibits the Board of Land and Natural Resources from issuing any new land disposition to the United States military until the military, State, and Office of Hawaiian Affairs reach an agreement in principle on certain matters.

RELATING TO CONSUMER PROTECTION.

RELATING TO MEDICAID.

Requires the State Auditor to conduct audits of Medicaid health care insurance contractors and the Department of Human Services and its Med-QUEST division at least once every two years, with the first audits to be conducted by 1/1/2027, and the reports to be submitted no later than twenty days prior to the Regular Session of 2027. Requires the Auditor to conduct audits. Appropriates funds.

RELATING TO THE POWERS OF ARTIFICIAL PERSONS.

Makes any state-chartered corporation, limited liability company, limited partnership, limited liability partnership, cooperative, nonprofit, or other association lack the legal capacity to make expenditures or contributions in connection with elections or ballot measures. Deems any election or ballot measure expenditure or contribution to be ultra vires or void as a matter of law, triggering administrative forfeiture of charter privileges, including limited liability and perpetual duration, until reinstatement. Effective 1/1/2027.
