Repeals the exemption of persons with disabilities from minimum wage requirements. Takes effect on 1/1/2022.
Establishes Dependent Care Flexible Spending Accounts for all working taxpayers. Defines qualifying individuals and eligible expenses. Outlines the requirements and limitations of the accounts. Applies to taxable years beginning after 12/31/2021.
Allows the court and the prosecution to ensure a prompt trial for certain proceedings involving minors. Allows a court to prohibit residency from certain areas for persons convicted of a crime against minors or sexual offense. Amends Hawaii Rules of Evidence to allow a child to testify before the court using teleconferencing or videoconferencing if an in-person testimony will cause harm to the child.
Prohibits the Hawaii National Guard from being released from the State into active duty combat unless the United States Congress passes an official declaration of war or takes an official action pursuant to its constitutional powers to call the National Guard to execute the laws of the union, repel an invasion, or suppress an insurrection. Requires the Governor to take any action necessary to comply with those requirements.
Requires and establishes deadlines for all state facilities with an area of 10,000 square feet and over, except facilities at Aloha Stadium, to implement all cost-effective energy efficiency measures. Provides that certain agencies that perform energy efficiency retrofitting may continue to receive appropriations for energy expenditures at an amount that accounts for any costs or debt service for the implementation and management of energy efficiency measures. Beginning 7/1/2020, requires, where feasible and cost-effective, the design of all new state building construction to maximize energy and water efficiency, maximize energy generation potential, and use building materials that reduce the carbon footprint of the project. Directs the Hawaii State Energy Office to collect utility bill and energy usage data for state-owned buildings and to make the data publicly available. (SD2)
Prohibits the manufacture, possession, sale, barter, trade, gift, transfer, or acquisition of detachable ammunition magazines with a capacity in excess of ten rounds, regardless of the type of firearm with which the magazine is compatible. Allows possession of large-capacity magazines that were legally possessed prior to the effective date of this Act. Allows acquisition by means of inheritance of large-capacity magazines that were legally in possession prior to the effective date of this Act. Allows possession and use by law enforcement agencies and officers. Allows the use of blank-fire assault weapons and detachable ammunition magazines with a capacity in excess of ten rounds for use solely as props for motion picture film or television program production when authorized by the chief of police of the appropriate county and not in violation of federal law. Authorizes the Public Utilities Commission to address any situation where the condition of a regulated water carrier of cargo may result in the disruption, reduction, or cessation of essential services. Amends the bases upon which the Public Utilities Commission may issue a certificate of public convenience and necessity to an applicant seeking authority to serve as a regulated water carrier. Authorizes the Department of Transportation to enter into contracts to provide subsidies to a regulated water carrier provided the carrier meets certain conditions. (SD1)
Authorizes transient accommodations in the State, subject to certain conditions. Requires all operators and plan managers and their respective properties to be listed on a registry created, published, and updated by each county, except in any county that does not regulate the number or location of transient accommodations within that county. Requires hosting platforms to collect and remit to the State all applicable TAT and GET, as agents of operators and plan managers, and to regularly disclose to the State information on transient accommodations listings in the State. Prohibits hosting platforms from collecting fees or completing any booking transactions for properties not listed on the registry, if applicable in that county. Authorizes DOTAX to establish fees, charges, and other requirements by rule. Establishes civil and administrative penalties for violations. Authorizes the State to issue administrative subpoenas to obtain certain information regarding transient accommodations listings in the State. (SD2)
Requires DOH to adopt rules to establish a classification system for composting facilities or operations for the purposes of regulating them for health purposes. Allows composting and co-composting in the agricultural district, including on lands with class A or B soils. Appropriates moneys to the Department of Health for a Program Specialist position in the Solid and Hazardous Waste Branch. Effective 7/1/2020. (SD1)
Establishes regulations on the use of hydrofluorocarbons in state law. Phases out hydrofluorocarbons in favor of alternatives with lower global warming potential. Establishes a preference for products that do not contain hydrofluorocarbons in the state procurement code. Directs the Hawaii State Energy Office and the Environmental Management Division of the Department of Health to study how to increase the use of refrigerants with low global warming potential, reduce the use of hydrofluorocarbons, and recommend how to fund, structure, and prioritize a state program that incentivizes or provides grants to support the elimination of legacy uses of hydrofluorocarbons. Appropriates funds for the study to be performed by the Hawaii State Energy Office. Effective 7/1/2050. (HD2)
