RELATING TO CHILD PASSENGER RESTRAINT SYSTEMS.

Requires motor vehicle operators to ensure that children two years of age or younger are properly restrained in rear-facing child passenger restraint systems. Requires the use of child safety seats or booster seats for certain children less than ten years of age. Effective 7/1/2050. (HD2)

RELATING TO LAND LEASES.

Authorizes the board of land and natural resources to: (1) Amend and extend existing pasture leases for up to sixty-five years; (2) Issue new pasture leases by negotiation, if doing so furthers public purposes and the lands are already under pastoral use; and (3) Develop agricultural and pasture lease rents based on the value of the land's agricultural uses. Effective 7/1/2050. (HD1)

RELATING TO LEASES.

Requires as a condition precedent for any valid withdrawal of lands out of pasture leases for reforestation purposes that the division of forestry and wildlife submit a funded action plan detailing the planned reforestation process for those lands and that the withdrawal be approved by the board of land and natural resources. RELATING TO THE DEPARTMENT OF EDUCATION.

Establishes the shade and fruit tree program in the department of education to support educational activities and encourage propagation of native shade trees and fruit trees for planting in department schools. Appropriates funds for the program and to establish an arborist position. Effective 7/1/2050. (HD2)

RELATING TO HABITAT CONSERVATION PLANS.

Requires any person, before engaging in an activity with a high likelihood of resulting in an incidental take of a threatened or endangered species, to enter into a planning process with DLNR for the purpose of preparing and implementing a habitat conservation plan. Requires habitat conservation plans to include additional components. Effective 7/1/2050. (HD2)

RELATING TO HEALTH.

Clarifies the group of professionals who are prohibited from knowingly referring or transferring patients to an uncertified or unlicensed care facility. Repeals the landlord exclusion. Requires the department of health to prioritize complaint allegations based on severity for inspections of state-licensed or state-certified care facilities. Effective 7/1/2060. (HD2)

RELATING TO CATALYTIC CONVERTERS.

Requires licensed used motor vehicle parts dealers to keep certain records of catalytic converter purchases and shipments. Establishes the felony offense of theft of catalytic converter. Increases the penalty for engaging in certain business related to used motor vehicle parts and accessories without a license. Requires scrap dealers to keep records of purchases of palladium, platinum, and rhodium. Requires all scrap dealers or recyclers to pay for palladium, platinum, and rhodium, and used motor vehicle parts dealers to pay for catalytic converters, by check. Effective 1/1/2050. (HD2)

RELATING TO PROPERTY FORFEITURE.

Restricts civil asset forfeiture to specific, limited cases. Raises the burden of proof for property forfeiture to clear and convincing evidence. Authorizes the use of certain forfeited property by local or state agencies for a limited time. Directs forfeiture proceeds to certain involved state and local governments and to the general fund. Amends the allowable uses of moneys in the criminal forfeiture fund. Requires the Attorney General to adopt rules. Advances the deadline for the Attorney General to report to the Legislature on the Hawaii omnibus criminal forfeiture act. Effective 1/1/2222. (HD2)

RELATING TO STREAM MAINTENANCE.

Requires the department of land and natural resources to establish and implement a two-year stream maintenance reimbursement pilot program to reimburse homeowners for clearing debris in and around streams near their property. Appropriates funds. Effective 7/1/2050. (HD1)

RELATING TO THE BOARD OF EDUCATION.

Requires that at least one at-large member of the board of education be a Hawaiian immersion expert selected from a list of three nominees submitted by the president of the senate, speaker of the house of representatives, and office of Hawaiian affairs. Effective 7/1/2050. (HD2)
