Rep. Luke Evslin

Makes the class B felony offense of delivering drug paraphernalia to persons under eighteen years of age applicable to offenders who are at least twenty-one years old. Exempts drug paraphernalia for marijuana from certain penalties under the Uniform Controlled Substances Act. Makes the possession of less than one ounce of recreational marijuana a nonjailable violation punishable by a fine of $25. Effective 7/1/3000. (HD1)

Prohibits any person convicted of operating a vehicle under the influence of an intoxicant or habitually operating a vehicle under the influence of an intoxicant from purchasing or publicly consuming alcohol for a certain period. Effective 7/1/3000. (HD1)

Requires certain projects meeting the criteria of section 201H-38(a)(1), Hawaiʻi Revised Statutes, to be exclusively for sale or rent to occupants who are Hawaiʻi residents who own no other real property.

Establishes the Hawaiʻi zero waste initiative to manage the State's transition to a zero solid waste economy.

Prohibits a landlord or the landlord's agent from charging an application fee for a criminal background check or credit report if an applicant provides a certified copy of a criminal background check or credit report. Requires a landlord or the landlord's agent to provide, upon request, a certified copy of an applicant's criminal background check or credit report.

Repeals the discretion for public officials to require work in respect to any structure or improvement, regardless of the cost valuation of the work, to be subject to the requirements of professional engineers, architects, surveyors, and landscape architects licensing laws. Maintains that work in respect to structures within special management areas, flood hazard areas, and special design districts and in respect to improvements resulting from conditional use or other discretionary zoning permits, code compliances or variances, and building permit expediting procedures, are subject to the licensing laws.

Increases the number of Commission on Water Resource Management members from 7 to 8, with only 5 of the 8 members required to have substantial experience in water resource management. Adds the Chairperson of the Hawaiian Homes Commission, or the Chairperson's designee, as a member of the Commission on Water Resource Management.

Beginning 1/1/2025, requires rental watercraft to be registered and numbered with the Department of Land and Natural Resources before being provided or offered to be used by the public for transiting the navigable waters of a state park. Sunsets 12/31/2029. Effective 7/1/3000. (HD1)

Establishes within the Department of Business, Economic Development, and Tourism the Interagency Council for Maui Housing Recovery to coordinate and facilitate Maui's permanent housing recovery and facilitate consultation and collaboration between state and county agencies on housing recovery initiatives for the island of Maui. Designates the executive director of the Hawaiʻi Housing Finance and Development Corporation to serve as chair of the council. Appropriates moneys. Sunsets 6/30/2034. Effective 7/1/3000. (HD1)

Beginning with the 2024-2025 school year, requires the Department of Education to provide free breakfast and lunch to students enrolled in a public school who meet certain requirements. Appropriates funds.
