PROPOSING AN AMENDMENT TO ARTICLE I OF THE CONSTITUTION OF THE STATE OF HAWAII TO RECOGNIZE AND PROTECT THE INHERENT AND INALIENABLE RIGHT OF ALL PEOPLE TO CLEAN WATER AND AIR, A HEALTHFUL ENVIRONMENT AND CLIMATE, HEALTHY NATIVE ECOSYSTEMS, AND BEACHES.

Proposes a constitutional amendment to ensure that the inherent and inalienable right of the people, including future generations, to clean water and air, a healthful environment and climate, healthy native ecosystems, and beaches shall be protected and shall not be infringed. Effective 6/30/3000. (HD1)

RELATING TO REEF PROTECTION.

Prohibits commercial operators of surfing tourism, instruction, and lesson companies from providing, or allowing the wearing of, footwear during lessons taking place on or above certain submerged reefs.

RELATING TO FIRE PREVENTION.

Appropriates funds to the Department of Land and Natural Resources for the Community Fuels Reduction Project. Beginning with fiscal year 2025-2026, and each fiscal year thereafter, requires the Department of Land and Natural Resources to establish the Community Fuels Reduction Project as a separate line item within the Department's budget. Effective 6/30/3000. (HD1)

RELATING TO ARRESTS.

Provides that after making an arrest, a police officer may issue to the arrestee an appearance ticket that states the date and time of the initial court appearance, and thereafter release the arrestee from custody. Broadens the range of offenses for which a police officer may issue a citation in lieu of making an arrest, provided that certain conditions are met. Effective 1/1/2024.

Requires the board of education to adopt and the department of education to administer a kindergarten entry assessment in ‘Olelo Hawai‘i for Kaiapuni schools. Delays the administration of the kindergarten entry assessment in ‘Olelo Hawai‘i for Kaiapuni schools to the 2026-2027 school year.
