Criminal Justice

Establishes the crime of criminal trespass on agricultural land. Prohibits persons being prosecuted for or convicted of the crime of criminal trespass on agricultural land from owning, possessing, or controlling a firearm or ammunition.

Prohibits law enforcement agencies and law enforcement officers from using biometric surveillance technology in the State unless certain conditions are met.

Requires the Director of Law Enforcement to adopt rules establishing training and certification standards and procedures for crisis intervention officers. Clarifies the scope of treatment allowable under orders for assisted community treatment. Requires the Department of the Attorney general to assist with the preparation, filing, and presentation of any request for a court or administrative order authorizing treatment over the objection of certain patients.

Removes requirement that all wiretapping applications made to a designated judge be accompanied by a written memorandum from the Department of the Attorney General recommending approval or disapproval.

Establishes comprehensive reforms to protect children and families from abuse and improve systemic responses. Part I: Establishes the calendar year 2027 as the Year of Resilience, Safety, and Survivor Justice. Part II: Modernizes statutory definitions of harm and child abuse. Part III: Recognizes coercive control as domestic abuse. Part IV: Reforms Family Court procedures to prioritize child safety and prohibit parental alienation theories. Part V: Defines economic abuse and strengthens financial protections, including automatic restraining orders, emergency hearings, forensic accounting authority, and liability for financial institutions. Part VI: Safeguards neurodivergent children and prohibits diagnosis shopping. Part VII: Protects reproductive privacy in custody proceedings. Part VIII: Enhances Child Welfare Services Branch accountability through audits and creation of a Child Welfare Ombudsman. Part IX: Requires automatic protective orders and custody restrictions in cases of severe violence. Part X: Creates a Family Violence Docket with mandatory judicial training and an advisory panel.

Limits moving violations arising from the operation of a motor vehicle that appear on traffic abstracts to those that resulted in convictions. Requires the Traffic and Emergency Period Violations Bureaus to remove all dismissed moving violations not resulting in a conviction from certified abstracts. Appropriates funds. Effective 7/1/2050. Requires defendants convicted of causing the death or disability of a parent or legal guardian of a minor child by the operation of a vehicle while under the influence of an intoxicant to make restitution in the form of financial support to each child of the victim.

Requires the court to impose a mandatory minimum term of imprisonment without possibility of parole or probation for a person convicted of a sexual assault offense.

Requires the Department of the Attorney General to submit annual reports to the Legislature pertaining to the offense of terroristic threatening in the first degree. Expands the definition of "terroristic threatening" to include any form of written or electronic communication. Includes additional protected classes that designate the offense of terroristic threatening in the first degree as a class B felony. Amends the offense of obstructing government operations to include obstructing the performance of a governmental function by an educational worker acting in an official capacity. Effective 7/1/3000. Requires any law enforcement officer acting under color of law in a public space or on state or county property to remain visibly identifiable. Prohibits law enforcement officers from wearing facial coverings while performing their duties, with certain exceptions. Requires law enforcement officers to wear apparel and use vehicles that bear conspicuous markings of the applicable law enforcement agency. Requires all civil law enforcement activity that involves participation by state or county law enforcement officers or occurs on state or county property to be conducted in a manner that adheres to specified standards. Deems certain locations to be service-first spaces and requires them to have clear, narrowly tailored procedures with respect to civil immigration actions. Requires all state and county agencies to adopt policies that limit the collection, retention, and sharing of immigration-related personal data. Requires all interagency data exchanges between state agencies, county agencies, or state and county agencies to operate under auditable agreements. Requires all state and county agencies to report annually to the Legislature and Governor regarding the civil-immigration-related requests. Requires every state and county agency to adopt a policy that prohibits immigration-based harassment or threats, including unwarranted verification of an individual's immigration status, with respect to employment or the provision of services to the public. Requires all state and county law enforcement officers to monitor civil immigration enforcement activity by activating body cameras when present in a situation in which United States Immigration and Customs Enforcement agents are interacting with a member of the general public.
