Under current law, the President determines whether any adjustment of an import is necessary and must submit to Congress the reasons for any action taken or not taken. Terry Technical Correction Act This bill broadens the scope of crack cocaine offenders who are eligible for a retroactive sentencing reduction under the First Step Act of 2018. The First Step Act made the Fair Sentencing Act of 2010 retroactive and authorized sentencing reductions for certain crack cocaine offenders convicted and sentenced before the Fair Sentencing Act became effective. Under current law, crack cocaine offenders whose conduct triggered a mandatory minimum sentence are eligible for a retroactive sentencing reduction under the First Step Act. However, in 2021, the Supreme Court held in Terry v. United States that low-level crack cocaine offenders whose conduct did not trigger a mandatory minimum sentence are not eligible for a retroactive sentencing reduction under the First Step Act. This bill extends eligibility for a retroactive sentencing reduction under the First Step Act to all crack cocaine offenders convicted and sentenced before the Fair Sentencing Act became effective, including low-level offenders whose conduct did not trigger a mandatory minimum sentence.

Prevent Unconstitutional Vaccine Mandates for Interstate Commerce Act This bill prohibits certain departments and agencies from promulgating any rule to require a a person to provide proof of a COVID-19 vaccination in order to engage in interstate commerce or travel. The prohibition applies to The Department of Transportation, Amtrak, The Surface Transportation Board, The Transportation Security Administration, The National Transportation Safety Board, The Federal Maritime Commission, and The Department of Commerce. The bill also limits the authority of the Department of Health and Human Services to mandate vaccination against COVID-19 as a prerequisite for engaging in interstate commerce or travel.

Treatment Restoration for Emergency Antibody Therapeutics Act or the TREAT Act This bill prohibits the Department of Health and Human Services (HHS) from implementing any policy that restricts health care facilities from ordering and receiving COVID-19 monoclonal antibody therapies directly from manufacturers and distributors. In addition, the bill expressly nullifies a policy announced on September 13, 2021, under which HHS allocated supplies of these therapies through state or territorial governments.

Opportunities for Fairness in Farming Act of 20 21 This bill establishes restrictions and requirements for checkoff programs, which are programs overseen by the Department of Agriculture (USDA) to promote and provide research and information for a particular agricultural commodity without reference to specific producers or brands. The bill prohibits boards established to carry out a checkoff program or a USDA order issued under a checkoff program from entering into a contract or agreement to carry out program activities with a party that engages in activities to influence any government policy or action that relates to agriculture. A board or its employees or agents acting in their official capacity may not engage in any act that may involve a conflict of interest; anticompetitive activity; unfair or deceptive act or practice; or act that may be disparaging to, or in any way negatively portray, another agricultural commodity or product. Upon approval of USDA, a board may enter directly into contracts and agreements to carry out generic promotion, research, or other activities authorized by law if the agreement or contract requires records accounting for the funds received to be submitted to the board. The board must meet specified requirements regarding the publication of budgets and disbursements of funds. The USDA Inspector General and the Government Accountability Office must conduct specified audits regarding checkoff programs.

Voluntary Checkoff Program Participation Act This bill prohibits mandatory or compulsory checkoff programs and requires producer participation in the programs to be voluntary at the point of sale. A checkoff program is a program to promote and provide research and information for a particular agricultural commodity without reference to specific producers or brands.
