Minimum Wage Requirements; Citing this act as the “On-the-Job Workforce Training Act”; exempting an employer from state minimum wage requirements for specified employees; authorizing employees to voluntarily opt out of the state minimum wage requirements by signing a waiver; prohibiting an employer from coercing an employee into opting out of the state minimum wage; requiring employers to pay an employee at or above the federal minimum wage, etc.

Department of Business and Professional Regulation; Revising the primary investigative, enforcement, and prosecutorial responsibilities of law enforcement officers appointed by the Division of Alcoholic Beverages and Tobacco within the Department of Business and Professional Regulation; revising the lists of persons or entities that may request copies of certain documentation relied on by an employer to verify a new employee’s employment eligibility to include the department; revising a provision prohibiting talent agencies from sending or causing to be sent any employee or minor to certain locations for certain purposes; providing that a public lodging establishment or public food service establishment that distributes or sells hemp extract in violation of the state hemp program is subject to specified penalties, etc.

Employment Eligibility; Requiring that all private employers, rather than only those employing more than a specified number of employees, use the E-Verify system to verify a new employee’s employment eligibility beginning on a specified date, etc.

Unauthorized Aliens; Prohibiting the Department of Financial Services from issuing a license or certification to unauthorized aliens; authorizing a county to require a borrower to provide proof of being lawfully present in the United States; authorizing the Division of Risk Management to approve or deny claims relating to a minor who is an unauthorized alien; requiring that certain procedures, instruction, and testing be conducted in English; prohibiting certain entities and corporations from providing down payment assistance to unauthorized aliens, etc.

Felony Battery; Revising the elements of the offense of battery by strangulation to delete creating a risk of or causing great bodily harm to another; revising the elements of the offense of domestic battery by strangulation to delete creating a risk of or causing great bodily harm to another; reclassifying the offense of battery by strangulation for the purposes of the offense severity ranking chart of the Criminal Punishment Code, etc.

Waste Management; Deleting obsolete provisions that provide legislative findings and require the Department of Environmental Protection to review and update a specified report; preempting the regulation of auxiliary containers to the state; permitting rules, regulations, or ordinances restricting the use of glass auxiliary containers within the boundaries of a public beach; authorizing the Division of Recreation and Parks to regulate auxiliary containers within state parks; specifying that certain local ordinances and restrictions are permitted, etc.

Virtual Currency Transfers; Providing that requests by a defendant, regardless of location, to residents of this state to transfer virtual currency to an account located outside of this state subjects the defendant to the jurisdiction of the state courts, etc.

Attorney Fees and Costs for Motor Vehicle Personal Injury Protection Benefits; Providing that prevailing parties in suits by certain health care providers for overdue medical benefits under motor vehicle personal injury protection policies are entitled to reasonable attorney fees and costs, etc.

Restrictions on Employer-owned Life Insurance Policies; Authorizing employer-owned life insurance policies covering certain key persons of business entities, organizations, companies, and corporations under specified circumstances; providing that premiums, loan interests, and expenses related to employer-owned life insurance are not tax deductible; specifying that insurers that violate certain provisions are subject to a fine of up to $1 million per violation and may have its authority to transact insurance suspended or revoked, etc.

Habitual Felony Offenders, Habitual Violent Felony Offenders, Three-time Violent Felony Offenders, and Violent Career Criminals; Revising the definitions of the terms “habitual felony offender,” “habitual violent felony offender,” “three-time violent felony offender,” and “violent career criminal”; revising the procedures that a court must follow in separate proceedings to determine whether a defendant is a habitual felony offender, a habitual violent felony offender, a three-time violent felony offender, or a violent career criminal, etc.
