Civil Remedies; Creates rebuttable presumption that lodestar fee is sufficient & reasonable attorney fee in most civil actions; reduces statute of limitations for negligence actions; provides standards for bad faith actions; provides for distribution of proceeds when two or more third-party claims arising out of single occurrence exceed policy limits; limits applicability of provisions relating to attorney fees in certain actions against insurers; provides standards for evidence to prove damages for medical expenses in certain civil actions; requires certain disclosures with respect to claims for medical expenses for treatment rendered under letters of protection; requires trier of fact to consider fault of certain persons who contribute to an injury; provides that owner or principal operator of multifamily residential property which substantially implements specified security measures on that property has presumption against liability in connection with certain criminal acts that occur on premises; revises provisions relating to immunity from liability for injury to trespassers on real property; specifies applicability of provisions relating to offer of judgment & demand for judgment.
Housing; Removes authority of local governments to adopt or maintain laws, ordinances, rules, or other measures that would have effect of imposing controls on rents; specifies requirements & restrictions on counties in approving housing developments; authorizes local governments to adopt ordinances to provide ad valorem tax exemption for portions of property used to provide affordable housing; revises total amount of community contribution tax credits which may be granted for projects; provides sales tax exemption for building materials used in construction of affordable housing units; authorizes department to make information available to corporation to administer Live Local Program; prohibits deduction of General Revenue Fund service charge on documentary stamp tax proceeds; provides appropriations. Guardianship; Revises provisions relating to guardianships, including the appointment of public guardians, visitation rights of minor’s or alleged incapacitated person’s family, alternatives to guardianship, petitions for appointment of guardian, & verified inventory & annual accounting requirements; requires full reevaluation of need for guardianship after certain time; prohibits certain judges from overseeing reevaluation proceedings; requires court to impanel jury for certain purpose.
Transportation Facility Designations; Designates 98 Points of Light Way in Miami-Dade County; directs DOT to erect suitable markers.
Pharmacies and Pharmacy Benefit Managers; Revises entities conducting pharmacy audits to which certain requirements & restrictions apply; authorizes audited pharmacies to appeal certain findings; provides that health insurers & HMOs that transfer certain payment obligation to pharmacy benefit managers remain responsible for specified violations; provides penalty for failure to register as pharmacy benefit managers.
School Safety; Revises provisions relating to Marjory Stoneman Douglas High School Public Safety Commission, FortifyFL, Commissioner of Education oversight of enforcement of school safety and security requirements, Office of Safe Schools, certain emergency drills, family reunification plans, threat assessment teams, safe-school officers, DOE responsibilities, & Florida Safe Schools Assessment Tool.
Protective Injunctions; Specifies timeframe in which clerk of court must transmit specified documents relating to protective injunctions to appropriate local sheriff or law enforcement agency; provides for electronic transmission of certain documents rather than by facsimile; provides that electronically submitted copies of injunctions must be served in same manner as certified copies.
