Complaints Against Law Enforcement and Correctional Officers

Complaints Against Law Enforcement and Correctional Officers; Requires copy of complaint, signed by complainant under oath, to be provided to law enforcement officers & correctional officers who are under investigation before any interrogation begins; provides exception if complaint is accompanied by corroborating evidence; prohibits certain personnel actions from being taken against law enforcement officer or correctional officer unless such officer receives copy of complaint signed by complainant under oath unless certain exception applies; requires certain investigative files to be included in officer's personnel file; prohibits investigation that does not result in imposition of disciplinary action from affecting officer's ability to receive promotion, raise, or any other commendation; requires complaint against law enforcement officer or correctional officer to be in writing & signed under oath by person filing complaint unless certain exception applies; provides penalties for making false complaint.

Health Care; Defines "treat," "treated," & "treatment"; authorizes individual to refuse examination, testing, or treatment for specified reasons; prohibits discrimination against patient based on patient's vaccination status; requires licensed health care practitioners to inform parent or legal guardian of minor child of risks, benefits, safety, & efficacy of specified vaccines, obtain signature from parent or legal guardian before administration of vaccine, & provide parent or legal guardian with option of alternative vaccination schedule; authorizes pharmacist to provide ivermectin without prescription; requires pharmacist to provide specified information to patient; provides pharmacists with immunity from civil & criminal liability & disciplinary action; authorizes Board of Pharmacy to adopt rules; authorizes parent to exempt their child from health examination or from administration of immunizing agents based on conscience grounds; requires DOH to make publicly available, by posting on its Internet website, exemption form for parents & legal guardians.

Electronic Monitoring Devices in Long-term Care Facilities; Defines "electronic monitoring device" & "representative"; authorizes resident, or his or her representative, of nursing home facility or assisted living facility, respectively, to install & use electronic monitoring device in resident's room if specified conditions are met; provides for consent of resident living in shared room with resident who intends to install device; authorizes other resident or his or her representative to impose conditions on consent; provides for withdrawal of consent & modification of conditions; requires AHCA to adopt forms by rule; prohibits facilities from denying admission or otherwise discriminating against resident for installing electronic monitoring device; provides administrative penalty; provides criminal penalty for unlawfully obstructing, tampering with, or destroying electronic monitoring device or recording made by such device; specifies who may view or listen to images broadcast or recorded by electronic monitoring device.
