Rep. Webster Barnaby

Protection of Historic Monuments and Memorials; Prohibits certain acts concerning historic monuments & memorials on public property; provides for standing to bring civil actions; provides civil penalties for officials who engage in certain actions; provides local government is liable in certain instances; requires state to restore or relocate monument or memorial in certain circumstances; prohibits distribution of funding to local governments until they reimburse state; authorizes removal or temporary relocation of monument or memorial in certain instances provided certain requirements are met; specifies certain duties of Division of Historical Resources & Department of Veterans' Affairs.

Manufacturing ; Revises duties of Department of Commerce; establishes Chief Manufacturing Officer for certain purpose; provides organizational structure & responsibilities for Chief Manufacturing Officer; directs all state & local governmental entities to assist Chief Manufacturing Officer; requires department to prepare & submit to Governor & Legislature specified report regarding manufacturing efforts in this state by specified date; creates Florida Manufacturing Promotional Campaign for specified purpose; requires department to take certain actions in promoting campaign; requires persons that participate in campaign to register annually with department.

Apprenticeship and Preapprenticeship Program Funding; Revises requirements for uniform minimum standards & policies governing apprenticeship & preapprenticeship programs & agreements to include requirements for partnerships between local educational agencies & apprenticeship & preapprenticeship programs; revises required date for specified report on apprenticeship & preapprenticeship programs; requires DOE to develop standard model contract template for local educational agencies & apprenticeship & preapprenticeship programs; provides requirements for local educational agencies & apprenticeship & preapprenticeship programs that enter into partnership agreements; requires DOE to develop apprenticeship funding transparency tool; provides requirements for District Workforce Education Funding Steering Committee meetings; provides requirements for certain workpapers; authorizes such meetings to be held using communications media technology.

Former Phosphate Mining Lands; Provides conditions for cause of action against certain former phosphate mine sites; provides for certain notice of former phosphate mines; requires DOH to conduct surveys of former phosphate land parcels upon petition; requires that specified documentation of radiation levels be submitted in certain civil actions related to phosphate mining.

Utility Services; Requires certain public meetings as condition precedent to effectiveness of new or extended agreement under which municipality will provide specified utility services in other municipalities or unincorporated areas; limits portion of certain utility revenues that municipality may use to fund or finance general government functions; requires excess revenues to be reinvested into municipal utility or returned to customers; revises provisions relating to permissible rates, fees, & charges imposed by municipal water & sewer utilities on customers located outside municipal boundaries; requires municipalities that provide specified utility services to report certain information by specified date, & annually thereafter, to PSC; requires PSC to compile such information & submit report by specified date, & annually thereafter, to Governor & Legislature; prohibits boards, agencies, commissions, & authorities of any county, municipal corporation, or political subdivision from restricting or prohibiting fuel sources & appliances used to provide energy to consumers.

Reading Interventions and Instruction; Revises requirements relating to Just Read, Florida! Office, Florida Center for Reading Research, school district reading instruction plans, & school district professional learning system to include specified training & instruction related to reading interventions & instruction; & creates reading coach allocation.

Local Option Taxes; Revising provisions related to Local Option Taxes including Tourist Development Tax, Local option food and beverage tax, & discretionary sales surtax.

Regulation of Xylazine; Excepts from list of Schedule I controlled substances certain xylazine animal drug products approved by USDA & used for certain purposes; provides criminal penalties & requiring mandatory minimum term of imprisonment specified offenses involving xylazine.

Arrest Warrants for State Prisoners; Authorizes prisoner in state prison who has unserved warrant to file notice of such unserved warrant in circuit court where warrant was issued; requires prisoner to serve notice on state attorney; requires court to schedule status hearing within certain time; specifies procedures; provides for prosecution of violation.

Community-based Care Lead Agency and Subcontractor Liability; Lowers dollar amount limit of net economic damages in tort actions brought against lead agencies & subcontractors; provides that lead agencies & subcontractors that are direct providers of foster care & related services are not liable to pay any claim or judgment that exceeds specified amount; provides that attorney may not charge, demand, receive, or collect for services rendered fees that exceed specified amount of any judgment or settlement.
