State Courts System; Revising the availability of judges to require at least one circuit judge in each circuit to be available for hearings with limited notice; revising the duty of the Florida Clerks of Court Operations Corporation to provide an annual budget request to be pursuant to specified provisions; deleting the per diem cap for arbitrators who participate in court-ordered, nonbinding arbitration; authorizing judges to authenticate a jurat, or certificate of proof or acknowledgment, by affixing their signature and printing their name, title, and court, etc.
General Permits for Distributed Wastewater Treatment Systems; Authorizing the Secretary of Environmental Protection to grant a general permit for the replacement of an existing onsite sewage treatment and disposal system with a distributed wastewater treatment system under certain circumstances; providing for the installation of distributed wastewater treatment units to proceed without any further action by the Department of Environmental Protection if a permittee submits a notification to the department at least a specified number of days before installation, etc.
Florida Institute for Human and Machine Cognition, Inc.; Requiring the board of directors of the Florida Institute for Human and Machine Cognition, Inc., rather than the Board of Governors, to authorize the creation of a subsidiary of the corporation; revising the composition of the board of directors of the corporation; authorizing subsidiaries of the corporation to enter into certain affiliation agreements, etc.
Trusts; Revising how an authorized trustee may exercise the power to invade principal as an authorized trustee administering a trust; providing that property devised to or from a revocable trust which is devised, given, or distributed to a donee by a settlor during the settlor’s lifetime is treated as a satisfaction of devise to that donee if certain criteria are met; providing that homestead property transferred by one or both settlor spouses to a community property trust will not be treated as a change of ownership for the purposes of reassessing the property, etc.
Telecommunications Access System Act of 1991; Revising the powers and duties of the Florida Public Service Commission in overseeing the administration of the telecommunications access system; revising the duties of the system’s administrator; revising the procedures required for the distribution of specialized telecommunications devices; revising the composition of the advisory committee appointed to assist the commission with implementing the act, etc.
OGSR/Department of Financial Services; Amending a provision which provides an exemption from public records requirements for certain records made or received by the Department of Financial Services acting as receiver pursuant to specified provisions; revising the list of records that are exempt from public records requirements; removing the scheduled repeal of the exemption, etc.
Fraudulent Use of Gift Cards; Providing criminal penalties for persons who, with the intent to defraud, commit specified prohibited acts related to gift cards; providing criminal penalties for persons who, with the intent to defraud, use for certain purposes gift cards or gift card redemption information; providing enhanced criminal penalties, etc.
Limited Liability Companies; Defining the terms “registered foreign protected series of a foreign series limited liability company” and “registered foreign series limited liability company”; specifying that certain limited liability companies are considered a nonresident under certain circumstances; creating the “Uniform Protected Series Provisions”; providing powers and prohibitions for protected series of series limited liability companies; authorizing domestic limited liability companies to establish protected series, etc.
Exploitation of Vulnerable Adults; Authorizing the use of substitute service on unascertainable respondents; requiring the court to enter an order providing for specified service when a petitioner files the sworn affidavit; requiring that any proposed transfer of funds or property in dispute be held for a specified time period, etc.
Warranty Associations; Revising the requirements of contractual liability insurance policies; revising the circumstances under which certain service warranty associations are not required to establish unearned premium reserves or to maintain contractual liability insurance and are authorized to allow their premiums to exceed specified ratios; requiring that contracts that include coverage for accidental damage from handling be covered by a specified policy, etc.
Aerospace Industry; Requiring Space Florida to administer the International Aerospace Innovation Fund; establishing the International Aerospace Innovation Fund; providing the purpose and duties of the fund; requiring Space Florida to establish an application process for projects seeking funding from the fund, etc.
Spring Restoration; Authorizing certain domestic wastewater treatment facilities to request the incorporation of reclaimed water projects identified in Outstanding Florida Springs recovery or prevention strategies; requiring the Department of Environmental Protection to approve such requests within a certain period of time if certain conditions are met, etc.
