Fiscal State of the Nation Resolution This concurrent resolution requires the congressional budget committees to conduct an annual joint hearing to receive a presentation from the Comptroller General regarding (1) the Government Accountability Office's audit of the financial statement of the executive branch, and (2) the financial position and condition of the federal government.
Local Infrastructure Funding & Technical Assistance Act or the LIFT Act This bill authorizes the Department of Commerce to provide grants under the Public Works and Economic Development Act of 1965 for predevelopment projects—measures required to be completed before construction of resilient climate infrastructure occurs—and related technical assistance. Grants may be provided to economic development districts, states, Indian tribes, local governments, institutions of higher education, individuals, and other organizations as specified by the bill.
Affordable Prescriptions for Patients Act of 2021 This bill prohibits product hopping by drug manufacturers, authorizes the Federal Trade Commission to enforce this prohibition, and imposes limits on patent litigation involving biological products. Generally, product-hopping describes a situation where, when the patents on a reference drug (or biological product) expire, the manufacturer switches to a follow-on product that is covered by a later-expiring patent. Under this bill, a follow-on product is a modified version of the reference drug that shares an indication (what the drug is used for) with the reference drug. The bill presumes product hopping has occurred when a reference drug manufacturer, after receiving notice that the Food and Drug Administration (FDA) has received an application to market a competing generic (or biosimilar) version, takes certain actions such as withdrawing the reference drug from the market and selling a follow-on product. A drug manufacturer may rebut these presumptions by demonstrating that its conduct was not intended to limit competition. The bill also limits in certain instances the number of patents that a reference biological product manufacturer can assert in a patent infringement lawsuit against a company seeking to sell a biosimilar version. Specifically, if the biosimilar manufacturer completes certain actions as part of an abbreviated pathway to get FDA market approval, the bill limits, subject to exceptions and waivers, the number of certain types of patents that the reference product manufacturer may assert, such as patents filed more than four years after the reference product received market approval.
VA Quality Health Care Accountability and Transparency Act This bill requires the Department of Veterans Affairs (VA) to make certain staffing and quality of care data publicly available on a specified VA website. Among other elements, the information published on the website should include statistics related to patient wait times, effectiveness of care, and staffing and vacancy information. The website must be (1) directly accessible from the main VA website and the main websites of each VA medical center, and (2) understandable and usable by the general public. The VA must implement a self-auditing process to assess the accuracy and completeness of the data available on the website.
Ensuring Survivor Benefits during COVID-19 Act of 2021 This bill requires the Department of Veterans Affairs (VA) to obtain a medical opinion that determines whether a service-connected disability was the principal or contributory cause of death for a veteran who died from COVID-19. Specifically, the VA must obtain this determination before notifying a claimant for survivor benefits of the final decision regarding such benefits in any case where a dependency and indemnity compensation claim is filed in relation to a veteran with one or more service-connected disabilities who dies, the death certificate for the veteran identifies COVID-19 as the principal or contributory cause of death, the death certificate does not clearly identify any of the service-connected disabilities as the principal or contributory cause of death, the veteran's service-connected disability includes a condition more likely to cause severe illness from COVID-19, the claimant is not entitled to certain dependency and indemnity compensation benefits, and the evidence to support the claim does not result in a preliminary finding in favor of the claimant. The VA must provide information to veterans, their dependents, and veterans service organizations about applying for dependency and indemnity compensation when a veteran dies from COVID-19. Such information must be available through the VA's website and via other outreach mechanisms.
Local Journalism Sustainability Act This bill allows individual taxpayers a tax credit up to $250 in any taxable year for subscriptions to one or more local newspapers for the taxpayer's personal use. It also allows a local news journalist employer a payroll credit for wages paid to local news journalists. The bill allows certain small businesses a tax credit for amounts paid for advertising in a local newspaper or through a broadcast of a radio or television station serving a local community.
This resolution designates June 2021 as National Post-Traumatic Stress Awareness Month and June 27, 2021, as National Post-Traumatic Stress Awareness Day. The resolution supports (1) the education of members of the Armed Forces, veterans, their families, and the public about post-traumatic stress; and (2) efforts by the Department of Veterans Affairs and the Department of Defense to foster cultural change around the issue of post-traumatic stress. The resolution also encourages the leadership of the Armed Forces to support treatment of members of the Armed Forces who suffer from post-traumatic stress.
Demand-Response Management Act of 2021 This bill requires electric utilities to promote the use of demand-response practices by commercial, residential, and industrial consumers to reduce electricity consumption during periods of unusually high demand. It also provides a variety of incentives for demand-response technologies and practices.
