This Act makes a technical correction to SB 169 by changing the designations of the new statutes and incorporates Senate Amendment No. 1 to Senate Bill No. 169.
This bill allows first-time home buyers to pay their portion of the realty transfer tax at the rate that was in effect prior to the increase that took effect on August 1, 2017. The credit is calculated as 0.5% of the first $400,000 in home value, with a maximum allowable credit of $2,000. This legislation is retroactive for any first-time home buyer who entered into a transaction for the transfer of real estate on or after August 1, 2017. The seller in any transaction with a first-time buyer will still pay the current tax rate. The bill also removes a provision that applied to contracts entered into prior to 1971, since such provision is no longer relevant. For ease of application, the new definition of "first-time home buyer" is cross-referenced in the already existing Code provision directing the counties to exempt such buyers from any county-imposed realty transfer tax. This reduction in the tax rate for first-time home buyers will be effective for transactions entered into on or after the effective date of this Act.
This act provides greater flexibility for County and Municipal governments to enter into public-private partnerships for public lands. These agreements provide opportunities for the preservation of public land and limit the amount of government money required to maintain the land. This act is intended to abrogate the restrictions on permitted uses for public land, including public parks, held in a public trust as provided in the common law, including the restrictions set forth in Anderson v. Mayor and Council of Wilmington. 137 A.2d 521 (Del. Ch. 1958) and City of Wilmington v. Lord. 332 A.2d 414 (Del. Ch. 1975). aff'd, 378 A.3d 635 (Del. 1977).
In January of 2018 the federal government passed the Federal Register Printing Savings Act, which included a moratorium in calendar year 2019 on a fee paid by health insurance companies or health service corporations to the federal government. The State of Delaware wants to ensure that savings received by the health insurers are passed along to Delaware consumers who buy health insurance plans in the individual market both on and off the health exchanges created by the Patient Portability and Affordable Care Act of 2010. This resolution requires health insurers who received this moratorium to file a report with the Secretary of the Department of Health and Social Services and the Insurance Commissioner of Delaware no later than January 2, 2019 outlining how they passed along savings to Delaware consumers.
This Act restores the Delaware Prescription Drug Payment Assistance Program (“Program”), which was eliminated in the Fiscal Year 2018 Annual Appropriations Act. This Act replaces Senate Bill 148 and makes the following additional changes: (1) Delays implementation of the Act until January 1, 2019, to coordinate with the Medicare Part D benefit year to enable the Department of Health and Social Services (“Department”) to make necessary system changes. (2) Makes changes to the defined term “prescription drugs.” (3) Removes provisions required to be included in rules and regulations promulgated by the Department. (4) Adds provisions that may be included in rules and regulations promulgated by the Department. (5) Makes technical corrections to conform the provisions of the restored Program to the standards of the Delaware Legislative Drafting Manual.
This Resolution honors Secretary of the Senate Bernard J. Brady by declaring June 30 to be “Bernard J. Brady Day in the Delaware State Senate.” It further thanks him for his 39 years of unequalled service to the Delaware State Senate.

This bill provides for a residential electrician license. A residential electrician license allows for a person to conduct residential electrical work without having to be under the direct onsite supervision of a licensed master electrician, master electrician special, limited electrician, limited electrician special or journeyperson electrician. Electricians with a residential electrician license are permitted to perform electric work performed on or within a residential dwelling or building prior to the dwelling or building being connected to the electric grid, or work to or beyond the breaker panel or fuse box in a residential dwelling or building, or residential low voltage electric work.
This Act expands the total number of vice-chancellors on the Court of Chancery to 6 and makes technical corrections to conform existing law to the standards of the Delaware Legislative Drafting Manual.
This Resolution recognizes the importance of the 2020 census and calls on state and local government to commit to a complete count. Federal dollars are often based on the population count of each state and it is vitally important to ensure that the State of Delaware is fully counted to ensure accuracy in the disbursement of federal dollars. The Resolution calls upon the Governor to establish a “Complete Count Commission” for the purpose of ensuring the State of Delaware is fully counted in the 2020 census.
