Starting December 31, 2023, the act requires each entity described below to label packages of premoistened, nonwoven disposable wipes (covered product) with the phrase "Do Not Flush": A manufacturer of a covered product that is sold or offered for sale in this state; and A wholesaler, supplier, or retailer that is responsible for the labeling or packaging of a covered product. The act outlines the parameters to which the labeling must adhere in order to comply with state and federal requirements, as applicable, and specifies that a violation of the requirements of the act is a deceptive trade practice under the "Colorado Consumer Protection Act". Most real property is reassessed every odd-numbered year. The bill establishes a one-time exception by making the reassessment cycle beginning on January 1, 2021, a 4-year cycle so that the next reassessment cycle will begin in 2025 instead of 2023. Under current law, for the 2023 property tax year, the actual value used for purposes of valuation for assessment is reduced for commercial real property by $30,000 and for residential real property by $15,000. The bill eliminates these reductions. The bill also sets the assessment rates for nonresidential real property and multi-family residential real property for the 2024 property tax year, so that they are the same rates as for the 2023 property tax year. Lastly, the bill ensures that the actual value of property used for purposes of valuation for assessment does not increase by more than 5% between 2022 and 2025, for property that does not have an unusual condition which results in an increase or decrease in actual value. The act requires out-of-state online dealers and salespersons selling motor vehicles or powersports vehicles to submit to the jurisdiction of the motor vehicle dealer board (board) when selling to a Colorado consumer. The act does not require these online dealers and salespersons to obtain a Colorado dealer license or have a physical location in Colorado but requires them to comply with Colorado laws and the board's rules. The bill creates a new county impact note that analyzes the potential impact of a pending bill on a county or a city and county. The legislative council staff will draft county impact notes for up to 20 legislative measures per session, unless more are allowed by the director of research of the legislative council. A county, a city and county, a statewide organization or organizations representing counties or cities and counties, and the department of local affairs are required to cooperate with and provide information for the legislative council staff in preparing county impact notes.(Note: This summary applies to this bill as introduced.)
The bill requires any intercollegiate, interscholastic, intramural, or club athletic team, sport, or athletic event to be designated as one of the following, based on the biological sex at birth of the participating students: Male, female, or coeducational. Male and female athletes may only participate on teams designated to their respective sexes. The bill prohibits a governmental entity from investigating a complaint or taking any adverse action against a public school, school district, activities association or organization, institution of higher education, or any employee or governing board member for complying with the bill. The bill creates a cause of action for a student, school, or institution that suffers harm as a result of noncompliance with the bill. There is also a cause of action for a student who suffers retaliation for reporting violations of the bill. The statutes of limitations for the causes of action are 2 years and a prevailing party is entitled to reasonable attorney fees. The attorney general is required to provide legal representation to a school, school district, association, or institution of higher education that is sued for complying with the bill. On January 1, 2024, the statewide paid family and medical leave insurance program will begin allowing covered individuals to take paid family and medical leave for qualifying reasons. The bill postpones the implementation of this program for one year, to January 1, 2025. The bill requires the division of paid family and medical leave insurance to credit employers for premiums paid between January 1, 2023, and March 1, 2023, as an offset against premiums owed starting January 1, 2024.(Note: This summary applies to this bill as introduced.)
