SB 336: Earthquake insurance: rates.

Existing law establishes the California Earthquake Authority and authorizes the authority to transact insurance in this state as necessary to sell policies of basic residential earthquake insurance. Existing law requires that the rates established by the authority be actuarially sound so as to not be excessive, inadequate, or unfairly discriminatory. Existing law provides that policyholders who have retrofitted their homes to withstand earthquake shake damage according to standards and to the extent set by the governing board of the authority shall enjoy a premium discount or credit of 5 percent on the authority-issued policy of residential earthquake coverage. Existing law authorizes the board to approve a premium discount or credit above 5 percent if the discount or credit is determined by the authority to be actuarially sound. This bill would instead provide that those policyholders shall enjoy a premium discount or credit of at least 5 percent on the authority-issued policy of residential earthquake coverage. The bill would also make nonsubstantive, technical changes.

SB 207: California Global Warming Solutions Act of 2006: Greenhouse Gas Reduction Fund.

The California Global Warming Solutions Act of 2006 establishes the State Air Resources Board as the state agency responsible for monitoring and regulating sources emitting greenhouse gases. The act authorizes the state board to include the use of market-based compliance mechanisms. Existing law requires all moneys, except for fines and penalties, collected by the state board from the auction or sale of allowances as part of a market-based compliance mechanism to be deposited in the Greenhouse Gas Reduction Fund and to be available upon appropriation by the Legislature. Existing law requires a state agency expending moneys from the fund to create a record, prior to the expenditure, that includes, among other things, a description of the expenditure proposed to be made and a description of how the proposed expenditure will contribute to achieving and maintaining greenhouse gas emissions reductions, as specified. This bill would require that record to be posted on the Internet Web sites of the state agency and the State Air Resources Board prior to the state agency expending those moneys.

SB 431: Vehicles: driver-assistive truck platooning.

Existing law prohibits a driver of a motor vehicle from following another vehicle more closely than is reasonable and prudent, having due regard for the speed of the vehicle and the traffic upon, and the condition of, the roadway. This bill would require a determination of a reasonable and prudent distance between 2 vehicles, for those purposes, to take into account presence of vehicle automation technology, as described. Existing law requires motor vehicles being driven in a caravan or motorcade outside of a business or residence district to be operated so as to allow sufficient space, and in no event less than 100 feet, between each vehicle or combination of vehicles so as to enable any other vehicle to overtake or pass. This bill would provide that a caravan or motorcade consists of 3 or more motor vehicles. This bill would declare that it is to take effect immediately as an urgency statute.

AB 1523: Attorneys.

Existing law, the State Bar Act, provides for the licensure and regulation of attorneys by the State Bar of California, a public corporation. Existing law requires an attorney or law firm receiving or disbursing trust funds to establish and maintain an IOLTA account, as defined, in which the attorney or law firm is required to deposit or invest all specified client deposits or funds. Existing law requires an attorney or law firm establishing an IOLTA account to report IOLTA account compliance and all other IOLTA account information required by the State Bar in the manner specified by the State Bar. This bill would make a technical correction to a definition related to IOLTA accounts.
