Existing law authorizes the governing board of a school district maintaining secondary schools, with the approval of the State Department of Education, to establish and maintain classes for adults, except programs and classes in outdoor science education and conservation education, for the purpose of providing instruction in civic, vocational, literacy, health, homemaking, technical, and general education. This bill would state the intent of the Legislature to enact legislation that would pertain to adult education.
Existing law requires a vehicle proceeding upon a highway at a speed less than the normal speed of traffic to drive in the right-hand lane for traffic or as close as practicable to the right-hand edge or curb, with exceptions. This bill would make technical, nonsubstative changes to that law.
Existing law authorizes a court to order a person who is convicted of a traffic violation, with his or her consent, to attend a licensed traffic violator school, a licensed driving school, or any other court-approved program of driving instruction in lieu of adjudicating the traffic offense if the person holds a noncommercial class C, class M1, or class M2 driver's license, except as specified. This bill would make a technical, nonsubstantive change to these provisions.
Existing law, for the purposes of assessments for fire suppression, defines fire suppression to mean firefighting and fire prevention, including, but not limited to, vegetation removal or management undertaken, in whole or in part, for the reduction of a fire hazard. This bill would make a technical, nonsubstantive change to this provision.
Existing law defines, among other things "sustainable green building" and "green business program" for the purposes of conserving natural resources and protecting the environment. This bill would state the intent of the Legislature to enact legislation that would define "green jobs."
Existing law generally makes it unlawful for any person to engage in the business of guiding or packing, or to act as a guide for any consideration or compensation whatever, without first having secured a guide license from the Department of Fish and Game. Existing law exempts an employee of a licensee who acts as a guide only in connection with, and within the scope of, his or her employment, and a person who is licensed in another state to provide guide services for the purposes of fishing, if certain conditions are met. This bill would make technical, nonsubstantive changes to those provisions.
Existing law prohibits an investment firm, as defined, from having specified interests in a new issuance of bonds from a local agency. This bill would prohibit a local agency from entering into a financial advisory, legal advisory, underwriting, or similar relationship with an individual or firm, with respect to a bond issue that requires voter approval on or after January 1, 2010, if that individual or firm, or an employee, agent, or person related to an employee or agent of the individual or firm, provided or will provide bond campaign services, as defined, to the bond campaign.
Existing law establishes the Home Purchase Assistance Program, administered by the California Housing Finance Agency, to assist first-time homebuyers to utilize existing mortgage financing. Existing law authorizes the agency to provide mortgage insurance for home purchase assistance provided pursuant to the program and limits the moneys provided for mortgage insurance to 15%. This bill would make a technical, nonsubstantive change to this provision of law.
The California Stem Cell Research and Cures Act, an initiative measure approved by the voters at the November 2, 2004, statewide general election as Proposition 71, establishes the California Institute for Regenerative Medicine (CIRM) , the purpose of which is, among other things, to make grants and loans for stem cell research, for research facilities, and for other vital research opportunities to realize therapies, protocols, and medical procedures that will result in the cure for, or substantial mitigation of, diseases and injuries. Existing law establishes the Independent Citizen's Oversight Committee (ICOC) composed of appointed members, that is required to perform various functions and duties with regard to the operation of the institute, including, but not limited to, establishing standards applicable to research funded by the institute. Existing law prohibits amendment of Proposition 71 by the Legislature unless the amendment is approved by the voters, or the amendment is accomplished by a bill introduced after the first 2 full calendar years and approved by a vote of 70% of both houses, and only if the amendment enhances the ability of the institute to further the purposes of the grant and loan programs. The act provides that the ICOC shall establish standards that require that all grants and loan awards under the act shall be subject to intellectual property agreements that balance the opportunity of the state to benefit from the patents, royalties, and licenses that result from basic research, therapy development, and clinical trials with the need to ensure that essential medical research is not unreasonably hindered by the intellectual property agreements. This bill would require that intellectual property standards that the ICOC develops shall include a requirement that each grantee and the licensees of the grantee submit to the CIRM for approval a plan that will afford uninsured Californians access to any drug that is, in whole or in part, the result of research funded by the CIRM, and would require that the plan shall require that the grantees and licensees thereof provide drugs to California state and local government funded programs at one of the three benchmark prices in the California Discount Prescription Drug Program, except when the ICOC adopts a waiver, as specified.
Existing law, the Real Estate Law, governs the licensure and regulation of real estate salespersons and real estate brokers. Existing law makes it unlawful for a person to, among other things, engage in the business of a real estate broker or a real estate salesman without a license. This bill would make technical and nonsubstantive changes to those provisions.
Existing law regulates the taking or possession of birds, mammals, fish, amphibians, and reptiles and generally provides that a violation of the fish and game laws is a crime.This bill would make technical, nonsubstantive changes to that violation provision.
Existing law imposes specified duties on state governmental agencies and provides for public access to government records. This bill would require, by no later than January 1, 2010, each state department and agency to develop and operate a searchable Internet Web site, as defined. The bill would also require the searchable Internet Web site to include specified information relating to each expenditure of state funds, as defined, made by that state department or agency in the most recently completed fiscal year, the ability of the user to view information in a format that may be downloaded and managed by the user, and the ability of users to provide input regarding the utility of, and recommendations for, improvements to the searchable Internet Web site.
