S 3146: WALL Act of 2021

WALL Act of 2021 This bill appropriates $25 billion for the construction of a wall on the U.S.-Mexico border and addresses other issues related to immigration. As offsets to this spending, the bill restricts the child tax credit, earned income credits, and lifetime learning credits to those with Social Security numbers and not prohibited from employment in the United States. Also, individuals who file taxes using an individual taxpayer identification number (ITIN) instead of a Social Security number must pay a fee ($300 for each individual on the tax return who was issued an ITIN). The bill restricts eligibility for certain federally-funded benefits, including unemployment compensation, supplemental nutrition assistance, and housing benefits, to those eligible to work in the United States. Agencies administering such benefits must use the E-Verify program to confirm the eligibility of applicants for such benefits. This bill also sets fines for aliens who improperly enter the United States or overstay their visas.

S 3153: Capital Gains Inflation Relief Act of 2021

Capital Gains Inflation Relief Act of 2021 This bill allows the adjusted basis of certain assets (including any common stock in a C corporation, any digital asset, and tangible property used in a trade or business) to be indexed for inflation for the purpose of determining the gain or loss of a taxpayer (other than a corporation) who has held the asset for more than three years. The bill sets forth rules for applying the inflation adjustment to short sales; regulated investment companies; real estate investment trusts; other pass-through entities, including partnerships, S corporations, and common trust funds; dispositions between related persons; and improvements to property or contributions of capital. The Internal Revenue Service may disallow an adjustment if any person transfers cash, debt, or any other property to another person for the principal purpose of securing or increasing the adjustment allowed by this bill.

HR 5631: Tim Hart Wildland Firefighter Classification and Pay Parity Act

Tim Hart Wildland Firefighter Classification and Pay Parity Act or Tim's Act This bill addresses the pay and benefits of federal wildland firefighters and related issues. Federal wildland firefighter is defined as any temporary, seasonal, or permanent position at the Department of Agriculture (USDA) or the Department of the Interior that maintains certain group, emergency incident management, or fire qualifications and primarily engages in or supports wildland fire management activities. Specifically, (1) the Office of Personnel Management (OPM) must establish one or more classification series for federal wildland firefighter positions, and (2) USDA and the Department of the Interior shall determine each position within USDA and Interior that qualifies as a federal wildland firefighter position. The bill, among other requirements (1) establishes a pay scale for such positions, with annual adjustments; and (2) provides for hazardous duty pay. The OPM must establish guidelines for work schedules. The bill addresses issues regarding wages, unpaid leave to care for a family member, recruitment and retention bonuses, and housing allowances. USDA and Interior shall (1) establish, maintain, coordinate, and operate a voluntary tuition assistance program; (2) establish and maintain a publicly accessible, searchable Federal Wildland Firefighter Cancer and Cardiovascular Disease Database; and (3) establish and carry out a program for mental health awareness and support. Additionally, the bill provides for continuation of firefighters pension coverage in case of disability and pay parity for federal structural firefighters.

S 3143: Resolving Sexual Assault and Harassment Disputes Act of 2021

Resolving Sexual Assault and Harassment Disputes Act of 2021 This bill invalidates predispute arbitration agreements relating to sexual assault claims by an employee against an employer or other employee. The bill authorizes predispute arbitration agreements relating to sexual harassment claims, but only if such agreements allow for specified actions, such as public disclosures and referrals to law enforcement. The bill applies to agreements that are entered into on or after the bill's enactment. The Government Accountability Office must study the effects of the bill on the use of arbitration agreements and related outcomes.

S 3132: Outpatient Surgery Quality and Access Act of 2021

Outpatient Surgery Quality and Access Act of 2021 This bill establishes and modifies certain requirements relating to Medicare payments for ambulatory surgical center (ASC) services. Specifically, the bill (1) requires the payment system for ASC services to feature certain positive annual adjustments equivalent to those made with respect to hospital outpatient department (OPD) services; (2) revises quality reporting requirements to permit publicly available, side-by-side comparisons of quality measures for ASCs and OPDs in the same geographic area; and (3) requires the Centers for Medicare & Medicaid Services (CMS), when excluding requested procedures from the list of those approved to be performed in ASCs, to cite specified reasons for doing so. With respect to excluding procedures from the approved list for ASCs, the CMS may not cite as a basis for exclusion that a procedure can only be reported using an unlisted surgical procedure code. (Physicians sometimes use unlisted codes when performing new procedures or services if no existing code is adequately descriptive.) The bill also limits the copayment amount for ASC services under Medicare to that of the inpatient hospital deductible.

HR 5725: Threatened Species Protection Improvement Act of 2021

Threatened Species Protection Improvement Act of 2021 This bill provides statutory authority for the rule published on August 27, 2019, by the U.S. Fish and Wildlife Service relating to threatened species. The rule requires species listed as threatened after the issuance of the rule to be given protections tailored to the species' needs. Prior to the rule, threatened species were automatically provided with most of the protections that are provided to endangered species.

HR 5733: To codify a final rule of the United States Fish and Wildlife Service relating to the designation of critical habitat under the Endangered Species Act of 1973.

This bill provides statutory authority for the rule published on December 18, 2020, by the U.S. Fish and Wildlife Service entitled Endangered and Threatened Wildlife and Plants; Regulations for Designating Critical Habitat. The rule set forth a process for excluding areas from critical habitat designations under the Endangered Species Act of 1973.

SRES 431: A resolution supporting the right of parents to be the leading voice in the education of their children.

This non-binding Senate resolution supports parents' primary role in decisions about their children's education. It specifically opposes a Justice Department memo (issued October 4, 2021) directing federal resources to investigate parents protesting school policies, and demands that memo be rescinded. The resolution condemns efforts to restrict parental involvement in school decisions, such as limiting access to school meetings or curricula. It was introduced in response to controversies involving school board meetings in Loudoun County, Virginia, and a National School Boards Association letter comparing parent protests to domestic terrorism.

S 3095: HERD Act of 2021

Having Employees Return to Duty Act of 2021 or the HERD Act of 2021 This bill addresses federal employees who comply with Executive Order 14043 (requiring COVID-19 vaccination for federal employees). Specifically, the bill requires each federal agency, with respect to each agency employee who has complied with such order, to require the employee to work from that employee's duty station and to work the hours required as of February 15, 2020. If such an employee was not employed by the applicable agency as of that date, that requirement shall apply to the employee with respect to duty station and hours of the individual who occupied that position as of that date. An agency may implement different policies than, or supplemental policies to, those requirements, including by requiring social distancing at a particular work site, if the agency finds that (1) there is substantial transmission of COVID-19 within a community in which such requirements would otherwise be carried out, as determined by the Centers for Disease Control and Prevention; and (2) implementing those different or supplemental policies will not degrade the level of service that the agency provides to the public.

Give Americans Stability at Pumps as Rising Inflation Causes Emergencies Act or the GAS PRICE Act This bill requires the Energy Information Administration (EIA) to report on any policy, regulation, or executive order with an effective date of January 20, 2021, or later that the EIA determines has increased or may increase energy prices in the United States.
