Right of Reproductive Freedom with Protections for Health and Safety Amendment

SJR 12 proposes a constitutional amendment to protect reproductive rights in West Virginia. It would guarantee every individual the right to make decisions about contraception, fertility treatment, pregnancy continuation, miscarriage care, and abortion. The amendment prohibits state interference with these rights unless the state uses the least restrictive means to advance health, with exceptions allowing abortion bans after fetal viability only if necessary to protect the patient's life or health. This proposal, if approved by voters in 2026, would become part of West Virginia's Constitution. It is currently in the Senate Judiciary Committee for review.
