Minimum parking requirements; prohibition on mandates by localities. Provides that no locality shall adopt, enforce, or maintain any ordinance, policy, or requirement that mandates a minimum number of parking spaces for any new building, structure, or other use or any existing building, structure, or other use that is undergoing material rehabilitation, defined in the bill. The bill has a delayed effective date of September 1, 2026.
Charter; City of Virginia Beach; certain land use approvals. Amends the charter for the City of Virginia Beach by providing that no application to rezone property to a higher density or a more intense zoning district south of the blue line, as defined in the bill, shall be approved except by a recorded affirmative vote of three-fourths of all of the members elected to the city council. The bill further provides that no extension of public water and sanitary sewer shall extend south of the blue line absent a public hearing and specific findings by the city council.
Protection of employees; warehouse distribution center requirements; civil penalty; civil action. Provides that a warehouse employer, as defined in the bill, that violates the bill's provisions shall be liable to an impacted warehouse employee, as defined in the bill, for certain remedies, damages, and other relief as specified in the bill. The bill requires a warehouse employer to provide each warehouse employee a written description of each performance standard to which such employee is subject and of any potential adverse employment action that may result from such employee's failure to meet such performance standard. The bill prohibits a warehouse employer from taking an adverse action against a warehouse employee for such employee's use of a bathroom facility. The bill provides that a warehouse employer that violates the bill's provisions relating to warehouse employees is subject to a civil penalty not to exceed $5,000 for each violation.
Department of Environmental Quality; siting of large data centers; site assessment; standards; civil penalties. Requires a locality, prior to any approval of a rezoning application, special exception, or special use permit for the siting or major expansion of a large data center, as those terms are defined in the bill, to conduct an initial public hearing regarding such siting or expansion and to require the applicant to perform a site assessment including certain specified information and to submit such site assessment to the locality and the Department of Environmental Quality (the Department). The bill directs the locality to hold a second public hearing upon such submission. The bill requires the Department to review such site assessment to ensure compliance with site assessment standards established by the Department, including standards for noise impacts, light pollution and illumination at night, water usage and source impacts, air emissions, traffic and other construction-phase impacts, and other impacts of proximity to residential units and schools. The bill permits the Department to issue a notice of any violation of its provisions to a large data center, to require corrective or supplemental mitigation actions as a condition of continued approval, and to assess civil penalties against or revoke any approval for a large data center that continues such violation for more than 60 days after receiving such notice. The bill authorizes the Office of the Attorney General to bring an action against a large data center for injunctive or other appropriate relief to enforce the bill's provisions. Certain provisions of the bill have a delayed effective date of July 1, 2027. In addition, the bill directs the Department to develop site assessment standards for large data centers by July 1, 2027.
General Assembly; intergovernmental affairs; delegates to a convention for proposing amendments held under Article V of the Constitution of the United States; penalties. Provides for the selection by the General Assembly of delegates to attend a convention for proposing amendments held under Article V of the Constitution of the United States. The bill grants the General Assembly the power to recall delegates, appoint new delegates, and convene an advisory committee to oversee the conduct of delegates. The bill provides that delegates must take an oath to adhere to the instructions of the General Assembly.
Transportation network companies; minimum compensation; civil penalty. Establishes minimum compensation rates for TNC partners. The bill also prohibits gratuities from passengers from being included in TNC partner compensation calculations, authorizes TNC partners to collect gratuity in cash or electronically, and prohibits transportation network companies from limiting the amount that can be paid as gratuity through such companies' digital platforms. The bill requires the Department of Motor Vehicles (DMV) to establish a process for reporting violations and to investigate claims. The bill authorizes enforcement by civil action or by civil penalties assessed by the DMV Commissioner.
School crossing zones; institutions of higher education. Expands the definition of "school crossing zone" to include areas surrounding schools where the presence of students reasonably requires a special warning to motorists and provides that the term "school" as it relates to a school crossing zone includes public institutions of higher education and nonprofit private institutions of higher education. Currently, the definition of "school crossing zone" includes only areas surrounding schools where the presence of children requires such warning. Existing provisions of law allowing photo speed monitoring devices to be installed in school crossing zones will apply to any location that meets the expanded definition.
Assessment of costs for construction, renovation, or maintenance of courthouse, jail, or court-related facilities. Increases from two to 10 dollars the maximum sum a county or city may assess as part of the costs for any civil action filed in the district or circuit courts within its boundary, or for each criminal or traffic case in its district or circuit court in which the defendant is charged with a violation of any statute or ordinance. Such assessment shall be used for the construction, renovation, or maintenance of courthouse, jail, or court-related facilities, or to defray cooling, heating, electricity, and ordinary maintenance costs.
Electric utilities; construction and development of renewable energy facilities; powers of State Air Pollution Control Board; powers of State Corporation Commission. Repeals provisions (i) requiring the State Air Pollution Control Board to adopt regulations to reduce carbon dioxide emissions from any electricity generating unit in the Commonwealth and authorizing the Board to establish an auction program for energy allowances; (ii) prohibiting the State Corporation Commission from approving any new utility-owned generation facilities that emit carbon dioxide as a by-product of energy generation under certain circumstances; (iii) declaring that statutory allowances for energy derived from sunlight, onshore wind, offshore wind, and storage facilities are in the public interest; and (iv) relating to the development of solar and wind generation and energy storage capacity, development of offshore wind capacity, and generation of electricity from renewable and zero-carbon sources. The bill provides that planning and development activities for new nuclear generation facilities are in the public interest.
Elections; primary dates; presidential year primaries. Provides that all primaries for offices to be filled at the November election in presidential election years shall be held on the date of the presidential primary. With respect to candidates for election in November of a presidential election year, the bill also lifts the requirement that petition signatures must be collected after January 1 of the presidential election year. The bill adjusts campaign finance filing deadlines for candidates in presidential year elections to account for the March primary date.
Public safety officer; definition. Adds dispatchers and animal control officers to the definition of a public safety officer for purposes of possible selection by the Governor for the Commonwealth Public Safety Medal of Valor, presented for performance above and beyond the call of duty involving extraordinary valor in the face of grave danger, at great personal risk. However, the bill specifies that dispatchers and animal control officers are not included in the definition of public safety officer for the purpose of an injury where weather constitutes a particular risk of a public safety officer's employment to be compensable under the Virginia Workers' Compensation Act.
Possession of retail tobacco products and hemp products intended for smoking by a person younger than 21 years of age prohibited; penalty. Prohibits any person younger than 21 years of age from possessing any retail tobacco product or hemp product intended for smoking, as those terms are defined in relevant law. A violation of such prohibition is punishable by seizure and forfeiture of such retail tobacco product or hemp product for a first violation. The bill imposes a civil penalty not to exceed $100 for a second violation and a civil penalty not to exceed $250 for a third or subsequent violation. The bill also provides that a court may, as an alternative to the civil penalty, and upon motion of the defendant, prescribe the performance of up to 20 hours of community service for a second violation and up to 40 hours of community service for a third or subsequent violation, but if the defendant fails or refuses to complete the community service as prescribed, the court may impose the civil penalty. Additionally, upon such violation, the judge may enter an order suspending the motor vehicle and driver's license of such person pursuant relevant law.
