Notaries; qualifications. Prohibits a personwho has been convicted of a felony offense of (i) fraud or misrepresentationor (ii) robbery, extortion, burglary, larceny, embezzlement, fraudulentconversion, perjury, bribery, treason, or racketeering from qualifyingto be a notary, regardless of whether his civil rights have beenrestored.
Contributory negligence; motor vehicle accidentinvolving a pedestrian, bicyclist, etc. Provides that the negligenceof a pedestrian, bicyclist, or other person lawfully using a deviceother than a motor vehicle on a public highway who is involved ina collision with a motor vehicle shall not bar a plaintiff's recoveryin any civil action unless the plaintiff's negligence is (i) a proximatecause of the plaintiff's injury and (ii) greater than the aggregatedtotal amount of negligence of all the defendants that proximatelycaused the plaintiff's injury.
Virginia Public Procurement Act; use of bestvalue contracting; construction and professional services. Authorizes any public body to procure construction on a best value procurementbasis using a numerical scoring system consisting of the following:(i) technical solution, 30 percent; (ii) past performance, 30 percent,including (a) price history of cost overruns, (b) schedule historyof on-time delivery, and (c) contractor performance ratings fromthe immediately preceding five-year period; and (iii) price, 40 percent.The Request for Proposal shall contain a notice to potential offerorsthat the procurement decision will be made on a best value procurementbasis. The Request for Proposal shall describe (1) the criteria thatwill be considered in evaluating the proposals and (2) the numericalscoring system that will be used in evaluating the proposals, includingidentification of the factors and weight values set forth in thebill.
Records of financial institutions; reimbursementof costs for production. Provides that a financial institutionthat is asked to provide records related to a customer of the financialinstitution pursuant to a court proceeding shall be reimbursed bythe requesting party for the reasonably necessary and directly incurredcosts for the production of such records.
Local hunting and firearm regulation. Prohibits any city or county east of the Interstate 95 corridor from prohibiting otherwise lawful hunting of migratory game birds in the jurisdictional waters of the Commonwealth and provides that no stake or stationary waterfowl blind that is erected in such public waters shall be located less than 150 yards from any occupied residence, church, or commercial building, unless the owner gives written permission to locate the blind or stake closer to the residence, church, or commercial building.
Relief for Jack Anthony Maxwell. Providesfor the relief of Jack Anthony Maxwell, who is ineligible to participatein the state retiree health benefits program, by directing the Departmentof Human Resource Management and the Virginia Retirement System toallow Mr. Maxwell to reenter the plan despite electing to discontinueparticipating in the plan at the time of his retirement. Under currentlaw, if a retiree does not elect to participate in the plan within31 days of retirement, such person is permanently barred from participatingin the plan.
Virginia Growth and Opportunity Fund; regionalgrant awards. Requires that at least 25 percent of grants receivedby a region from the Virginia Growth and Opportunity Fund be usedto support the creation of jobs in qualified opportunity zones inthe region.
Tobacco Indemnification and Community RevitalizationFund; broadband. Authorizes the Tobacco Region RevitalizationCommission to distribute funds from the Tobacco Indemnification andCommunity Revitalization Fund to tobacco-dependent communities inan equitable manner throughout the Middle Peninsula, Northern Neck,Southside, and Southwest regions of the Commonwealth in order to expandaccess to broadband Internet in those areas.
Abuse and neglect of children; contact withother parent; penalty. Provides that any parent, guardian, orother person responsible for the care of a child under the age of18 whose willful act or omission interferes with such child's contactand relationship with the other parent, guardian, or other personresponsible for the care of such child, including unreasonably denyingthe other parent, guardian, or other person responsible for the careof such child access to or visitation with such child, is guilty of a Class 6 felony.
Capital murder of a person in a school setting;penalty. Provides that the willful, deliberate, and premeditatedkilling of any person by another when such person is upon the propertyof any child day center, any public, private, or religious preschool,elementary school, middle school, or high school, or any institutionof higher education is punishable as capital murder, a Class 1 felony.The bill also provides that any person convicted of such offenseshall be sentenced to no less than a mandatory minimum term of confinementfor life.
Virginia Board for Court Reporters. Createsthe Virginia Board for Court Reporters as an independent board toestablish the qualification of applicants for licensure or registrationof court reporters in the state. Beginning July 1, 2021, no person may engage in or offer to engage in work as a court reporter unlesshe has been licensed by the Board. The bill establishes principlesof conduct for court reporters and creates the Board for Court ReportersFund to receive licensing and registration fees to fund the licensureand registration program.
Constitution of the United States; Equal RightsAmendment. Ratifies the Equal Rights Amendment to the Constitutionof the United States that was proposed by Congress in 1972.
