SB 114: Court-ordered custody and visitation arrangements; petition for visitation by grandparent.

Visitation; petition of grandparent. Requiresthe court, in petitions for visitation filed by the grandparent ofa child where either (i) the parent is the grandparent's child andis deceased, incarcerated, or incapacitated, or has had his parentalrights terminated or (ii) the grandparent has an established relationshipwith the child and has provided a significant level of care for thechild, to consider the following factors: (a) the historical relationshipbetween the grandparent and child, (b) the motivation of the grandparentin seeking visitation, (c) the motivation of the living parent indenying visitation to the grandparent, (d) the quantity of time requestedand the effect it will have on the child's daily activities, and(e) the benefits of maintaining a relationship with the extendedfamily of the deceased parent.

SB 374: Project labor agreements; prevailing wage, collective bargaining for employees of local gov'ts, etc.

Project labor agreements; prevailing wage; collective bargaining for employees of local governments. Repeals certainprovisions of the Code that (i) require contractors and subcontractorsunder any public contract with a state agency or certain localitiesto pay the prevailing wage rate; (ii) authorize any public body,when engaged in procuring products or services or letting contractsfor construction, manufacture, maintenance, or operation of publicworks, to require bidders to enter into or adhere to project laboragreements on the public works projects; and (iii) authorize a localityto recognize any labor union or other employee association as a bargainingagent of any public officers or employees or to collectively bargainor enter into any collective bargaining contract with any such unionor association or its agents.

SB 255: Zoning; wireless communications infrastructure, application process.

Zoning; wireless communications infrastructure;application process. Provides that in its consideration of certaincommunications infrastructure applications, a locality shall notdisapprove an application if (i) the proposed new structure providesadditional wireless coverage or capacity for first responders or(ii) the proposed tower is not within a four-mile radius of an existingtower that is part of the applicant's network. Additional changesin the bill provide that a locality shall not be prohibited fromdisapproving certain applications for any zoning approval requiredfor non-administrative review-eligible projects on the basis of the fact that the proposed height of any wireless support structure,wireless facility, or wireless support structure with attached wirelessfacilities exceeds 200 feet above ground level. Current law setsthe limit at 50 feet above ground level.

SJ 37: Charter & directives for State Board of Elections; SOA to oversee & develop, etc.

Study; Secretary of Administration; State Board of Elections; electronic return of voted military-overseas ballots; pilot program; report. Requests the Secretary of Administration to oversee and develop a charter and directives for the State Board of Elections to form a working group to study implementation of electronic return of voted military-overseas ballots. In conducting its study, the State Board of Elections with the working group shall study and develop initial instructions and procedures that (i) consider issues related to accessibility, auditability, authentication, verification, and security through encryption, in order to ensure that any process implemented would guarantee the accuracy and integrity of voted military-overseas ballots, and (ii) recommend (a) security measures necessary to reasonably secure the transmission, processing, and storage of voter data from interception and unauthorized access; (b) methods for verifying and authenticating the identity of the voter electronically when registering to vote and when requesting a ballot from and returning a ballot to the voter's jurisdiction; (c) methods for the encryption of voted ballots; and (d) a procedure for security reviews after an election. The study shall focus on implementation of electronic return of voted military-overseas ballots first as a limited pilot program in 2023 and later on a statewide basis. An executive summary and report shall be submitted as no later than the first day of the 2023 Regular Session of the General Assembly.

SB 65: Alcoholic beverage control; distiller licenses to allow Internet orders and shipments.

Alcoholic beverage control; distiller licenses;Internet orders and shipments. Allows the Virginia AlcoholicBeverage Control Authority to include in its agency agreements withlicensed distillers provisions that allow distillers to sell spiritsand low alcohol beverage coolers through Internet orders and shipsuch orders to consumers and licensees within the Commonwealth. Thebill imposes certain quantity, carriage, transaction, and labelingrequirements on such sales and shipments.

SB 466: Virginia College Equity Foundation and Fund; established.

Virginia College Savings Plan; Virginia CollegeEquity Foundation and Fund. Directs the Board of the VirginiaCollege Savings Plan to invest the surplus from the fund for prepaidtuition contracts, if any, in the Virginia College Equity Fund (theFund), established by the bill. The bill provides that financial management of the Fund is the responsibility of the Board of theVirginia College Savings Plan but authorizes the board of the VirginiaCollege Equity Foundation, also established by the bill, to managea scholarship program funded by the Fund. The bill establishes anindividual and corporate income tax subtraction for donations to the Fund. Under the bill, the programprovides scholarships to students at Virginia's nonlegacy publicuniversities. Scholarships are available only to students who attenda nonlegacy university, likely would have been denied admission toa public institution of higher education prior to 1900 based on admissioncriteria in effect at the time, meet the income requirements fora Pell Grant, and commit to working in Virginia for at least eightyears after graduation.

SB 275: Public school libraries; printed and audiovisual materials, selection, evaluation, checkout, etc.

Public school libraries; printed and audiovisualmaterials; selection, evaluation, checkout, and removal procedures.Requires each local school board to adopt policies that addressthe selection and evaluation of all printed and audiovisual materialspurchased by, donated to, or otherwise made available to the schooldivision that will be available to students in school libraries andrequires such policies to contain clear procedures for (i) parentalinvolvement in and a reasonable opportunity for public comment before the selection and evaluation of printed and audiovisual materialsthat will be available to students in school libraries; (ii) mandatoryprior written parental consent before a student is permitted to checkout from the school library any such printed or audiovisual materialsthat could be considered grooming video or materials, as that termis defined in relevant law; and (iii) the removal from the schoollibrary of any such printed or audiovisual materials that could beconsidered grooming video or materials, as that term is defined inrelevant law.
