Department of Medical Assistance Services; amendwaivers providing services for individuals with developmental disabilities;greater financial flexibility for certain services; report. Directsthe Department of Medical Assistance Services to (i) take steps toamend the Family and Individual Supports, Community Living, and BuildingIndependence waivers to combine the maximum annual allowable amount for assistive technology, electronic home-based support services,and environmental modifications for an individual receiving waiverservices, for an annual total of $15,000, to provide for greaterflexibility and better meet the needs of individuals receiving servicesand (ii) report on its progress to the Governor and the General Assembly by December 1, 2022.
Elections; form of ballot; party identificationof candidates on ballots; constitutional officers. Extends toelections for constitutional officers the requirement that ballotsidentify the nominating political party for party candidates andidentify independent candidates as such. Currently, this requirementapplies only to federal, statewide, and General Assembly elections.
Preliminary analysis of breath to determinealcoholic content of blood; failure to advise person of rights.Provides that if a police officer or a member of any sheriff's department fails to advise a person of his rights to refuse a preliminary breathtest, any preliminary breath test sample shall not be admissiblefor the purpose of determining probable cause or used in evidenceat any hearing or trial.
Permanent protective orders; contact betweenpetitioner and respondent. Provides that when issuing a permanent protective order a court may impose certain conditions on the petitioner,including (i) prohibiting acts of violence, force, or threat or criminaloffenses that may result in injury to person or property; (ii) prohibitingsuch contacts by the petitioner with the respondent or family orhousehold members of the respondent as the court deems necessary forthe health or safety of such persons; and (iii) any other reliefnecessary to prevent (a) acts of violence, force, or threat, (b)criminal offenses that may result in injury to person or property,or (c) communication or other contact of any kind by the petitioner.
Study; Joint Commission on Health Care; benefitsof hospitals, health systems, and other providers addressing thehealth-related social needs of Virginians; report. Directs theJoint Commission on Health Care to study the benefits of hospitals,health systems, and other providers in addressing the health-relatedsocial needs of Virginians. The study shall identify opportunities for policy making to make health care in Virginia more affordableand effective through innovations in care coordination, workforce development, payment options, and improved data collection.
Department of Behavioral Health and DevelopmentalServices; voluntary mental health check-in option as part of thecomprehensive crisis system; report. Directs the Department of Behavioral Health and Developmental Services to implement a voluntarymental health check-in option as part of the comprehensive crisissystem and to report by November 1, 2022, to the Governor and theChairmen of the House Committees on Appropriations and Health, Welfareand Institutions and the Senate Committees on Education and Healthand Finance and Appropriations regarding its progress in implementingsuch program.
