SB 963: Energy manager; responsibilities.

Energy efficiency; Commonwealth Efficient andResilient Buildings Board. Establishes the Commonwealth Efficientand Resilient Buildings Board to advise the Governor, the Virginia Public Building Authority, and all state agencies, departments, authorities, institutions of higher learning, and political subdivisionson accelerating improvements to state buildings to reduce greenhousegas emissions and improve resiliency. The Board shall be composedof eleven members, including three nonlegislative citizen membersto be appointed by the Governor. The Directors of the Departmentsof General Services, Mines, Minerals and Energy, and Planning andBudget, or their designees; the Secretaries of Education, Finance,and Natural Resources, or their designees; the Special Assistant tothe Governor for Coastal Adaptation and Protection; and the Chairmanof the Virginia Public Building Authority shall serve ex officiowith voting privileges. The billalso requires the head of each state agency to designate an existingemployee, known as an energy manager, who shall be responsible forimplementing improvements to state buildings to reduce greenhousegas emissions and improve energy efficiency and climate change resiliency. The Board has a sunset date of July 1, 2030.

HB 991: Firefighting equipment; weight limitation on interstate.

Firefighting equipment; weight limitation on interstate. Requires firefighting equipment to comply with existing weight limitations for emergency vehicles on interstate highways. Current law exempts firefighting equipment from all size and weight limitations. The bill exempts emergency vehicles registered to a federal, state, or local agency or a fire company from any fee typically charged for the issuance of an overweight permit for such vehicle.

HB 887: ABLE savings trust agreement; Medicaid clawback prohibition.

ABLE savings trust agreement; Medicaid clawbackprohibition. Provides that the beneficiary of an ABLE savingstrust account may appoint a survivor. In the event of the beneficiary'sdeath, the survivor becomes the new beneficiary of the account ifhe is eligible under federal law to be a beneficiary of an ABLE savingstrust account. The bill provides that if the survivor is ineligible,then any proceeds remaining in the account are distributed to thesurvivor and the account is closed. Under current law, if the beneficiaryof an ABLE savings trust account dies, his state of residence becomesa creditor of the account and may seek payment under federal law for Medicaid benefits provided to the beneficiary while he was alive.The bill prohibits the Commonwealth from seeking estate recoveryor payment from the proceeds of the deceased beneficiary's accountfor benefits provided to him.

HB 989: Motor vehicle title; designation of beneficiary.

Designation of beneficiary on motor vehicle title; multiple owners. Provides a process whereby a motor vehicle, trailer, or semitrailer with multiple owners can be titled with a designated beneficiary. The bill requires the consent of all owners and provides that the transfer of ownership would occur upon the death of the last surviving owner.

HB 393: Landlord and tenant; statement of tenant rights and responsibilities.

Landlord and tenant; statement of tenant rights and responsibilities. Requires that the Director of Housing and Community Development develop a statement of tenant rights and responsibilities explaining in plain language the rights and responsibilities of tenants under the Virginia Residential Landlord and Tenant Act and maintain such statement on the Department's website. The bill requires the Director to develop and maintain on the Department's website a printable form to be signed by the parties to a written rental agreement acknowledging that the tenant has received from the landlord the statement of tenant rights and responsibilities and requires a landlord to furnish to a prospective tenant, at the time of furnishing an unsigned copy of the proposed written rental agreement, the statement of tenant rights and responsibilities for signature by the parties to the rental agreement. The landlord may not file or maintain an action against the tenant in a court of law for any alleged lease violation until he has provided the tenant with such statement.

Commissioner of Social Services; work group; plan for licensure of prescribed pediatric extended care centers in the Commonwealth; report. Directs the Commissioner of Social Services to establish a work group to develop a plan for the licensure of prescribed pediatric extended care centers in the Commonwealth. The work group shall report the plan to the Governor and the Chairmen of the House Committee on Health, Welfare and Institutions and the Senate Committee on Education and Health by November 1, 2020.

Allowsexpired state issued driver's licenses or state issued identificationcards and expired passports to be used as a means of identificationfor notarial purposes for individuals residing in nursing homes orassisted living facilities, provided such expired documents expiredwithin five years of the date of use for such identification purposes.

HB 1333: Landlord and tenant; damage insurance shall conform to certain criteria.

Landlord and tenant; damage insurance in lieu of security deposit. Provides that a landlord may permit a tenant to provide damage insurance coverage meeting certain criteria in lieu of the payment of a security deposit. The bill also caps the total amount of any combination of security deposit and rental insurance coverage required by the landlord to twice the amount of the periodic rent payment and provides that a tenant who initially opts to provide damage insurance in lieu of a security deposit may, at any time without consent of the landlord, opt to pay the full security deposit to the landlord in lieu of maintaining a damage insurance policy.

SB 903: Hospitals; screening emergency department patients, etc.

Hospitals; emergency treatment for substanceuse-related emergencies; services. Requires the Board of Healthto amend regulations governing hospitals to require each hospitalthat provides emergency treatment to an individual experiencing asubstance use-related emergency to (i) complete a comprehensive assessmentto identify appropriate medical interventions necessary for the treatmentof the individual; (ii) complete a comprehensive behavioral healthassessment to determine whether additional treatment may be appropriate;(iii) initiate pharmacotherapy for treatment of drug or alcohol dependence,where appropriate; and (iv) provide the patient with naloxone orother opioid antagonist used for overdose reversal. Such regulationsshall also require each hospital that provides emergency treatment to an individual experiencing a substance use-related emergencyto establish and implement a protocol for connecting such patientsreceiving emergency treatment with appropriate community-based providersof behavioral health services upon discharge.
