Roy P. Byrd, Jr., Memorial Bridge. Designates the U.S. Route 29 Business bridge over U.S. Route 29 in Pittsylvania County the "Roy P. Byrd, Jr., Memorial Bridge."
Juveniles; trial as adult. Increases from 14 years of age to 16 years of age the minimum age at which a juvenile must be tried as an adult in circuit court for murder or aggravated malicious wounding; however, if the juvenile is 14 years of age or older but younger than 16 years of age, the court, on motion of the attorney for the Commonwealth, shall hold a transfer hearing. The minimum age is also raised from 14 to 16 for certain charges requiring notice of intent to try such juvenile as an adult by the attorney for the Commonwealth. In order to be tried as an adult in circuit court for the charges that under current law require notice of intent to proceed with trial as an adult by the attorney for the Commonwealth, the bill requires that (i) a report concerning the juvenile be prepared by the court services unit or other qualified agency and (ii) the attorney for the Commonwealth provide written notice that he intends to proceed with a preliminary hearing for trial of such juvenile as an adult, including affirmation that he has read the report. This bill incorporates HB 1440.
DMAS; steps to facilitate transition betweentwo programs. Directs the Department of Medical Assistance Services(DMAS) to establish a process for (i) conducting a comprehensive needs assessment of a person who is eligible to participate in the MedicaidWorks waiver program but is not yet participating in such programto determine the services the person may need to continue to liveindependently and engage in employment and (ii) developing a planof care for such person that describes the types of services and amountof each such service the person will receive should they choose toparticipate in the Medicaid Works waiver program so that personsconsidering transitioning from the Home and Community-Based Serviceswaiver program to the Medicaid Works waiver program have sufficient information to make an informed choice regarding such transition.The bill also requires DMAS to develop processes to (i) enable aperson who transitions from a Home and Community-Based Services waiverservice to the Medicaid Works waiver program to retain their Homeand Community-Based Services waiver slot for up to 180 days followingthe date of such transition and (ii) give priority to individualspreviously receiving services through such waiver program who transitionedto the Medicaid Works waiver program and who subsequently seek toreturn to receiving services through the Home and Community-BasedServices waiver program.
Family day homes; storage of firearms. Requires that during hours of operation, all firearms in a licensed family day home, registered family day home, or family day home approved by a family day system be stored unloaded in a locked container, compartment, or cabinet, and that all ammunition be stored in a separate locked container, compartment, or cabinet. The bill requires that the key or combination to such locked containers, compartments, or cabinets be inaccessible to all children in the home. This bill is identical to HB 600.
Common interest communities; electric vehicle charging stations permitted. Prohibits certain common interest community associations from prohibiting the installation of an electric vehicle charging station within the boundaries of a member's unit or limited common element parking space appurtenant to the unit owned by the unit owner or, in the case of a property owners' association, a lot owner's property, and sets forth provisions governing the installation and removal of such charging stations. The bill also requires the association member installing an electric vehicle charging station to indemnify and hold the association harmless from all liability resulting from a claim arising out of the installation, maintenance, operation, or use of such charging station.
Athletic trainers; naloxone or other opioidantagonist. Authorizes licensed athletic trainers to possessand administer naloxone or other opioid antagonist for overdose reversalpursuant to an oral or written order or standing protocol issuedby the prescriber within the course of his professional practice.
Forfeiture of property used in connection with the commission of crimes; finding of guilt required. Requires that any action for the forfeiture of property used in connection with the commission of a crime be stayed until the person whose property is the subject of the forfeiture action has been found guilty of the crime authorizing the forfeiture, regardless of whether he has been sentenced. The bill provides that property may be forfeited even though no finding of guilt is made if (i) the forfeiture is ordered by the court pursuant to a plea agreement or (ii) the owner has not submitted a written demand for the return of the property within 21 days from the date the stay terminates. This bill incorporates HB 225.
Smoking in motor vehicle with a minor present. Expands the group in the presence of whom it is illegal to smoke in a motor vehicle from minors under the age of eight to minors under the age of 15.
Virginia Charitable Gaming Board; regulationsof the Board; electronic or mechanical equipment used in the conductof charitable gaming. Increases the number of electronic pulltabs that may be placed in the social quarters of a qualified organizationfrom nine, as currently provided by Virginia Charitable Gaming Boardregulations, to 30.
Department of Motor Vehicles; driver's license eligibility. Authorizes the Department of Motor Vehicles to issue a limited-duration driver's license, permit, or special identification card to an applicant with a valid, unexpired Employment Authorization Document.
Minimum staffing ratio for school counselors. Requires local school boards to employ school counselors in accordance with the following ratios, effective with the 2020-2021 school year: in elementary schools, one hour per day per 75 students, one full-time equivalent at 375 students, one hour per day additional time per 75 students or major fraction thereof; in middle schools, one period per 65 students, one full-time equivalent at 325 students, one additional period per 65 students or major fraction thereof; and in high schools, one period per 60 students, one full-time equivalent at 300 students, one additional period per 60 students or major fraction thereof. The bill also requires local school boards to employ one full-time equivalent school counselor position per 325 students in grades kindergarten through 12, effective with the 2021-2022 school year. Board of Pharmacy; pharmaceutical processors;cannabis oil. Replaces the definitions of cannabidiol oil andTHC-A oil with a definition for cannabis oil. The bill allows pharmaceuticalprocessors to acquire industrial hemp grown and processed in Virginiafrom a registered industrial hemp dealer or processor and allowsa pharmaceutical processor to process and formulate industrial hempwith cannabis plant extract into an allowable dosage.
