Electric utilities; regulation of rates; prohibited recovery; report. Provides that the State Corporation Commissionshall consider any rate, toll, charge, or schedule of a public utilityjust and reasonable only if the investor-owned public electric utilityhas demonstrated that no parts of such rates, tolls, charges, orschedules includes costs for activities as prohibited by the bill.The bill prohibits investor-owned electric utilities from recoveringthrough base rates any direct or indirect costs associated with certainprohibited recovery activities listed in the bill. The bill requireseach such utility to submit an annual report to the Commission startingJuly 1, 2025, of specific information related to the prohibited recoveryactivities listed in the bill. The bill also permits the Commissionto impose a fee on any utility acting in violation of the provisionsof the bill in an amount equal to the amount improperly recoveredby the utility through any prohibited recovery activity listed inthe bill.
Department of Health; perinatal services forparents. Directs the Department of Health to obtain all availablefederal funding for services for expecting mothers and fathers.
Directing the Speaker of the House of Delegates to order a study of the legal effects and consequences of a constitutional amendment enshrining a right to reproductive freedom. Directsthe Speaker of the House of Delegates to order a study of the legaleffects and consequences of a constitutional amendment enshrininga right to reproductive freedom, including whether the phrase "Thisright to make and effectuate one's own decisions about all mattersrelated to one's pregnancy shall not be denied, burdened, or infringedupon...." would constitutionally protect abortion throughout allof pregnancy, create a constitutional right for the parents of adead child to sell such child's body parts, and legally permit partialbirth infanticide, born-alive murder, child pornography, sexual assault, and any other crime so long as the umbilical cord and placenta arestill attached to both the mother and the child.
Eminent domain; offer to sell to former owner.Provides that a former owner may enter into a contractual agreementor agree to a contractual provision waiving his right to receivean offer of sale from a condemnor. Under current law, any agreementor provision waiving such right is void and unenforceable.
Sexual extortion; penalty. Makes it a Class5 felony for any person to maliciously threaten eviction, loss ofhousing, property damage, or any financial loss with the intent tocause the complaining witness to engage in sexual intercourse, cunnilingus,fellatio, anilingus, anal intercourse, inanimate or animate object sexual penetration, or an act of sexual abuse and thereby engagein sexual intercourse, cunnilingus, fellatio, anilingus, anal intercourse,inanimate or animate object sexual penetration, or an act of sexualabuse. The bill also creates an unclassified felony punishable bynot less than one nor more than 20 years and a fine of not more than$100,000 for any adult who violates the provisions of the bill witha person younger than 18 years of age.
Candidates for office; electronic petitions.Allows for the collection of signatures by electronic means, requiresthe State Board of Elections to prescribe candidate petitions formsin both paper and electronic formats, and provides formal requirementsfor signatures on electronic petitions. The bill also makes technicalamendments to provide uniformity in requirements for such petitions.
Maximum number of authorized judgeships in eachjudicial district. Increases from six to seven the number ofauthorized general district court judgeships and increases from fiveto seven the number of authorized juvenile and domestic relationsdistrict court judgeships in the Thirteenth Judicial District.
Contributing to the delinquency of a minor;sex offenders; penalty. Creates a Class 6 felony for any person18 years of age or older who engages in consensual sexual intercourseor anal intercourse with or performs cunnilingus, fellatio, or anilingusupon or by a child 15 or older not his spouse, child, or grandchildwhile such person is required to register with the Sex Offender andCrimes Against Minors Registry.
Enhanced earned sentence credits; exemptions;felony drug offenses. Removes any person convicted of a secondor subsequent felony drug offense from being eligible to earn enhancedearned sentence credits.
State plan for medical assistance services;certified community health workers; work group. Directs the Departmentof Medical Assistance Services to amend the state plan for medicalassistance services to include a provision for payment for services provided by certified community health workers. The bill directsthe Department to convene a work group of stakeholders to designthe certified community health worker services benefit and to seekfederal approval through a state plan amendment to implement thebenefit.
Issuing citations; certain traffic offenses.Removes the provisions that provide that no law-enforcement officermay lawfully stop a motor vehicle for operating (i) without a lightilluminating a license plate, (ii) with defective and unsafe equipment,(iii) without brake lights or a high mount stop light, (iv) withoutan exhaust system that prevents excessive or unusual levels of noise,(v) with certain sun-shading materials and tinting films, and (vi)with certain objects suspended in the vehicle and removes the accompanyingexclusionary provisions.
Nationally Certified School Psychologist Program established; incorporation into National Teacher Certification IncentiveReward Program Fund. Establishes the Nationally Certified SchoolPsychologist Program, incorporates such program into the existing National Teacher Certification Incentive Reward Program Fund andrenames such fund as the National Teacher Certification Incentive Reward Program and Nationally Certified School Psychologist ProgramFund, and permits such fund to be used to award incentive grantsto school psychologists employed in the public schools of the Commonwealthobtaining national certification from the National Association ofSchool Psychologists consisting of an initial state-funded awardof $5,000 and a subsequent award of $2,500 each year for the lifeof the certificate.
