Authority of Attorney General; criminal cases;human and sex trafficking. Authorizes the Attorney General toprosecute violations of criminal law relating to human and sex traffickingoffenses in connection with racketeering.
Land preservation tax credit; maximum amountincrease. Increases from $75 million to $100 million, beginningin 2024, the maximum amount of land preservation tax credits thatmay be issued in a calendar year.
Study; Virginia Freedom of Information AdvisoryCouncil; charges for the production of public records; report.Directs the Virginia Freedom of Information Advisory Council (theFOIA Council) to convene a work group consisting of citizens of the Commonwealth, representatives of state and local government entities, broadcast, print, and electronic media sources, open government organizations, and other interested parties to study whether the provisions of the Virginia Freedom of Information Act (FOIA) allowing public bodiesto charge requesters for the production of public records shouldbe amended to make access to public records easier for requesters.The resolution further directs the work group to examine the currentFOIA provisions on charges and make recommendations on ways to amendsuch provisions to make the assessment of charges by public bodiesfor the production of public records more uniform, more transparent,easier to understand, and less costly.
Study; sickle cell disease in the Commonwealth;report. Directs the Joint Commission on Health Care to studysickle cell disease in the Commonwealth. The bill directs the JointCommission on Health Care to submit an executive summary of its findingsand recommendations to the Division of Legislative Automated Systemsno later than the first day of the 2025 Regular Session of the General Assembly.
Water certificates or permits; compliance withwater quality standards. Requires the State Water Control Boardto ensure all activities allowed under any water certificate or permitare in compliance with the water quality standards promulgated bythe Board.
Virginia Public Procurement Act; prohibitionon boycotting Israel. Requires all public bodies to include in every contract in excess of $100,000 with a business that employsmore than 10 employees and in every subcontract or purchase orderin excess of $10,000 a provision that states that during the performanceof the contract, neither the contracting business nor any of itsaffiliates shall engage in a boycott of Israel.
Energy policy of the Commonwealth; state authority;legislative declaration. Declares that affordable, reliable,and secure energy resources are important to the health, safety,and welfare of the Commonwealth's citizens and provides that theCommonwealth has a duty to defend the production and supply of affordable, reliable, and secure energy from external regulatory interference.Under the bill, if the State Corporation Commission or an electricutility, as defined in the bill, receives notice of any federal regulationthat may threaten the production or supply of affordable, reliable,and secure energy within the Commonwealth, the Commission or suchelectric utility shall inform the Office of the Attorney Generalof such regulation within 30 days of the receipt of such notice.The bill requires the Office of the Attorney General to take anyaction necessary to defend the Commonwealth's interest in the productionand supply of affordable, reliable, and secure energy, includingfiling an action in court or participating in administrative proceedings.
State plan for medical assistance services;fertility preservation treatments; genetic material misuse; penalty. Directs the Board of Medical Assistance Services to amend the stateplan for medical assistance services to include a provision for paymentof medical assistance for coverage of fertility preservation for individuals diagnosed with cancer who need treatment for that cancerthat may cause a substantial risk of sterility or iatrogenic infertility,as defined in the bill, including surgery, radiation, or chemotherapy.The bill also establishes that it is a Class 3 felony for a healthcare provider to provide assisted conception treatment to a patientand use the health care provider's own gamete without the writtenconsent of the patient.
Disabled Veteran's Passport; service-connecteddisability. Entitles any veteran of the U.S. Armed Forces witha service-connected disability to a Disabled Veteran's Passport forfree entry into state parks and discounted services. Current lawlimits such passport to veterans of the U.S. Armed Forces with a service-connected disability rating of 100 percent.
Local tax authority; nicotine vapor products.Authorizes localities by ordinance to impose a sales and usetax on nicotine vapor products, defined in the bill to include liquidnicotine in closed and open systems, as such terms are defined inthe bill, and includes directives for the administration and enforcementof any such ordinance. The bill also directs the Department of Taxationto consult with localities, the Virginia Association of Counties,and the Virginia Municipal League for implementing and administering such local taxation of nicotine vapor products.
Department of Health; mobile food units.Directs the Department of Health to amend its regulations and eachlocal health department and health district to amend its regulationsand guidance documents to allow a mobile food unit to conduct up to 20 percent of its sanitation and food preparation activities withina 50-foot radius of the mobile food unit.
Civil causes of action; social media platforms;complying with certain requests for information. Requires theowner or operator of a social media platform, as defined in the bill,to comply with requests from a party to a civil action concerning(i) any identifying information regarding any person alleged to havepublished content giving rise to such action on such platform and(ii) restoration of access to any person claiming ownership of anaccount created on such platform, provided such person can proveoriginal ownership of such account.
