HB 764: Virginia Residential Landlord and Tenant Act; early termination of rental agreement.

Virginia Residential Landlord and Tenant Act;early termination of rental agreement; victims of sexual abuse orcriminal sexual assault. Provides that a tenant who is a victimof family abuse, sexual abuse, or other criminal sexual assaultmay terminate such tenant's obligations under a rental agreement if the tenant (i) has obtained a protective order and has given properwritten notice of termination during the period of the protectiveorder or any extension thereof or (ii) as evidence of such abuseor criminal sexual assault, has obtained (a) records or files froma federal or state agency, law-enforcement agency, or court; (b)documentation from a domestic violence or sexual assault program;(c) documentation from a duly ordained, commissioned, or licensedminister of any religious denomination who provides proper proof ofhis credentials as outlined in the bill; or (d) documentation froma medical professional licensed by the Board of Medicine or Boardof Nursing or a mental health service provider and has given written notice of termination. Under current law, there must be a familyabuse protective order or a conviction before the tenant may terminatesuch obligations under a rental agreement.

HB 5: Town of Leesburg Parking Authority; created.

Town of Leesburg Parking Authority. Authorizesthe creation of the Town of Leesburg Parking Authority. The billgrants to the Authority various powers, including the authority to construct, operate, and lease parking facilities, contract with outside entities, issue revenue bonds and revenue refunding bonds, and acquire property. The bill also exempts the Authority from taxation.

HB 619: Military centered community zones; localities may establish, by ordinance, one or more zones.

Military centered community zones; local designation. Allows localities to establish, by ordinance, one or more military centered community zones, defined in the bill as a community that has a significant presence of military personnel living or working in the designated area and where such presence drives, or has the potential to drive, significant economic activity. The bill provides that a locality, or another political subdivision acting on behalf of the locality, may offer unique benefits to businesses looking to locate within a zone for the purpose of serving the needs of the military personnel, including reduction of certain fees and taxes. In addition, the bill provides that local governing bodies are authorized to enter into agreements for the payment of economic development incentive grants to such businesses. The bill also allows a governing body to provide for certain regulatory flexibility and incentives and provides that the establishment of a military centered community zone shall not preclude the area from also being designated as an enterprise zone or from receiving support under the Virginia Military Community Infrastructure Grant Program. This bill is identical to SB 343.

HB 650: Zoning; solar photovoltaic and energy storage projects.

Zoning; residential and electrical generation projects; period of validity. Provides that the conditions of a special exception or special use permit may include a period of validity; however, in the case of a special exception or special use permit for residential and electrical generation projects, the period of validity shall be no fewer than three years. The bill provides that for so long as a special exception, special use permit, or conditional use permit remains valid, no change or amendment to any local ordinance, map, resolution, rule, regulation, policy, or plan adopted subsequent to the date of approval of the special exception, special use permit, or conditional use permit shall adversely affect the right of the developer or his successor in interest to commence and complete an approved development in accordance with the lawful terms of the special exception, special use permit, or conditional use permit unless the change or amendment is required to comply with state law or there has been a mistake, fraud, or a change in circumstances substantially affecting the public health, safety, or welfare.

HB 322: Cosmetology Compact; established.

Cosmetology Compact. Establishes the Cosmetology Compact upon the enactment of substantially similar legislation in the seventh member state, defined in the bill. The bill creates a multistate license in furtherance of the objectives of providing opportunities for the uninterrupted practice of cosmetology between member states and supporting the relocation of military members and their spouses by enabling such continuation of practice. The bill requires the Board for Barbers and Cosmetology to adopt emergency regulations to implement the provisions of the bill.

HB 144: Speed limits; notification to primary liaison in each locality when change occurs.

Change in speed limits; notification. Requiresthe Department of Transportation, if the Commissioner of Highwaysincreases or decreases a speed limit, to (i) notify the primary liaisonwith the Department in each locality within which such speed limitchange will occur and (ii) place roadside signage notifying driversof the upcoming change in such speed limit. The bill also requiresthe Department to notify the governing body of any property owners'association or condominium association if any such speed limit changewill occur in a community subject to such association.

Termination of trust; notice requirements.Provides that a trustee seeking to terminate a trust may do so withouta court order, provided that the trustee sends notice, subject tocertain provisions enumerated in the bill, to any qualified beneficiariesor cotrustees. The bill also provides that a qualified beneficiaryor cotrustee who objects to the termination of the trust may provideto the trustee seeking to terminate the trust written notice of suchobjection within 60 days of receipt of the notice of termination.

HB 634: Residential dwelling units; rentals for 30 consecutive days or longer.

Residential dwelling units; rentals for 30 consecutive days or longer. Prohibits a locality from enacting or enforcing an ordinance that bans the rental of residential dwelling units for 30 consecutive days or longer. The bill allows a locality by ordinance to regulate such rental if such regulations (i) are reasonable and (ii) do not exceed the requirements for an owner-occupied residential property or a residential property rented for a lease term of 12 months or more in the same zoning district. This bill is identical to SB 308.
