HR 7335: MST Claims Coordination Act

MST Claims Coordination Act This act modifies the Department of Veterans Affairs (VA) claims process for claims related to military sexual trauma (MST). During or immediately after a medical examination, hearing before the Board of Veterans' Appeals, or other relevant event, the Veterans Benefits Administration (VBA) must coordinate with the Veterans Health Administration (VHA) to provide veterans who elect to receive materials with outreach letters, information on the Veterans Crisis Line, information on how to make an appointment with a mental health provider, and other information on available resources relating to MST. Additionally, the VHA and the VBA must provide such materials with the determination the VA provides to the claimant in connection with a claim for compensation. In a claim for compensation arising from MST experienced by a veteran who is enrolled in the VA health care system and consents to the notification system, the VBA must automatically notify the VHA before the veteran (1) participates in a medical examination, hearing, or other relevant event; or (2) receives a determination from the VA in connection with the claim for compensation.

HR 7299: SVAC Act of 2022

Strengthening VA Cybersecurity Act of 2022 or the SVAC Act of 2022 This act requires the Department of Veterans Affairs (VA) to seek to enter into an agreement with a federally funded research and development center to provide a cybersecurity assessment of five high-impact VA information systems and the effectiveness of the VA's information security program and information security management system. The VA must submit a plan to Congress to address the findings of the assessment. The Government Accountability Office must review the assessment and the VA's response to the assessment and report its findings to Congress.

HR 6961: Dignity for MST Survivors Act

This act modifies communications and procedures for the Department of Veterans Affairs (VA) and Board of Veterans' Appeals (BVA) regarding claims for compensation based on military sexual trauma (MST) experienced by veterans. The act requires the VA to ensure each member of the BVA is offered annual training on MST and proceedings that concern a claim for compensation based on MST. A proceeding that concerns a claim for compensation based on MST may not be assigned to a member of the BVA (or a panel of members) unless such persons have completed the annual training. When a notice of disagreement is filed, the BVA must promptly determine whether it is filed for a case that concerns a claim for compensation based on MST and for which the appellant has requested a hearing in the notice. The VA must audit the language used in letters sent to individuals to explain decisions denying claims for compensation based on MST. Letters must be modified to ensure (1) the use of trauma-informed language, and (2) veterans are not retraumatized through insensitive language. The VA must establish protocols for VA medical providers and contract medical providers to ensure that the medical providers use trauma-informed practices in conducting examinations in relation to claims for compensation based on MST.

HR 6604: Veterans Eligible to Transfer School (VETS) Credit Act

Veterans Eligible to Transfer School (VETS) Credit Act This act addresses eligibility for Department of Veterans Affairs (VA) educational assistance for individuals who are transferring credits due to the closure or disapproval of a program of education. Currently, an individual who transfers fewer than 12 credits from a program of education that is closed or disapproved must be deemed to have not received such credits, and the period for which the entitlement is not charged must be the entire period of the individual's enrollment in the program. Under the act, the VA must require an individual to certify in writing the transfer of fewer than 12 credits from a program of education that is closed or disapproved. The VA must accept such a certification as proof that the individual is transferring fewer than 12 credits. The VA must provide a certificate of eligibility (to demonstrate proof of full educational assistance entitlement) to individuals who make the certification and acknowledge that if 12 or more credits are transferred (1) they may not be deemed to be someone who did not receive such credits, and (2) the VA must rescind the certificate of eligibility in such cases. The VA must notify individuals who are eligible to make such a certification and receive a certificate of eligibility. The act also removes the requirement that an individual transferring a Post-9/11 GI Bill entitlement must specify the period for which the transfer must be effective for each dependent who is designated to receive the transfer.
