This resolution congratulates the students, families, teachers, administrators, and staff of public charter schools across the United States for (1) making ongoing contributions to public education, (2) making impressive strides in closing the academic achievement gap in U.S. schools, and (3) improving and strengthening the public school system. The resolution supports the ideals and goals of the 22nd annual National Charter Schools Week.
Fairness in Orphan Drug Exclusivity Act This bill limits which orphan drugs may be granted a market exclusivity period by the Food and Drug Administration (FDA). (Generally, an orphan drug is one that is not economically viable because of the rarity of the disease that it treats. The sponsor of an FDA-designated orphan drug may be granted various incentives, such as a seven-year period in which the FDA may not grant market approval to a different sponsor for the same drug to treat the same disease.) Under this bill, if a drug is designated as an orphan drug on the basis that there is no reasonable expectation that the sponsor will recover the costs of developing and distributing the drug from U.S. sales, the drug shall be granted the seven-year exclusivity period only if the sponsor demonstrates that there is no reasonable expectation that it will recover such costs specifically within its first 12 years of U.S. sales of the drug. This requirement shall also apply retroactively to an orphan drug that was granted such an exclusivity period before this bill's enactment. When deciding whether an orphan drug meets this requirement, the FDA shall consider the sales of all drugs from the sponsor that are covered by the same orphan drug designation.
This resolution condemns the acts of gun violence that led to the tragic loss of eight lives in Georgia on March 16, 2021.
COVID-19 Emergency Medical Supplies Enhancement Act of 2021 This bill expands certain authorities under the Defense Production Act of 1950 (DPA) and authorizes the President and federal agencies to take specific actions to support the production of critical medical supplies during the COVID-19 (i.e., coronavirus disease 2019) emergency, including with respect to private-sector coordination, needs assessments, and overall strategies. The bill makes loans under the DPA subject to certain notification requirements. A report required under the DPA for FY2022 and FY2023 shall include the percentage of contracts awarded to small businesses.
Homebuyer Assistance Act of 2021 This bill modifies requirements for appraisers of Federal Housing Administration-insured mortgages. Currently, an appraiser must be certified by certain state or national entities. The bill removes the national entities from the list of approved certification entities and allows an appraiser for a mortgage for single-family housing to be state-licensed rather than state-certified to meet requirements. The bill also provides specified educational requirements for appraisers for mortgages for single-family housing.
COVID-19 Fraud Prevention Act This bill establishes the Consumer and Investor Fraud Working Group to prevent fraud during the COVID-19 (i.e., coronavirus disease 2019) pandemic. The working group must report quarterly regarding resources available to consumers, public enforcement actions, and related consumer complaints.
Combating Sexual Harassment in Science Act This bill addresses sexual harassment and gender harassment in the science, technology, engineering, and mathematics (STEM) fields by supporting research regarding such harassment and efforts to prevent and respond to such harassment. (Sec. 4) This bill directs the National Science Foundation (NSF) to award grants to institutions of higher education or nonprofit organizations (or their consortia) to expand research into sexual harassment and gender harassment in the STEM workforce, including students and trainees; and examine interventions for reducing the incidence and negative consequences of such harassment. (Sec. 5) The NSF must convene a working group composed of representatives of federal statistical agencies to develop questions on sexual harassment and gender harassment in STEM departments in order to gather national data on the prevalence, nature, and implications of such harassment in institutions of higher education. (Sec. 6) The NSF shall enter into agreements with the National Academies of Sciences, Engineering, and Medicine to (1) update a responsible conduct guide issued by the National Academies to include, among other things, updated professional standards of conduct in research and evidence-based practices for fostering a climate that is intolerant of sexual harassment and gender harassment; and (2) study the influence of such harassment in institutions of higher education on the career advancement of individuals in the STEM workforce. (Sec. 7) The National Science and Technology Council shall establish an interagency working group to coordinate the federal science agencies' efforts to reduce the prevalence of sexual harassment and gender harassment involving grant personnel. The Office of Science and Technology Policy must develop a uniform set of policy guidelines for such agencies to prevent and respond to reports of sexual harassment and gender harassment.
Improving VA Accountability To Prevent Sexual Harassment and Discrimination Act of 2021 This bill requires the Department of Veterans Affairs (VA) to implement various policies and procedures related to sexual harassment, other harassment, and employment discrimination. The bill requires the VA to ensure that the official who serves as the VA's Equal Employment Opportunity Director reports directly to the Deputy Secretary and does not also serve in a position that has responsibility over personnel functions or functions that conflict with the equal employment functions, each Equal Employment Opportunity program manager at the facility level reports to the head of the Office of Resolution Management (ORM) with respect to equal employment functions, and the employment discrimination complaint resolution system requires any VA manager who receives a harassment or employment discrimination complaint to report such complaint to the ORM immediately (or within two business days of receiving the complaint if immediate reporting is impracticable). The VA must provide employees with mandatory annual training on identifying and addressing sexual harassment, other harassment, and employment discrimination, including with respect to processes under the VA's Harassment Prevention Program. The VA must regularly review the policies relating to sexual harassment, other harassment, and employment discrimination to ensure its policies are complete and in accordance with the policies established by the ORM. Additionally, the VA must issue a final directive and handbook for its Harassment Prevention Program.
Insider Trading Prohibition Act This bill generally provides statutory authority for the prohibition against securities trading, as well as related communications to others, by a person aware of material, nonpublic information. The bill further provides, for purposes of establishing a violation of this prohibition, that it is not necessary for such a person to know specifically how such information was obtained or whether a personal benefit was paid or promised.
MSI STEM Achievement Act (Sec. 4) This bill supports efforts to increase science, technology, engineering, and mathematics (STEM) education at minority-serving institutions of higher education (IHEs), including Historically Black Colleges and Universities and Tribal Colleges or Universities. The bill requires the National Science Foundation to award grants for purposes including building the capacity of such IHEs to increase the number and success of their students in the STEM workforce. (Sec. 5) The Office of Science and Technology Policy (OSTP) shall develop a uniform set of policy guidelines for federal science agencies to carry out a program of outreach activities to increase clarity, transparency, and accountability for federal science agency investments in STEM education and research activities at minority-serving IHEs. The OSTP shall submit to Congress a report containing a strategic plan for each federal science agency to increase the capacity of minority-serving IHEs to compete for grants, contracts, or cooperative agreements and to encourage such IHEs to participate in federal programs.
Coastal and Ocean Acidification Stressors and Threats Research Act of 2021 or the COAST Research Act of 2021 This bill addresses the effects of ocean and coastal acidification on marine organisms and ecosystems. Specifically, the bill reauthorizes through FY2026 and revises the Ocean Acidification Program of the National Oceanic and Atmospheric Administration and the ocean acidification grant program of the National Science Foundation. The bill expands those programs, as well as the ocean acidification activities of the National Aeronautics and Space Administration (NASA), to include efforts to research and monitor the effects of coastal acidification.
Department of State Authorization Act of 2021 This bill modifies the management and operations of the Department of State through various measures. These include requiring actions to recruit and retain a diverse workforce, establishing offices and roles to carry out designated functions, and providing for certain public diplomacy and anti-corruption measures. Specifically, the bill addresses personnel matters within the State Department by, for example, requiring the State Department to submit a comprehensive five-year strategic staffing plan and otherwise modifying provisions related to home leave travel, employee assignment restrictions and preclusions, and the recall and reemployment of career members of the Foreign and civil service. Further, the bill establishes recruitment, retention, and promotion requirements to further the goal of achieving a more diverse workforce at the State Department. In addition, the bill modifies the organization and operations of the State Department by, among other things, (1) providing statutory authority for the Bureau of Consular Affairs and the Bureau of Population, Refugees, and Migration; and (2) authorizing the establishment of an Assistant Secretary of State for Energy Resources to handle global energy-related issues. The bill also establishes measures to address State Department information and data security, revises procedures and requirements related to the overseas construction of embassies and consulates, and requires the State Department to report on the efforts of the Coronavirus Repatriation Task Force.
