Protecting Our Wealth of Energy Resources Act or the POWER Act This bill requires the President and federal agencies to obtain the approval of Congress before prohibiting or substantially delaying certain new energy or mineral leases or permits on federal lands, including oil and gas leases, coal leases, hard rock leases, or critical minerals leases. In addition, the President and agencies must obtain the approval of Congress before withdrawing certain federal lands from mineral and geothermal leasing activities.
Living Donor Protection Act of 2021 This bill prohibits certain insurance carriers from discriminating against, and provides other protections for, living organ donors. Specifically, carriers may not deny, cancel, or otherwise impose conditions on policies for life insurance, disability insurance, or long-term care insurance based on an individual's status as a living organ donor. The bill also expressly specifies that recovery from organ-donation surgery constitutes a serious health condition that entitles eligible employees to job-protected medical leave. In addition, the Department of Health and Human Services must update educational materials on live organ donation to include information about the benefits of live organ donation and about access to insurance for living organ donors.
21st Century Entrepreneurship Act This bill requires the Small Business Administration (SBA) to develop a curriculum for volunteers with the Service Corps of Retired Executives (SCORE) to teach underrepresented students (e.g., minority students, English learners, and children with disabilities) about entrepreneurship. The SBA shall develop and implement a strategy to encourage partnerships between the SCORE program and community learning centers to teach this curriculum and, in developing the curriculum, collaborate with education specialists and groups with experience serving underrepresented children. The SBA must submit a biennial report on partnerships between the SCORE program and community learning centers, the use of funds by the program, the number of students reached through the entrepreneurship curriculum, and plans for improving the curriculum.
No Taxpayer Funding for Paris Climate Agreement Act This bill prohibits the use of any funds to take action providing for the United States to become a party to the Paris Agreement.
Telehealth Modernization Act This bill modifies requirements relating to coverage of telehealth services under Medicare. Specifically, the bill extends certain flexibilities that were initially authorized during the public health emergency relating to COVID-19 (i.e., coronavirus disease 2019). Among other things, the bill allows (1) rural health clinics and federally qualified health centers to serve as the distant site (i.e., the location of the health care practitioner); (2) the home of a beneficiary to serve as the originating site (i.e., the location of the beneficiary) for all services (rather than for only certain services); and (3) all types of practitioners to furnish telehealth services, as determined by the Centers for Medicare & Medicaid Services.
Diplomatic Personnel Modernization Act This bill requires the Department of State to submit to Congress a comprehensive five-year strategic staffing plan. This plan must include (1) a data set displaying comprehensive workforce data for all current and planned State Department employees, disaggregated by certain metrics; (2) recommendations on the number of Foreign Service officers that should be posted at each U.S. diplomatic post and in the District of Columbia; and (3) recommendations on the number of civil service officers that the State Department should employ.
Ending Corporal Punishment in Schools Act of 2021 This bill prohibits the Department of Education (ED) from providing funding to any educational agency or institution that allows its school personnel to inflict corporal punishment upon a student as a form of punishment or to modify undesirable behavior. First, the bill requires each state educational agency (SEA), in order to receive education funds, to submit to ED a state plan for eliminating the use of corporal punishment in schools. Additionally, the bill authorizes ED to award three-year grants to SEAs and, through them, subgrants to local educational agencies (LEAs) to assist them with improving school climate and culture. Grants must be used to implement school-wide positive behavioral intervention and support programs. Further, LEAs that receive subgrants must ensure that private school personnel are able to participate in grant activities. ED may also allocate funds to the Department of the Interior for schools operated or funded by Interior. Next, the bill directs ED to carry out a national assessment to determine compliance with the requirements of the bill and identify best practices for professional development and training programs. Finally, the bill gives protection and advocacy systems the authority to investigate, monitor, and enforce protections for students that are provided by the bill.
ABLE Age Adjustment Act This bill increases from 26 to 46 the age threshold for tax-favored ABLE (Achieving a Better Life Experience) accounts. (ABLE accounts are designed to enable individuals with disabilities to save for and pay for disability-related expenses. To establish an account, an individual must have a qualifying impairment that began before the individual attained the age threshold.)
Confederate Monument Removal Act This bill prohibits a state from providing for display in National Statuary Hall a statue of a person who voluntarily served with the Confederate States of America, and it provides for the removal, return, and replacement of any statue currently on display that depicts such a person.
Protecting Our Students and Taxpayers Act of 2021 or the POST Act of 2021 This bill requires a for-profit institution of higher education (IHE), in order to participate in federal student-aid programs, to derive at least 15% of its revenue from sources other than federal funds. Current law requires a for-profit IHE to derive at least 10% of its revenue from sources other than federal funds. The bill also expands the definition of federal funds to include GI education benefits, with an exception for the monthly housing stipend provided under the Post-9/11 Educational Assistance Program.
Food Allergy Safety, Treatment, Education, and Research Act of 2021 or the FASTER Act of 2021 This bill expands the definition of major food allergen for purposes of certain food-labeling requirements to specifically include sesame. In addition, the Department of Health and Human Services must report on certain information related to food allergy research and data collection activities.
Kids' Access to Primary Care Act of 2021 This bill modifies payments for Medicaid primary care services. Specifically, the bill applies a Medicare payment rate floor to Medicaid primary care services that are provided after the date of enactment of the bill and extends the payment rate to additional types of practitioners (e.g., obstetricians). The Centers for Medicare & Medicaid Services must conduct a study on the number of children enrolled in Medicaid, the number of providers receiving payment for primary care services, and associated payment rates before and after the bill's implementation.
