HR 4291: Opportunities for Fairness in Farming Act of 2021

Opportunities for Fairness in Farming Act of 202 1 This bill establishes restrictions and requirements for checkoff programs, which are programs overseen by the Department of Agriculture (USDA) to promote and provide research and information for a particular agricultural commodity without reference to specific producers or brands. The bill prohibits boards established to carry out a checkoff program or a USDA order issued under a checkoff program from entering into a contract or agreement to carry out program activities with a party that engages in activities to influence any government policy or action that relates to agriculture. A board or its employees or agents acting in their official capacity may not engage in any act that may involve a conflict of interest; anticompetitive activity; unfair or deceptive act or practice; or act that may be disparaging to, or in any way negatively portray, another agricultural commodity or product. Upon approval of USDA, a board may enter directly into contracts and agreements to carry out generic promotion, research, or other activities authorized by law if the agreement or contract requires records accounting for the funds received to be submitted to the board. The board must meet specified requirements regarding the publication of budgets and disbursements of funds. The USDA Inspector General and the Government Accountability Office must conduct specified audits regarding checkoff programs.

HR 4264: Requiring Education Providers to Observe Requirements or Trigger Fines Act

Requiring Education Providers to Observe Requirements or Trigger Fines Act or the REPORT Fines Act This bill modifies the disclosure threshold regarding gifts or contracts from a foreign source that institutions of higher education (IHEs) must report to the Department of Education (ED). The bill also establishes new penalties for failure to report. Under current law, an IHE is required to disclose to ED a gift or contract that is from a foreign source and is valued at $250,000 or more, considered alone or in combination with all other gifts from or contracts with that foreign source within a calendar year. The bill instead requires the IHE to disclose such a gift or contract that is valued at $50,000 or more within a calendar year. In addition, the bill establishes new penalties for IHEs that fail to report to ED. These penalties include written warnings, civil penalties, and ineligibility for federal research funds. Further, the bill establishes accelerated penalties for IHEs that receive funding from certain countries (e.g., China or Russia).

HRES 402: Urging the Administration to facilitate assistance in response to the devastating impact of COVID–19 in India.

This resolution urges the President to facilitate private medical supply donations and to deliver urgently needed medical supplies, including oxygen generator plants, to India and countries neighboring India that are facing the spread of COVID-19.

Restore the Rights of Property Owners under the Eviction Moratorium Issued by the CDC Act of 2021 This bill nullifies beginning on July 1, 2021, the emergency order (and any extensions of the order) issued by the Centers for Disease Control and Prevention on September 4, 2020, that restricted residential evictions during the COVID-19 emergency. It also prohibits the order from being reissued unless specifically authorized by law.

HR 3733: Essential Caregivers Act of 2021

Essential Caregivers Act of 2021 This bill requires skilled nursing facilities, nursing facilities, intermediate care facilities for the intellectually disabled, and nearby inpatient rehabilitation facilities to establish an essential caregivers program during a public health emergency. Under the program, facilities must allow each resident to select up to two essential caregivers to provide daily living assistance, emotional support, or companionship during the emergency. Facilities must afford such caregivers 12 hours of access to residents each day (or unlimited access for end-of-life care), and caregivers must agree to follow facility protocols for staff safety. Facilities may deny access to caregivers who violate protocols, subject to certain notification requirements; the Centers for Medicare & Medicaid Services must establish an appeals process relating to such decisions and may take specified enforcement actions against facilities that violate the bill's requirements.

HR 4173: Tax-Free Pell Grant Act

Tax-Free Pell Grant Act This bill excludes from gross income, for income tax purposes, any amount received as a federal Pell Grant. It also expands the definition of qualified tuition and related expenses under the American Opportunity and Lifetime Learning tax credit to include computer or peripheral equipment (up to a maximum of $1,000), child and dependent care expenses, and course materials.

HR 4174: Expand American Educational Opportunity Act of 2021

Expand American Educational Opportunity Act of 2021 This bill replaces the Hope Scholarship and Lifetime Learning tax credits with a modified American Opportunity Tax Credit that (1) allows an income tax credit of up to $2,500 of the qualified tuition and related expenses of a student who is carrying at least one half of a normal course load, (2) allows a lifetime dollar limitation for the credit of $15,000 for all taxable years, and (3) increases the refundable portion of the credit to a maximum of $1,500. The bill defines qualified tuition and related expenses as tuition, fees, computer or peripheral equipment, child and dependent care expenses, and course materials for the taxpayer, the taxpayer's spouse, and dependents at certain postsecondary educational institutions. The bill also allows an exclusion from gross income, for income tax purposes, of any amount received as a Federal Pell Grant.

National Biomedical Research Act This bill establishes and makes deposits through FY2031 into the Biomedical Innovation Fund for initiatives at the National Institutes of Health and the Food and Drug Administration. The fund supports (1) research for disease prevention, diagnosis, and treatment; (2) research for diseases that disproportionally account for federal health care spending; (3) the development, review, and post-market surveillance of medical products; and (4) other innovative medical research.

HR 4131: Better Care Better Jobs Act

Better Care Better Jobs Act This bill establishes programs and provides funds for state Medicaid programs to improve home- and community-based services (HCBS), such as home health care, personal care, case management, and rehabilitative services. Specifically, the bill provides funds for the Centers for Medicare & Medicaid Services to award planning grants, develop quality measures, and provide technical assistance to states regarding specified HCBS improvements, particularly with respect to access, utilization, and the associated workforce. The bill also increases the Federal Medical Assistance Percentage (i.e., federal matching rate) for HCBS in states that develop plans and meet specified benchmarks for improvements. The bill also makes permanent (1) the Money Follows the Person Rebalancing Demonstration Program (a grant program to help states increase the use of HCBS for long-term care and decrease the use of institutional care), and (2) certain provisions regarding Medicaid eligibility that protect against spousal impoverishment for recipients of HCBS.

Therapeutic Fraud Prevention Act of 20 21 This bill prohibits commercial conversion therapy, which is a practice or treatment designed to change a person's sexual orientation or gender identity or otherwise change behaviors, thoughts, or expressions related to gender or sexual attraction. This prohibition does not apply to treatment that assists an individual undergoing a gender transition or facilitates identity exploration and development.
