SB 2028: AN ACT RELATING TO TAXATION -- SALES AND USE TAXES -- LIABILITY AND COMPUTATION

SB 2028 imposes a tiered sales tax on digital advertising services sold within Rhode Island, affecting large digital advertising companies based on their global revenue (2.5% for $100M-$1B revenue, 5% for $1B-$5B, 7.5% for $5B-$15B). The tax revenue will be distributed annually to specific state funds: 10% to public transit (RIPTA), 15% to climate resiliency, 5% to university research, 20% to housing, 10% to school lunches, 20% to municipal resilience, and 20% to the general fund. The tax applies to purchases of digital ads within Rhode Island and takes effect on July 1, 2026. It does not allow companies to add the tax as a separate fee on customer invoices but requires clear disclosure of the amount.

SB 2022: AN ACT RELATING TO TAXATION -- BUSINESS CORPORATION TAX

SB 2022 repeals Rhode Island's minimum business corporation tax, which required corporations to pay at least $400 annually regardless of profits. This change directly affects corporations subject to Rhode Island's business tax, particularly those that would have owed the minimum amount under current law. The bill removes the $400 annual minimum tax provision (previously $450 for 2015-2016 tax years), meaning corporations will only pay tax based on their actual net income. The repeal takes effect upon the bill's passage.

SB 2227: AN ACT RELATING TO TAXATION -- PERSONAL INCOME TAX

SB 2227 amends Rhode Island's personal income tax code to clarify how withdrawals from the state's tuition savings program are treated for tax purposes. Specifically, it modifies the calculation of taxable income for nonqualified withdrawals (those not used for eligible education expenses) by adding back certain amounts to federal adjusted gross income. This affects residents who use Rhode Island's tuition savings program (§ 16-57-6.1) and make nonqualified withdrawals. The bill does not address foreign service pensions as mentioned in the abstract; the actual provisions focus solely on tuition savings program tax treatment. The changes apply to taxable years beginning on or after January 1, 2020.
