HR 1132: Gun Owner Privacy Act

Gun Owner Privacy Act This bill restricts the use of federal funds in connection with the implementation and operation of a firearms-related background check system. Specifically, it prohibits the use of federal funds for a firearms-related background check system that does not immediately destroy all information about a person who is eligible to own firearms, or the implementation or collection of a tax or fee in connection with a firearms-related background check.

HR 1143: LOAN Act

Lenders Offer Assistance Now Act or the LOAN Act This bill requires the discharge of a private education loan in the event of the student borrower's disability. Such a discharge is not considered income for tax or other purposes. Additionally, the bill prohibits the automatic default of a private education loan due to the disability of a loan cosigner. Furthermore, the bill generally permits the discharge of student loans in bankruptcy. Under current law, student loans are not dischargeable in bankruptcy unless repayment would be an undue hardship to the debtor and the debtor's dependents.

HR 1159: Preventing Tragedies Between Police and Communities Act of 2021

Preventing Tragedies Between Police and Communities Act of 2021 This bill requires a state or local government that receives funding under the Edward Byrne Memorial Justice Assistance Grant (JAG) program to train law enforcement officers on de-escalation techniques and require law enforcement to use such techniques. The Department of Justice (DOJ) may reduce the JAG allocation of a state or local government that fails to comply with the training requirement. DOJ must reduce by 15% the JAG allocation of a state or local government that fails to require law enforcement officers to use de-escalation techniques.

HR 1080: Pain-Capable Unborn Child Protection Act

Pain-Capable Unborn Child Protection Act This bill establishes a new criminal offense for performing or attempting to perform an abortion if the probable post-fertilization age of the fetus is 20 weeks or more. A violator is subject to criminal penalties—a fine, a prison term of up to five years, or both. The bill provides exceptions for an abortion (1) that is necessary to save the life of the pregnant woman, or (2) when the pregnancy is the result of rape or incest. A physician who performs or attempts to perform an abortion under an exception must comply with specified requirements. A woman who undergoes a prohibited abortion may not be prosecuted for violating or conspiring to violate the provisions of this bill.

HR 1026: LABEL Opioids Act

Lessening Addiction By Enhancing Labeling Opioids Act of 2021 or the LABEL Opioids Act This bill requires prescription opioids to contain a warning label specifying that the opioids may cause dependence, addiction, and overdose. A registrant (e.g., a pharmacist) who dispenses an opioid in violation of the labeling requirement is subject to penalties.

Domestic Violence Public Health Emergency Guidance Act This bill requires the Department of Justice to issue guidance to law enforcement agencies on model practices for addressing domestic violence and protecting the safety of law enforcement officers during the COVID-19 (i.e., coronavirus disease 2019) public health emergency.

S 1385: Puppy Protection Act of 2021

Puppy Protection Act of 2021 This bill requires the Department of Agriculture to expand standards that govern the humane handling, care, treatment, and transportation of animals to include new requirements for commercial dog dealers. Specifically, the standards must require dog dealers to provide to dogs adequate housing, exercise, and veterinary care; appropriate and nutritious food; continuous access to potable water; and meaningful socialization with humans and compatible dogs for at least 30 minutes each day. The standards must also include requirements for breeders to use safe breeding practices and make all reasonable efforts to find humane placement for retired breeding dogs.

S 1380: Clean Slate Act of 2021

Clean Slate Act of 2021 This bill establishes a framework for sealing records related to certain federal criminal offenses. Courts must automatically seal records related to (1) a conviction for simple possession of a controlled substance or for any nonviolent offense involving marijuana, or (2) an arrest for an offense that does not result in a conviction. Additionally, an individual who meets certain criteria may petition to seal records related to a conviction for other nonviolent offenses.

HR 2833: Reconnecting Communities Act

Reconnecting Communities Act This bill establishes a grant program to remove, retrofit, or otherwise address infrastructural barriers (e.g., highways, railways, or viaducts) that impede mobility and connectivity, with a particular focus on communities of color and low-income communities. Under this program, the Department of Transportation (DOT) must award three types of grants: community engagement, education, and capacity-building grants to educate and involve community members in transportation and economic development planning; planning and feasibility study grants to develop designs, conduct environmental reviews, and carry out other preliminary activities required to remove, retrofit, or mitigate an infrastructural barrier; and capital construction grants to remove, retrofit, or mitigate an infrastructure barrier. DOT must award the community engagement, education, and capacity-building grants and the planning and feasibility study grants to state, tribal, and local governments; metropolitan planning organizations; and nonprofits. An eligible entity may apply for and receive funding from more than one type of grant. DOT must award the capital construction grants to the owner of an infrastructure barrier. The owner may, if applicable, partner with other eligible entities.

HR 2835: Consortia-Led Energy and Advanced Manufacturing Networks Act

Consortia-Led Energy and Advanced Manufacturing Networks Act This bill requires the Department of Commerce to carry out a grant program for establishing consortia to enhance U.S. economic, environmental, and energy security by promoting domestic research and commercial application of clean technologies and advanced manufacturing processes. Clean technology means technologies, production processes, or methodologies that produce energy from renewable energy sources; transmit, distribute, or store energy more efficiently; enhance energy efficiency for buildings and industry; enable the development of a Smart Grid; produce an advanced or sustainable material with energy or energy efficiency applications; improve energy efficiency for transportation; or enhance water security through improved water management, conservation, distribution, or end use applications.

HR 3: Elijah E. Cummings Lower Drug Costs Now Act

Elijah E. Cummings Lower Drug Costs Now Act This bill establishes several programs and requirements relating to the prices of prescription drugs. In particular, the bill requires the Department of Health and Human Services (HHS) to negotiate prices for certain drugs (current law prohibits HHS from doing so). Specifically, HHS must negotiate maximum prices for single-source, brand-name drugs that lack certain generics and that are among either the 125 drugs that account for the greatest national spending or the 125 drugs that account for the greatest Medicare spending. HHS must negotiate the prices of at least 25 such drugs for 2024 and of at least 50 such drugs thereafter and must also negotiate prices for certain newly approved drugs and for insulin products. The negotiated prices must be offered under Medicare and may also be offered under private health insurance unless the insurer opts out. The negotiated maximum price may not exceed (1) 120% of the average price in Australia, Canada, France, Germany, Japan, and the United Kingdom; or (2) if such information is not available, 85% of the U.S. average manufacturer price. Drug manufacturers that fail to comply with the bill's negotiation requirements are subject to civil and tax penalties. The bill also makes a series of additional changes to Medicare prescription drug coverage and pricing, including by (1) requiring drug manufacturers to issue rebates to the Centers for Medicare & Medicaid Services for covered drugs that cost $100 or more and for which the average manufacturer price increases faster than inflation, and (2) capping annual out-of-pocket spending under the Medicare prescription drug benefit. The bill also requires drug manufacturers to report specified information for certain high-cost drugs, and it provides funds for opioid epidemic initiatives and biomedical research.

HR 1466: American PPE Supply Chain Integrity Act

The American PPE Supply Chain Integrity Act This bill requires specified federal departments to purchase certain items, including medical supplies, personal protective equipment (PPE), and clothing, from the United States, with exceptions. Specifically, the bill requires the Department of Health and Human Services, the Department of Homeland Security (DHS), and the Department of Veterans Affairs to purchase items such as specified medical supplies (including disinfecting wipes), PPE, and fabric products (including clothing, bags, and tents) from products that are 100% grown, reprocessed, reused, or produced in the United States. The bill requires regulations to (1) prohibit the use by any federal department or agency of reverse auctions or lowest price technically acceptable contracting methods for the procurement of PPE if the level of quality or failure of the item could result in infection, illness, or death; and (2) establish a preference for the use of best value contracting methods for the procurement of such equipment. The bill applies the Berry Amendment (which requires the Department of Defense to give preference in procurement to domestically produced, manufactured, or homegrown products) to specified supplies and equipment, such as surgical dressing materials, hospital and surgical clothing, and textile medical supplies and equipment.
