SB 830: Relating to wine labeling; prescribing an effective date.

Requires that , to extent provided by Oregon Liquor Control Commission rules, if wine labeled with American viticultural area in Oregon is labeled with single grape variety as type designation, wine must meet specified content requirements. Authorizes Oregon Liquor Control Commission to exempt wine varieties or American viticultural areas from requirement. ] Requires commission to make requirements applicable to wine with labels identifying Willamette Valley viticultural area and American viticultural areas wholly or partly within Willamette Valley viticultural area. Creates exception. Requires commission to classify certain grape varieties as exempt from content requirements. Authorizes commission to exempt additional grape varieties by rule. Prohibits identifying Pinot noir as exempt grape variety. Establishes content requirement for wine from exempt grape varieties. Establishes default content requirement for wines not subject to other content requirements. Applies ] Makes content requirements applicable to wine labeled on or after January 1, 2023. Imposes revised content requirements for wine bottled on or after January 1, 2030. Requires commission to appoint advisory committee. Sunsets advisory committee January 2, 2030 ] 2023 . Requires commission to adopt rules establishing penalty schedule for labeling requirement. Creates exception to civil penalty. Requires adoption of initial rules in time to take effect January 1, 2023. Repeals rule adoption requirement January 2, 2023 ] 2024 . Requires commission to report to interim committee of Legislative Assembly no later than September 15, 2020, regarding advisory committee recommendations and status of commission rule adoption proceedings. Takes effect on 91st day following adjournment sine die.

HB 3099: Relating to the withdrawal of the territory of a city from a special district; declaring an emergency.

Authorizes city that was annexed into special ] county service district to petition county board for withdrawal from district. Provides that if city that was annexed into special district upon election called only in such city wishes to withdraw from district, election called to withdraw city from district shall also be held only in city. ] Changes requirement that withdrawal petition must be approved or denied depending on feasibility of providing district service to territory described in petition to option for county board to approve or deny petition based on feasibility. Provides that if city is withdrawn from county service district, city and district must negotiate and finalize agreement for equitable division and disposal of district assets. Authorizes resolution by circuit court if city and district are unable to agree on division and disposal of district assets. Provides that if city was annexed into county service district upon election held only in city, and petition proposes withdrawal of city from district, election called to withdraw city from district must also be held in city. Declares emergency, effective on passage.

HB 2020: Relating to greenhouse gas emissions; declaring an emergency.

Establishes Climate Policy Office within Oregon Department of Administrative Services and directs office to adopt Oregon Climate Action Program by rule. Creates Oregon Climate Board to advise office. Modifies statewide greenhouse gas emissions reduction goals. Establishes Joint Committee on Climate Action. Becomes operative on effective date of Act. Establishes purposes of Oregon Climate Action Program and provisions for investment of moneys received by state as proceeds from auctions conducted under program. Requires program to place cap on greenhouse gas emissions that are regulated emissions and to provide market-based mechanism for covered entities to demonstrate compliance with program. Sets forth certain other requirements for program and for rules adopted by office related to program. Establishes certain funds. Sets forth requirements for uses of moneys deposited in funds. Sets forth certain duties of Public Utility Commission related to program. Authorizes commission to allow rate or rate schedule to include differential rates or to reflect amounts for programs that enable public utilities to assist low-income residential customers. Authorizes commission to allow rate or rate schedule to reflect amounts for investments in infrastructure measures that support adoption of alternative forms of transportation vehicles. Amends greenhouse gas reporting statute. Repeals Energy Facility Siting Council carbon dioxide emissions standards. Includes provisions for treatment of site certificate conditions affected by repeal of carbon dioxide emissions standards. Repeals authority for State Forester to establish forestry carbon offset program. Becomes operative January 1, 2021. Requires Environmental Quality Commission to adopt by rule standards and requirements for reducing methane gas emissions from landfills. Becomes operative on effective date of Act. Abolishes Oregon Global Warming Commission and transfers duties to Oregon Climate Board. Becomes operative January 1, 2020. Transfers to Climate Policy Office duties, functions and powers of Environmental Quality Commission and Department of Environmental Quality related to greenhouse gas reporting. Becomes operative January 1, 2022. Provides for expedited review of certain questions on Act to Supreme Court upon petition by adversely affected party. If Supreme Court declares upon expedited review that auctions conducted under Act do not impose tax subject to Article IX, section 3a, Oregon Constitution, requires Climate Policy Office to identify certain specific opportunities for using certain state proceeds from auctions. Requires certain reports and proposals. Modifies study related to highway maintenance, operation and improvement costs. Declares emergency, effective on passage.

HB 2408: Relating to the application of a prevailing rate of wage to public works projects; declaring an emergency.

Includes within definition of "public works" project for constructing, reconstructing or performing major renovation of privately owned road, highway, building, structure or improvement that is located in enterprise zone or for which qualified business firm received or will receive exemption from ad valorem property taxation and has total project cost estimated as equaling or exceeding $20 million. Defines "funds of a public agency," for purposes of applying prevailing rate of wage to projects for public works, to include tax credits or tax abatements that contractor engaged in public works project receives from state in connection with project. Requires contractor or contractor's surety to file certified statements with, as appropriate, public agency that awarded contract for public works or sponsor of enterprise zone in which public works project is located. Becomes operative on January 1, 2020. ] Takes effect on 91st day following adjournment sine die. ] Becomes operative 91 days after effective date of Act. Declares emergency, effective on passage.

HB 3173: Relating to elections for county commissioners; declaring an emergency.

Specifies that when two or more county commissioners are elected for one county at same election and one is elected to fill vacancy, commissioner filling vacancy shall hold office for two years. Applies this rule, which currently applies only to general elections, to primary elections. Declares emergency, effective on passage.

SB 901: Relating to translator districts.

Authorizes translator district board to establish property tax permanent rate limit and impose operating taxes, following elector approval. Authorizes district board to impose local option taxes following elector approval. Authorizes translator districts to enter into enforcement agreements with cities to permit code enforcement officers to determine if property occupant is intentionally receiving and using translator district signals.

HB 2456: Relating to Eastern Oregon Border Economic Development Region housing; prescribing an effective date.

Allows counties to partition and rezone up to 200 acres of lands within Eastern Oregon Border Economic Development Region from exclusive farm use to residential uses. Continues any applicable farm use tax deferral and valuation on properties in region until redeveloped for sale or five years after rezoning. Applies to property tax years beginning on or after July 1, 2020, and before July 1, 2031. ] Entitles owner to income tax credit of up to $5,000 on sale of new residential dwelling on rezoned property. Applies to tax years beginning on or after January 1, 2020, and before January 1, 2026. ] Takes effect on 91st day following adjournment sine die.

SB 1040: Relating to discharge of firearms from quarries or mines in Polk County adjacent to the Willamette River; declaring an emergency.

Makes owner, operator or lessee of quarry or mine located on property adjacent to Willamette River in Polk County strictly ] and across river from City of Keizer liable for injuries resulting from bullets that stray outside boundaries of property if, after being notified that bullets have strayed, owner, operator or lessee fails to take reasonable measures to prevent additional bullets from straying . Provides exceptions. ] Makes person who discharges firearm from quarry or mine located on property adjacent to Willamette River in Polk County strictly ] and across river from City of Keizer liable for injuries resulting from bullets that stray outside boundaries of property. Allows injured person to bring civil action against city or county that fails to reasonably regulate discharge of firearms from property adjacent to Willamette River in Polk County containing quarry or mine. ] Declares emergency, effective on passage.

HB 2303: Relating to pseudoephedrine; prescribing an effective date.

Allows pharmacist or pharmacy technician to transfer drug containing pseudoephedrine without prescription to person who is at least 18 years of age and presents person's valid government-issued photo identification. Requires pharmacist or pharmacy technician, prior to transfer, to submit specified information into electronic system designed to prevent illegal transfer of drugs containing pseudoephedrine. Requires pharmacist or pharmacy technician to record specified information about transfer of drug containing pseudoephedrine. Specifies maximum amount of pseudoephedrine that person may receive without prescription. Establishes storage requirements for drug containing pseudoephedrine. Clarifies that measure does not apply to drugs transferred pursuant to prescription. Punishes violation by 364 days' imprisonment, $6,250 fine, or both. ] Allows pharmacist to prescribe and dispense pseudoephedrine to person who is at least 18 years of age and who provides to pharmacist person's valid government-issued photo identification. Requires pharmacist to query prescription monitoring program prior to prescription and dispensation. Limits amount of pseudoephedrine person may receive. Allows State Board of Pharmacy to adopt rules. Removes provision subjecting records of specified transactions to inspection by board and law enforcement agencies. Becomes operative January 1, 2020. Sunsets December 31, 2023. ] Takes effect on 91st day following adjournment sine die.

HB 3342: Relating to plant-based meals.

Requires certain medical and residential facilities ] hospitals and long term care facilities to make available to patients and residents plant-based meals when necessary to accommodate medical, religious, cultural or ethnic needs, preferences or requests . Requires Department of Corrections to make available to inmates plant-based meals any time meal is served .
