HB 4026: Relating to state finance; and prescribing an effective date.

Modifies disposition of certain estimated excess corporate excise tax revenues by dividing estimated excess between Education Stability Fund and Oregon Rainy Day Fund. ] Prohibits Department of Revenue from considering charitable activities in determining individual's domicile or resident status. Applies to tax years beginning on or after January 1, 2019. Takes effect on 91st day following adjournment sine die.

HB 4144: Relating to contractors.

Allows applicant ] individual applying for construction contractor license with residential general contractor or residential specialty contractor endorsement who has specified amount of experience in construction-related activities on residential or small commercial structures to obtain license and endorsement without meeting contractor training requirements or paying fees to Construction Contractors Board. Allows applicant who has specified amount and type of experience in plumbing work on residential or small commercial structures to obtain plumbing contractor license without meeting contractor training requirements or paying fees to State Plumbing Board. ] Allows applicant who has specified amount and type of experience in electrical work on residential or small commercial structures to obtain electrical contractor license without meeting contractor training requirements or paying fees to Department of Consumer and Business Services. ] Allows plumbing contractor or electrical contractor who obtained license based on experience without training or board or department fees to obtain construction contractor license with residential specialty contractor endorsement without meeting construction contractor training requirements or paying fees to Construction Contractors Board. ] Allows individual qualifying for plumbing contractor license or electrical contractor license to obtain license without fee payment if individual obtained construction contractor license with residential general contractor or residential specialty contractor endorsement without meeting training or fee payment requirements. Allows business owned and managed by person who obtained construction contractor license with residential general contractor or residential specialty contractor endorsement without meeting training and fee payment requirements to qualify as emerging small business and obtain loan for capital investment purposes if contractor agrees to certain conditions. Allows business owned and managed by person who obtained construction contractor license with residential general contractor or residential specialty contractor endorsement without meeting training and fee payment requirements to qualify for financial support as local economic development assistance for workforce investment ] recruitment, training or retention if contractor agrees to certain conditions. Requires board to report to interim committee of Legislative Assembly no later than October 1, 2020, regarding program allowing individual to obtain construction contractor license with residential general contractor or residential specialty contractor endorsement without meeting contractor training requirements or paying fees to board. Requires Department of Consumer and Business Services to report to interim committee of Legislative Assembly no later than October 1, 2020, regarding program allowing qualified individual to obtain plumbing contractor or electrical contractor license if individual obtained construction contractor license with residential general contractor or residential specialty contractor endorsement without meeting training or fee payment requirements. Requires Oregon Business Development Department to report to interim committee of Legislative Assembly no later than October 1, 2020, regarding program allowing individual who obtained construction contractor license with residential general contractor or residential .

HB 4018: Relating to coordinated care organizations; and declaring an emergency.

Requires meetings of governing body of coordinated care organization in which decisions are made final to be open to public and to take public testimony. Requires coordinated care organization to record all meetings of governing body in sound, video, digital or written format and make record available on coordinated care organization's website. Requires coordinated care organization to provide contact information for chairperson of governing body and member of governing body or designated staff person. Requires expenditure of portion of coordinated care organization's annual net income or reserves on services designed to address health disparities and social determinants of health. Modifies composition of coordinated care organization governing body. Establishes new requirements for contracts between Oregon Health Authority and coordinated care organizations. Requires coordinated care organization to provide advance notice of intent not to renew contract to authority and, under certain circumstances, to members and providers. Declares emergency, effective on passage.

SB 1557: Relating to students ordered to active duty; and declaring an emergency.

Requires community colleges, public universities and Oregon Health and Science University to provide certain rights to students ordered to federal or state active duty for 30 or fewer consecutive days. Declares emergency, effective on passage.

HB 4139: Relating to the taxation of certain heavy equipment; and prescribing an effective date.

Imposes tax on rental price of construction, mining, earthmoving or industrial equipment, together with attachments and other equipment and tools, that is mobile and held primarily for rental. Directs Department of Revenue to administer heavy equipment rental tax program. Provides for pro rata distribution of two percent of gross tax revenues among counties that do not otherwise receive qualified heavy equipment rental tax revenues. Provides for distribution to counties of net tax revenues attributable to rentals made from locations in county. Directs county treasurer to distribute tax moneys to local taxing districts in accordance with property tax and interest distribution percentage schedule. Provides for temporary annual payments by or to equipment owner of any difference between heavy equipment rental tax and ad valorem property tax that would be assessed on such equipment if such equipment were subject to ad valorem property tax. Requires department to submit report regarding heavy equipment rental tax experience, including proposed tax rate to maintain revenue neutrality with respect to replacement of ad valorem property tax by heavy equipment rental tax, to interim committees related to revenue no later than July 1, 2022. Takes effect on 91st day following adjournment sine die.

SB 1565: Relating to methods of public procurement; and prescribing an effective date.

Requires Attorney General, Director of Oregon Department of Administrative Services and Director of Transportation to cooperate in adopting rules for end-to-end electronic procurement system. Specifies minimum contents for rules. Requires state agency to use electronic procurement system in accordance with rules in conducting procurement. Permits contracting agency that is not state agency to choose to conduct procurement using electronic procurement system. ] Requires Oregon Department of Administrative Services to establish pilot program for using reverse auction method for conducting procurement for goods and services. Specifies features that pilot program must have. Requires department to regularly report to Governor and Joint Legislative Committee on Information Management and Technology concerning department's implementation of pilot program and to evaluate pilot program and submit final report with results of department's evaluation not later than December 31, 2019. Sunsets program on January 2, 2020. Requires state contracting agency in evaluating competitive proposal to weight proposed contract price at not less than 30 percent of total weight that state contracting agency gives to all factors in final evaluation of proposals. Provides that director or other head of state contracting agency may waive requirement if director or other head determines that waiver is in best interest of state contracting agency. Requires director or other head to report each waiver to Oregon Department of Administrative Services unless state contracting agency is Secretary of State or State Treasurer. Requires Secretary of State and State Treasurer to keep written record of each waiver in procurement file for public contract. Becomes operative January 1, 2019. Takes effect on 91st day following adjournment sine die.

HB 4137: Relating to addiction recovery; and declaring an emergency.

Requires Alcohol and Drug Policy Commission to report to interim committees of Legislative Assembly, no later than September 15 ] December 31 , 2018, its recommendations for scope and framework for its comprehensive addiction, prevention, treatment and recovery plan. Requires plan to be reviewed and updated by September 15 ] July 1 of each even-numbered year beginning July 1, 2020 . Requires Oregon Health Authority to report to Legislative Assembly on scope of alcohol and drug abuse and addiction in Oregon and on availability of prevention, treatment and recovery services. ] Grants specified powers to Director of Alcohol and Drug Policy Commission to carry out duties, functions and powers of commission. Declares emergency, effective on passage.

HB 4049: Relating to sexual assault forensic evidence kits; and declaring an emergency.

Directs Department of State Police to establish multidisciplinary committee on tracking of sexual assault forensic evidence kits. Directs department to adopt recommendations of committee and to create and maintain statewide electronic sexual assault forensic evidence kit tracking system. Establishes requirements of tracking system. Exempts records and information within tracking system from disclosure as public record. Directs department to, no later than January 1, 2019, report on status of tracking system to Task Force on the Testing of Sexual Assault Forensic Evidence Kits and to Governor and Attorney General. Extends sunset of Task Force on the Testing of Sexual Assault Forensic Evidence Kits to June 30, 2021. Directs task force to monitor implementation of tracking system and to, no later than December 1, 2020, submit to interim committee of Legislative Assembly related to judiciary final report that includes status update on tracking system. Declares emergency, effective on passage.

Eliminates probationary driver permits. Standardizes requirements for hardship permits. Eliminates certain driving privilege suspensions.
