Provides proceedings to escheat to State of Oregon matured United States savings bonds presumed abandoned and in custody of state. Authorizes Director of Department of State Lands to seek payment for escheated bonds from United States Treasury. Declares emergency, effective on passage.
Gives hemp research program currently operated by State Department of Agriculture name of Oregon Industrial Hemp Agricultural Pilot Program. Authorizes actions by department to carry out program. Specifies that agricultural hemp seed is agricultural seed or flower seed for purposes of statutes regulating labeling, testing, certifying or other aspects of seeds. Directs Director of Agriculture and Dean of College of Agricultural Sciences of Oregon State University to establish program for labeling and certification of agricultural hemp seed. Provides that accredited independent testing laboratory that has been approved by Oregon Health Authority or department may test industrial hemp and industrial hemp commodities and products produced or processed by grower, handler or agricultural hemp seed producer. Requires that industrial hemp intended for human consumption be entered into tracking system prior to laboratory testing and through delivery to licensed premises. Modifies other provisions related to regulation of industrial hemp. Authorizes Oregon Liquor Control Commission actions regarding industrial hemp to enforce and ensure compliance with marijuana laws and provisions of industrial hemp laws that incorporate requirements, restrictions or other provisions of marijuana laws. Prohibits sale of industrial hemp containing more than 0.3 percent tetrahydrocannabinol to consumer by person other than licensed retailer. Changes description of limit on production and storage of homegrown cannabis plants. Prohibits production, processing or storage of homemade industrial hemp extracts. Allows department to adopt rule establishing higher average tetrahydrocannabinol concentration limit for industrial hemp if higher average concentration limit is established by federal law. Revises language regarding grower retention of agricultural hemp seed for producing industrial hemp. Establishes Industrial Hemp Fund. Appropriates fund moneys to department for purposes of implementing, administering and enforcing industrial hemp statutes. Directs certain moneys to fund. Declares emergency, effective on passage.
Directs Public Employees Retirement Board to adopt rules providing that, if Oregon Investment Council invests assets of individual account program in multiple risk categories depending on characteristics of individual member, member of individual account program may direct investment of individual accounts in any risk category or with other assets of Public Employees Retirement Fund ] elect to have moneys in member's individual accounts deposited into approved investment option . Directs office of State Treasurer to review legal and fiduciary standards. Provides that if office of State Treasurer determines that standards prohibit implementation of Act, board may not adopt rules to implement Act. Declares emergency, effective on passage.
Prohibits child care providers from enrolling in Central Background Registry or providing child care for five years after denial for cause, revocation or voluntary surrender of certification or registration and for five years after denial for cause, removal or voluntary surrender of enrollment in Central Background Registry. Confers on Office of Child Care continuing jurisdiction over actions against individuals or child care facilities. Permits Office of Child Care to issue cease and desist orders. Directs Office of Child Care to develop progressive enforcement system for rule violations. Permits Office of Child Care to impose conditions on certification or registration of child care facility. Increases maximum civil penalty amounts for violations committed by child care providers. Declares emergency, effective on passage.
Directs Chief Education Office to conduct study on recruitment, retention, mentoring and professional development of educators who serve students from student groups that may be at risk for experiencing achievement gap. Sunsets June 30, 2019. Takes effect on 91st day following adjournment sine die.
Requires Chief Education Office to prepare annual report on accelerated college credit programs. Sunsets report requirements on January 2, 2029. Directs Higher Education Coordinating Commission to develop statewide standards related to information provided by public post-secondary institutions of higher education about accelerated college credit programs. Limits expenses for which dependent care income tax credit may be claimed to combination of ] earned income taxable by Oregon and imputed income ], using lesser amount attributable to either spouse on joint return. Provides for calculation based upon imputed income to allow degree-seeking enrolled student to claim credit. ] Modifies annual limitation on total amount of tax credits for production or collection of bovine manure allowed for all taxpayers by tying limitation to calendar year instead of tax year. Modifies terms. Provides that qualified borrower on loan related to manufactured dwelling park for which lending institution may be allowed tax credit for qualified loan includes nonprofit corporation or housing authority with controlling interest in real property. Applies to tax years beginning on or after January 1, 2018. Allows Legislative Assembly to appropriate to Oregon Production Investment Fund balance of amount allowed for certification, but not certified, for tax credit for contributions to fund for current or upcoming fiscal year. Applies to fiscal years beginning on or after July 1, 2017. Provides for transfer and abatement of clawback of property taxes not imposed with respect to land that ceases to be exempt as land held for cemetery or crematory purposes if land is purchased for purpose of providing low income housing subject to certain property tax exemption programs for at least 10 consecutive property tax years. Adjusts sunset date for property tax exemption for low income rental housing. For purposes of certain economic development property tax benefits, provides that "eligible location" includes location not formerly used for industrial purposes and "eligible property" may be property appraised either by county or by Department of Revenue and clarifies definition of "rural area." Takes effect on 91st day following adjournment sine die.
Permits individual to create first-time home buyer savings account with financial institution to pay or reimburse account holder's eligible costs for first-time purchase of single family residence. Allows subtraction from account holder's federal taxable income of amounts contributed to first-time home buyer savings account during each tax year. Exempts from taxation amount of interest and other income earned on account. Establishes amount and time limitations on subtractions and exemptions from taxable income. Provides that withdrawals for purposes other than approved purposes are taxable income to account holder and subject to penalty . Applies to tax years beginning on or after January 1, 2019, and before January 1, 2027 ] 2037 . Increases amount of fees charged and collected by county clerks to record or file certain real property documents and transferred to Housing and Community Services Department accounts for housing-related programs. Exempts county tax collectors from paying certain fees. Takes effect on 91st day following adjournment sine die.

Authorizes State Fish and Wildlife Commission to adopt record keeping requirements for person engaged in taking, landing, buying or selling of food fish for commercial purposes or otherwise dealing in food fish for commercial purposes. Creates exception. Allows commission and Director of Agriculture ] , State Department of Fish and Wildlife, State Department of Agriculture or designees to examine records. Authorizes commission to undertake surveys, investigations and inquiries regarding food fish. Requires commission to undertake survey, investigation or inquiry requested by director. Requires commission to report to director on results of completed surveys, investigations or inquiries. ] Allows State Department of Agriculture to request record copies and information for purpose of food safety law programs. Allows department to enter premises where records are kept as part of general pattern of administration and enforcement of food safety laws.
Directs Attorney General to appoint members with certain backgrounds or qualifications to batterers' intervention program standards advisory committee. Specifies requirements for program standards. Specifies requirements for retention of sexual assault forensic evidence kits by law enforcement agencies. Directs Department of Justice to create informational materials for victims of sexual assault describing services payable by Sexual Assault Victims' Emergency Medical Response Fund. Requires health care providers to, upon request, provide Psychiatric Security Review Board with medical records of person under jurisdiction of board. Modifies procedures by which person found guilty except for insanity and on conditional release may be ordered returned to state hospital or other facility. Specifies entities authorized to issue order and under what circumstances each entity may issue order. Modifies elements of, and exceptions to, crime involving unlawful operation of unmanned aircraft system. Authorizes court to vacate judgment of conviction for violating municipal prostitution ordinance upon making certain findings. Provides that moneys in inmate transitional fund, while within custody or control of Department of Corrections, are not assignable or subject to process. Increases to 30 days mandatory term of incarceration for person convicted of crime of initiating a false report if law enforcement Special Weapons and Tactics team was deployed and deployment resulted in death or serious physical injury to another person. Modifies general conditions of probation to include requirement that probationer follow reasonable recommendations resulting from risk and needs assessment. Authorizes court to enter judgment of conviction for Class A misdemeanor when person convicted of possession of controlled substance constituting Class B felony has successfully completed probation and court makes certain findings. Provides that court may enter judgment of conviction for Class A misdemeanor for specified felonies at any time after sentence of probation has been completed when person otherwise qualifies. Provides that offender revoked from optional probationary sentence shall receive credit for time served in jail unless court orders otherwise. Confers jurisdiction upon Supreme Court to determine constitutionality of chapter 673, Oregon Laws 2017, for certain appeals. Requires court to expedite disposition in appeals of civil actions. Sunsets July 1, 2023. Requires law enforcement agency or prosecuting attorney's office to inform Department of State Police of action taken concerning report of attempted unlawful transfer of firearm instead of action taken concerning each attempted unlawful transfer. Establishes Employer Incentive Fund. Appropriates moneys in fund to Public Employees Retirement Board for purpose of matching portions of certain lump sum payments of employer contributions to Public Employees Retirement System. Allows participating public employer that makes certain lump sum payment of employer contributions to system in amount equal to or greater than $10 million to choose amortization period for use of lump sum payment to offset employer contributions otherwise owed. Directs transfer of certain proceeds from debt collection, capital gains tax, estate tax, marijuana tax, wine, cider and malt beverage privilege tax and lawsuit settlements to Public Employees Retirement Fund to be credited to side account for school districts. ] Directs transfer of certain proceeds from lottery revenues to Public Employees Retirement Fund to be credited to side accounts for school districts, community colleges and public universities. ] Provides that Department of State Lands shall transfer from Common School Fund Account all or part of interest earned from certain unclaimed property to Public Employees Retirement Fund to be credited to side account for school districts. ] Establishes School Districts Unfunded Liability Fund. Appropriates moneys in fund to Public Employees Retirement Board for purpose of establishing and funding pooled account to be applied against liabilities of participating public employers that are school districts. Directs transfer of certain proceeds from debt collection, capital gains tax and estate tax and all or part of interest from certain unclaimed property to fund. Directs Public Employees Retirement Board to establish Unfunded Actuarial Liability Resolution Program to assist participating public employers in developing plans to improve funded status and manage employer contribution rate changes. Requires board to report to Joint Committee on Ways and Means during each regular session on status of funds and program. Directs State Treasurer to study feasibility and prudence of borrowing moneys in Oregon Short Term Fund to be redeployed into investments. Directs State Treasurer to report to Legislative Assembly on results of study no later than September 30, 2019. Directs Department of Revenue to distribute estimated amount of increased corporate tax revenue attributable to treatment of post-1986 deferred foreign income to Employer Incentive Fund and to School Districts Unfunded Liability Fund on or before July 1, 2021. Provides for direct review by Supreme Court. Takes effect on 91st day following adjournment sine die.
