SB 995: Relating to civil proceedings.

Modifies provisions relating to restraining orders. Directs State Court Administrator to study issues relating to civil proceedings and report to committee or interim committee of Legislative Assembly no later than December 31, 2020. ].

SB 25: Relating to forensic evaluations; and declaring an emergency.

Directs public bodies, and private entities ] medical providers in possession of relevant records, to comply, within specified time period, with court order for release of records to state mental hospital or other facility for purposes of forensic evaluation. Authorizes exception for good cause and for certain entities. Requires ] Allows report resulting from forensic evaluation on issue of mental defense to be filed with court electronically. Specifies manner in which report may be disclosed and used. Allows forensic evaluation on issue of fitness to proceed to be filed with court electronically. Specifies manner in which fitness to proceed evaluations and reports may be disclosed and used. Extends time period of commitment for mental defense examination from 30 days to 60 days. ] Requires that court provide, by end of next business ] judicial day, copies of orders relating to fitness to proceed to state mental hospital or other facility and community mental health program director or designee , and, if defendant is found to lack fitness, to any entity ordered to provide services and supervision to restore fitness. Declares emergency, effective on passage.

SB 165: Relating to employer exemption from participation in Oregon Retirement Savings Plan; and prescribing an effective date.

Directs employer, on annual tax withholding return submitted to Department of Revenue, to indicate whether employer offers qualified retirement savings plan that would allow exemption from participation in Oregon Retirement Savings Plan. Allows department to share collected information with State Treasurer. Applies to returns submitted to department on or after January 1, 2020. Takes effect on 91st day following adjournment sine die.

SB 411: Relating to exemptions from maximum vehicle weight limitations.

Directs Department of Transportation to prepare report on maximum weight limits of vehicles powered by electricity and submit report to interim committees of Legislative Assembly related to transportation on or before September 15, 2020. ] Sunsets January 2, 2021. ] Provides limited exemption from maximum weight limitations for vehicles powered primarily by means of electric battery.

SB 269: Relating to sexual assault in correctional facilities.

Directs Department of Corrections to conduct study on sexual assault within women's correctional facilities and to report to interim committees of Legislative Assembly related to judiciary on or before February 1, 2020. ] Requires appointing authority to dismiss department or Oregon Corrections Enterprises employee convicted of sex crime committed against inmate or other employee. ] Requires department to adopt policy for reduction and prevention of sexual abuse and sexual harassment, and to publish policy on Internet website. ] Declares emergency, effective on passage. ] Directs Department of Corrections to provide audit report prescribed by Prison Rape Elimination Act of 2003 to Legislative Assembly no later than February 1 following completion of audit report.

SB 5532: Relating to the financial administration of the Public Defense Services Commission; and declaring an emergency.

Appropriates moneys from General Fund to Public Defense Services Commission for certain biennial expenses. Limits biennial expenditures from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by commission. Appropriates moneys from General Fund to Emergency Board for allocation to commission. Declares emergency, effective July 1, 2019.

HB 2480: Relating to legal proceedings; and declaring an emergency.

Creates exception to prohibition on recording communications for person who records conversation during or regarding commission of offense against person. ] Creates exception to rule against hearsay for translation by qualified interpreter. ] Expands venue for trial of two or more offenses involving domestic violence or abuse between same defendant and victim. ] Requires defendant to give notice of intent to introduce evidence on issue of insanity at least 60 days before trial. ] Modifies provisions relating to prior convictions for felony sex crimes in other jurisdictions. ] Provides that, upon receipt of petition to initiate commitment proceedings of extremely dangerous person with mental illness, court shall order that person be held in custody pending evaluation and hearing. ] Provides that statement purporting to interpret otherwise admissible statement from one language into another does not constitute hearsay if declarant testifies. Declares emergency, effective on passage.
