SB 42: Relating to fish resource programs; and prescribing an effective date.

Eliminates sunset for funding dedicated to State Department of Fish and Wildlife fish restoration and enhancement program. Eliminates sunset on dedicating portion of certain angling license fee moneys for expenditure under program. Eliminates sunset on fee surcharges for certain trolling and gillnet permits imposed for expenditure under program. Eliminates sunset on additional fee for landing of certain fish species imposed for expenditure under program. Changes criteria for appointment of Restoration and Enhancement Board members. Changes meeting requirement for board. Eliminates sunset on Columbia River Fisheries Enhancement Fund. Extends State Fish and Wildlife Commission authority to charge for endorsements to certain Columbia River Basin fishing licenses and deposit endorsement moneys to fund. Extends youth license and pioneer license exemptions from endorsement charges. ] Takes effect on 91st day following adjournment sine die.

HB 2881: Relating to the per-mile road usage charge program; and prescribing an effective date.

Replaces vehicle weight rating with designation as passenger vehicle as qualification for per-mile road usage charge program. Removes cap on number of vehicles that may participate in program. Increases from 17 to 20 miles per gallon minimum rating required for program. Exempts vehicles with rating of 40 miles per gallon or more from additional registration fees. Requires payment of additional registration fees for exempt vehicle if owner ends voluntary participation in program. Changes per-mile road usage charge to five percent of rate of per-gallon gasoline license tax. Provides for reconciliation when amount of fuel taxes paid by person with respect to subject vehicle for reporting period is less than or exceeds per-mile road usage charge owing for such reporting period. Requires Department of Transportation to consult with vehicle dealers to determine how to encourage at point of sale participation in per-mile road usage charge program. Grants department general rulemaking authority for per-mile road usage charge program. Takes effect on 91st day following adjournment sine die.

SB 479: Relating to workplace harassment; and prescribing an effective date.

Requires public employers to adopt policies to prevent workplace harassment. Requires public employers to establish policies and procedures for addressing reports of workplace harassment. Requires employer to follow up with victim of reported harassment to determine whether harassment has stopped or if victim has experienced retaliation. Becomes operative January 1, 2020. Makes unlawful employment practice for employer to enter into certain agreements with employee that would prevent employee from disclosing or discussing conduct that constitutes workplace harassment. Provides that employer may, in certain circumstances, enter into settlement, separation or severance agreement that includes provision that would prohibit employee from disclosing or discussing such conduct or that would prohibit employee from seeking reemployment with employer as term or condition of agreement. Allows civil and administrative remedies for violation against unlawful practice. Becomes operative October 1, 2020. Extends timeline for filing complaint with Commissioner of Bureau of Labor and Industries alleging certain unlawful employment practices. Extends statute of limitations from one year to five years to file civil action for certain violations of law. Provides that extended statute of limitations applies to certain conduct that occurs on or after effective date of Act. Requires commissioner to adopt any rules necessary to implement certain provisions no later than 90 days after effective date of Act. Takes effect on 91st day following adjournment sine die.

HB 3138: Relating to transient lodging taxation; and prescribing an effective date.

Provides that exemption from transient lodging taxation for dwelling unit used by members of general public for temporary human occupancy for fewer than 30 days per year does not apply to dwelling unit rented out as transient lodging using platform of any kind provided in any manner by transient lodging intermediary. Takes effect on 91st day following adjournment sine die.

HB 3201: Relating to deferred resolution of criminal charges; and declaring an emergency.

Provides that agreement for deferred resolution of criminal cases ] conditional discharge for controlled substance offenses may not contain requirement that defendant enter plea of guilty or no contest. Applies to diversion offered by district attorney, conditional discharge for controlled substance offenses and diversion for driving while under the influence of intoxicants. ] Requires that agreement contain waiver of rights by defendant. Provides that agreement does not constitute admission of guilt and is not sufficient to warrant finding of guilty by court. Authorizes court to find defendant guilty of offense based on waiver of rights if defendant violates agreement. Declares emergency, effective on passage.

HB 3152: Relating to the protected dealer data of motor vehicle dealers.

Prohibits authorized integrator, unless authorized integrator is acting in accordance with federal, state or local government law or under valid court order, from obtaining, sharing, selling, copying, transmitting, using, producing, generating or providing protected dealer data without dealer's prior express written consent or in manner that is inconsistent with dealer's prior express written consent and from locking out, deactivating or denying dealer access to dealer data system, permitting another person to obtain, share, sell, copy, transmit, use, produce, generate or provide protected dealer data without dealer's prior express written consent or charging fee for or otherwise prohibiting, preventing, restricting or limiting dealer's ownership, possession or use of protected dealer data. ] Permits dealer management system provider to condition dealer's or authorized integrator's access to and ability to receive, share, copy, use, write or transmit protected dealer data from or to dealer data system on dealer's or authorized integrator's compliance with security standards, require authorized integrator to have express written authorization from dealer before allowing authorized integrator to gain access to, receive, share, copy, use or transmit protected dealer data and deny access to dealer data system if dealer fails to pay amount due to dealer management system provider under lease, contract or other agreement. Prohibits dealer management system provider from taking action to limit or prohibit dealer's or authorized integrator's ability to receive, protect, store, copy, share or use protected dealer data, including by imposing access fee or certain other restrictions on dealer or authorized integrator. Requires authorized integrator to obtain express written authorization from dealer and to comply with security standards before gaining access to, receiving, sharing, copying, using, writing or transmitting protected dealer data. Permits dealer to withdraw, revoke or amend prior express written consent ] authorization at dealer's discretion after giving 30 days' prior notice or immediately for good cause.

HB 3431: Relating to vending facilities on public property; and declaring an emergency.

Limits definition of "public building" or "property" to exclude convention or exposition centers, zoos, performing arts centers or other venues or attractions dedicated to tourism, travel, hospitality or entertainment for purposes of management by persons who are blind. ] Excludes vending facilities located at visitor venues from requirement that state grant to persons who are blind priority to operate vending facilities in public buildings. Requires state to grant to persons who are blind priority to operate vending machines located at visitor venues. Excludes cafeterias located at visitor venues from requirement that state grant to persons who are blind preference to operate cafeterias in public buildings. Declares emergency, effective on passage.

SB 421: Relating to reimbursements for benefits paid to persons injured in motor vehicle accidents; and prescribing an effective date.

Prohibits insurer from receiving reimbursement or subrogation for personal injury protection benefits or health benefits insurer provided to person injured in motor vehicle accident from any recovery injured person obtains in action for damages except to extent that injured person first receives full compensation for injured person's injuries and reimbursement or subrogation is paid only from total amount of recovery in excess of amount that fully compensates for injured person's injuries. Defines "total amount of the recovery." Specifies presumptions that apply to determination of when injured person receives full compensation for injured person's injuries. Prohibits person with whom injured person enters into settlement or from whom injured person obtains judgment in connection with claim or action from naming insurer that seeks reimbursement or subrogation as payee on check, draft or other form of payment in satisfaction of claim or judgment. Specifies additional duties of insurer and prohibitions on certain of insurer's actions. Becomes operative on January 1, 2020. Takes effect on 91st day following adjournment sine die.

HB 5002: Relating to the financial administration of the State Department of Agriculture; and declaring an emergency.

Appropriates moneys from General Fund to State Department of Agriculture for certain biennial expenses. Limits certain biennial expenditures from fees, moneys or other revenues, including Miscellaneous Receipts and certain federal funds, but excluding lottery funds and other federal funds, collected or received by department. Limits biennial expenditures by department from lottery moneys. Limits biennial expenditures by department from federal funds. Declares emergency, effective July 1, 2019.

HB 3309: Relating to the State Department of Geology and Mineral Industries.

Directs State Department of Geology and Mineral Industries to study and make recommendations on provisions of state law related to geological and mineral resources of state. Requires department to submit report on findings to Legislative Assembly by January 1, 2021. ] Amends definition of "surface mining" to exclude certain excavation and grading activities. Removes State Department of Geology and Mineral Industries' authority to prohibit certain construction within tsunami inundation zone.

HB 2402: Relating to aviation fuel; and prescribing an effective date.

Increases aviation fuel taxes increased by House Bill 2075 (chapter 700, Oregon Laws 2015), and makes increases and distributions of increased revenue permanent. ] Modifies rulemaking authority of Oregon Department of Aviation, considerations for reviewing applications for distributions and priority in making certain distributions under section 7, chapter 700, Oregon Laws 2015.
