Appropriates moneys from General Fund to Water Resources Department for biennial expenses. Limits biennial expenditures by department from certain lottery moneys. Limits biennial expenditures for certain purposes from fees, moneys or other revenues, including Miscellaneous Receipts and specified federal funds, but excluding lottery funds and other federal funds, collected or received by department. Limits biennial expenditures by department from other federal funds. Declares emergency, effective July 1, 2019.
Declares purpose of Critical Incident Review Teams. Defines "critical incident." Directs Department of Human Services to assign team within seven ] 10 days after department becomes aware of critical incident. Modifies membership of team. Directs department to publish certain information regarding teams on department's website. Modifies deadlines by which department shall publish team report. Modifies report requirements. Provides that statements in final report or document created during critical incident review process are inadmissible in civil or administrative proceedings. Declares emergency, effective on passage.
Authorizes qualified institutions to receive loans from Water Pollution Control Revolving Fund to finance projects to repair or replace failing on-site septic systems or to replace failing on-site septic systems with connections to available sewer. Becomes operative January 1, 2020. Declares emergency, effective on passage.
Requires hospitals to submit emergency department discharge abstract records to ] Oregon Health Authority or to ] entity contracting with authority to compile ] obtain discharge records from hospitals, ambulatory surgical centers and extended stay centers. Permits authority to charge fee to ambulatory surgical centers to cover cost of abstracting and compiling records. Permits authority to require health maintenance organizations to submit ambulatory surgery, inpatient and emergency department discharge records. Requires authority to notify hospitals and ambulatory surgical centers ] entities submitting data of changes to data sets of discharge records that must be submitted, ] no later than July 1 of calendar year preceding effective date of changes.
Transfers from Department of Human Services to Oregon Community Foundation responsibility for administering Fairview housing trust. Transfers unexpended balance of moneys in Community Housing Trust Account to Oregon Community Foundation for purpose of providing housing to individuals with intellectual disabilities or other developmental disabilities or providing financial assistance to housing or care providers that provide community housing to individuals with intellectual disabilities or other developmental disabilities . Requires Oregon Council on Developmental Disabilities to appoint advisory committee to advise and consult with Oregon Community Foundation in making expenditures of moneys transferred to foundation from Community Housing Trust Account. Requires Oregon Community Foundation to annually report to department balance remaining of moneys transferred and uses for expenditures of funds. Requires foundation to repay to department moneys used for unauthorized purpose.
Limits actions of persons that take clams for commercial purposes. ] Requires State Department of Fish and Wildlife to limit take of clams for commercial purposes. ] Requires State Department of Fish and Wildlife to annually assess take of clams for commercial purposes in Oregon and produce certain surveys of clam populations every six years. ] Establishes permit fees for resident and nonresident permits to take clams for commercial purposes. ] Requires State Department of Fish and Wildlife to produce survey of bay clam populations in priority areas of Tillamook Bay. Requires department to establish and appoint Tillamook Bay Clam Advisory Committee. Specifies advisory committee duties. Provides time lines for appointment and initial meeting of advisory committee. Requires department to report to interim committee of Legislative Assembly on or before December 31, 2022, regarding advisory committee recommendations.
Modifies oil spill prevention fees. Applies to fees assessed on or after effective date. Takes effect on 91st day following adjournment sine die.
Authorizes court to award prevailing retail customers, who bring actions against vehicle dealers relating to vehicle registration or vehicle titling, attorney fees under certain circumstances. ] Provides that retail customer may bring individual action against vehicle dealer that fails to comply with certain requirements related to transfer of interest in vehicle. Allows for award of attorney fees in action under certain circumstances.
Requires public universities, community colleges and community college districts ] certain institutions of higher education to require contractors to employ apprentices and to establish and execute plan for outreach, recruitment and retention of women and minority individuals for certain work relating to improvements to real property. Provides that requirements do not apply if institution of higher education determines that compliance with requirements would cause unreasonable expense or delay or reduce pool of bidders to fewer than three.
Modifies procedures related to criminal defendants lacking fitness to proceed. Provides that when defendant is committed to state mental hospital or other facility for examination on issue of fitness to proceed, examination may include period of observation. Provides that committed defendant be transported to hospital or facility for examination, after which superintendent of hospital or director of facility may return defendant to facility from which defendant was transported, or inform court and parties that defendant requires hospital level of care and request that defendant remain at facility pending fitness to proceed order. Authorizes report concerning defendant's fitness to proceed to be provided to community mental health program director of county in which defendant is charged and county of defendant's last known residence. Restricts availability and use of report. Authorizes court to enter order concerning fitness to proceed, without hearing, based on report from examination if both parties consent. Requires court to receive and consider certain input from community mental health program director or director's designee, and any entity responsible for supervising defendant upon release, after court finds defendant lacks fitness to proceed. Directs court and parties to at hearing determine appropriate action in case. Directs court to consider certain criteria and enter order necessary to implement action. Requires court to make three specified findings before committing defendant to state mental hospital or other facility. Requires review hearing after 14 ] every seven days for certain defendants not requiring ] lacking fitness to proceed who do not require hospital level of care and who remain in custody following fitness determination . Modifies procedures when court receives notice that committed defendant is no longer danger to self or others , that defendant no longer requires hospital level of care, or that resources to treat defendant are available in community. Requires review hearing every seven days when court terminates commitment but defendant remains in custody. Prohibits court from committing defendant lacking fitness to proceed to state mental hospital or other facility when defendant charged only with violation offenses. Restricts circumstances in which court may commit defendant lacking fitness to proceed to state mental hospital or other facility when defendant is ] charged only with misdemeanor or violation ] misdemeanor offenses . Provides that defendant committed for treatment to restore fitness to proceed receive credit for time served in jail both before and after commitment. Authorizes treatment, as permitted by law, when defendant committed for purposes of conducting examination on issue of mental defense. Restricts availability and use of report resulting from examination. Declares emergency, effective on passage.
