HB 5006: Relating to state financial administration; and declaring an emergency.

Limits for six-year period beginning July 1, 2019, payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by various state agencies for capital construction. Limits expenditures from federal funds collected or received by various state agencies for capital construction for six-year period beginning July 1, 2019. Limits for six-year period beginning July 1, 2019, payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by Higher Education Coordinating Commission for expenditures of bond proceeds for benefit of public universities and community colleges. Sets expiration date on project approvals and expenditure limitations. Extends expiration dates for certain projects. Modifies expenditure limit for six-year period beginning July 1, 2017, for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts and certain federal funds, but excluding lottery funds and other federal funds, collected or received by Higher Education Coordinating Commission for expenditures of bond proceeds for benefit of public universities. Declares emergency, effective July 1, 2019.

SB 1008: Relating to juvenile offender sentencing; prescribing an effective date; and providing for criminal sentence reduction that requires approval by a two-thirds majority.

Requires court to include in judgment document age of defendant at time of committing offense if defendant is sentenced to term of incarceration and physical custody of defendant is related to age of defendant at time of committing offense. Directs Department of Corrections to transfer person sentenced to term of incarceration for offense committed when person was under 18 years of age to physical custody of Oregon Youth Authority even if criminal proceedings were initiated after person attained 18 years of age. Eliminates mandatory adult prosecution for certain offenses committed when person charged is 15, 16 or 17 years of age at time of offense. Requires juvenile court, upon filing by state of motion requesting waiver hearing, to hold hearing to determine whether person should be prosecuted as adult. Authorizes juvenile offender charged with offense subject to mandatory minimum sentence, who receives mandatory minimum sentence or other sentence of imprisonment, to be eligible for conditional release hearing after serving at least one-half of sentence imposed. Provides that person in custody of Oregon Youth Authority for offense committed while person was under 18 years of age, for which person was sentenced to term of imprisonment with projected release date that falls after person attains 25 years of age but before person attains 27 years of age, is eligible for conditional release hearing. Prohibits person who was under 18 years of age at time of committing offense from being sentenced to life imprisonment without possibility of release or parole. Requires court to consider certain factors when sentencing person who was under 18 years of age at time of committing offense. Prohibits court from considering age as aggravating factor. Directs court to include in judgment document fact that person is eligible for hearing and release after serving 15 years of sentence of imprisonment. Establishes process for hearing with State Board of Parole and Post-Prison Supervision for persons who were under 18 years of age at time of committing offense and who have served 15 years of sentence of imprisonment. Authorizes release of person on parole or post-prison supervision if certain findings are made. Directs Department of Justice to adopt model policies for providing victim notification concerning conditional release and waiver hearings. Directs district attorney victim assistance programs to provide notice to victims in accordance with model policies. Takes effect on 91st day following adjournment sine die.

SB 155: Relating to interpersonal boundary invasions affecting youth; and declaring an emergency.

Requires investigations of all reports involving suspected abuse or suspected sexual conduct by school employees, contractors, agents and volunteers. Establishes requirements for law enforcement agencies and Department of Human Services to conduct investigations related to reports of abuse that involve child and person who is school employee, contractor, agent or volunteer. Establishes requirements for Teacher Standards and Practices Commission to conduct investigations related to reports of suspected sexual conduct that may have been committed by school employee, contractor, agent or volunteer who is licensed by commission. Establishes requirements for Department of Education to conduct investigations related to reports of suspected sexual conduct that may have been committed by school employee, contractor, agent or volunteer who is not licensed by commission. Allows education provider to use findings of agencies when making employment determinations. Prescribes timelines for completing investigations and making employment determinations. Revises definitions of terms of "education provider," "sexual conduct" and "student" for purposes of certain laws related to abuse and sexual conduct by school employees, contractors, agents and volunteers. Prohibits individual who is school employee, contractor or agent from assisting other school employee, contractor or agent in obtaining new job if individual knows or has probable cause to believe school employee, contractor or agent engaged in abuse or sexual contact with student. Provides exceptions. Allows commission to discipline individual for any violations of prohibition. Prohibits certain agreements or contracts that have effect of terminating or impairing ongoing investigations or of suppressing information relating to substantiated report of abuse or sexual conduct. Directs Department of Human Services and law enforcement agencies that receive report of child abuse to notify Department of Education if alleged child abuse occurred in school or was related to school-sponsored activity. Declares emergency, effective July 1, 2019.

SB 431: Relating to urban flood safety and water quality districts; and prescribing an effective date.

Creates urban flood safety and water quality district in portion of Multnomah County within urban growth boundary adopted by Metro, for purposes of acquiring, purchasing, constructing, improving, operating and maintaining infrastructure in order to provide for flood safety and contribute to water quality, floodplain restoration and habitat and landscape resilience. Provides for selection of board of directors. Sets forth powers and duties of district and district board. Authorizes district board to impose charges, assessments and taxes and issue bonds. Authorizes district board to dissolve certain drainage districts and water improvement corporations. Requires urban flood safety and water quality district to assume dissolved entity's duties, assets and liabilities. Takes effect on 91st day following adjournment sine die.

SB 769: Relating to the administration of fees in lieu of property taxes assessed against solar projects; and prescribing an effective date.

Provides that request for computation of fee in lieu of property taxes for property constituting solar project may not be filed after April 1 immediately preceding property tax year to which request relates. ] Requires owner or person in possession or control of solar project to file, on or before December 31 preceding first property tax year to which agreement with county for payment of fee in lieu of property taxes on solar project property relates, nameplate capacity of project and copy of agreement with county assessor and Department of Revenue. Requires annual filing thereafter, by owner or person in possession or control of solar project, of nameplate capacity with central assessment statement. Requires department, when certifying central assessment roll, to provide nameplate capacity of each solar project to respective county assessor. Requires county assessor to place all fees in lieu of property taxes upon tax roll for distribution pursuant to percentage schedule. Takes effect on 91st day following adjournment sine die.

SB 994: Relating to juveniles.

Requires person who has taken child into custody to request, prior to releasing child to custody of child's noncustodial parent, Department of Human Services to conduct criminal records check on noncustodial parent and all adults in same home as noncustodial parent.

SB 770: Relating to statewide health care coverage; and declaring an emergency.

Establishes Task Force on Universal Health Care Commission ] charged with recommending to Legislative Assembly design of Health Care for All Oregon Plan, administered by Health Care for All Oregon Board to provide publicly funded, equitable, affordable, comprehensive and high quality health care to all Oregon residents. Specifies membership and duties of commission ] task force . Requires recommendations to be guided by specified values and principles. Prescribes requirements for plan design and items that commission ] task force must consider. Requires commission to first meet by November 1, 2019, and provide first report to interim committees of Legislative Assembly related to health by March 15, 2020. Requires commission ] members of task force to be appointed by May 31, 2020, and task force to submit to 2021 regular session of Legislative Assembly final recommendations by February 1, 2021, or report on work that remains to be completed ] for design of Health Care for All Oregon Plan and Health Care for All Oregon Board . Requires Oregon Health Authority to develop plan for Medicaid Buy-In program. Specifies elements that must be included in plan, to extent feasible. Requires authority to provide report to Legislative Assembly, no later than May 1, 2020, containing discussion of potential eligibility requirements for Medicaid Buy-In program or public option, options for targeting specified groups, recommendations for legislative changes necessary to implement plan and any federal approval that would be required to implement plan. Declares emergency, effective on passage.

SB 688: Relating to professional authorizations.

Directs professional licensing board to annually report to interim committee of Legislative Assembly related to veterans information about temporary authorizations to practice occupational or professional service for spouses or domestic partners of members of Armed Forces of United States who are stationed in this state. Requires professional licensing board to issue temporary authorization to qualified individual.

SB 1: Relating to youth with specialized needs.

Establishes System of Care Advisory Council to provide forum for statewide system of care policy development and planning. Directs council to develop and maintain state system of care policy and comprehensive, long-range plan for coordinated system of care. Directs council to update plan biennially and submit plan to interim committee of Legislative Assembly and Governor. Directs council to make annual reports and recommend legislation to interim committee of Legislative Assembly and Governor. Directs council to make recommendations to Director of Oregon Health Authority, Director of Oregon Youth Authority and Director of Human Services regarding systems of care. Authorizes ] Directs council to award grants to support local system of care governance and carry out recommendations in council's long-range plan for coordinated system of care. Directs council to create Children's System Data Dashboard regarding youths being served by Oregon Youth Authority, Oregon Health Authority and Department of Human Services. Appropriates moneys from General Fund to council for biennial expenses related to council. ] Authorizes Department of Human Services, Oregon Health Authority and Oregon Youth Authority to contract with providers to establish interdisciplinary assessment teams to provide services to youth.
