SB 1524: Relating to taxation; and prescribing an effective date.

Modifies provisions of tax laws. Increases expense reimbursement percentage allowed to single film or single local media production project from Oregon Production Investment Fund. Applies to fiscal years beginning on or after July 1, 2022. Extends availability of income tax credit for rural medical providers to certain medical laboratory scientists and medical laboratory technicians. Applies to tax years beginning on or after January 1, 2022. ] For purposes of pass-through business alternative income tax, provides for add-back amounts to be treated as qualifying income and taxed at elective reduced rate, and directs Department of Revenue to require estimated payments. Provides for penalty relief if either pass-through entity or its members make sufficient estimated payments. Applies to tax years beginning on or after January 1, 2022, and before January 1, 2024, and to estimated payments due on and after June 15, 2022. Increases limit on Multistate Tax Commission Revolving Account. Lowers income threshold for occupants for property tax exemptions that county may adopt for newly constructed single-family dwelling. Exempts, from commercial activity subject to corporate activity tax, receipts of certain pharmacies from sale of prescription drugs. Applies to tax years beginning on or after January 1, 2022, and before January 1, 2026. Extends sunset for shared services distributions. Allows taxpayer primarily doing business in agricultural sector to use three-year net operating loss carryback. Applies to tax years beginning on or after January 1, 2023, and before January 1, 2029, and to any tax year to which net operating loss arising in those tax years is carried back. Becomes operative only if all sections of chapter ___, Oregon Laws 2022 (Enrolled House Bill 4002), become law before January 1, 2023. Requires Department of Revenue to waive penalty or interest due to underpayment or underreporting resulting from authorization of required estimated payments of pass-through business alternative income tax. Takes effect on 91st day following adjournment sine die.

HB 4034: Relating to health care; and declaring an emergency.

Deletes requirement that coordinated care organization collect specified data from members and submit data to Oregon Health Authority. Allows authority to make certain releases of data. ] Allows pharmacy intern to transfer drug containing pseudoephedrine or ephedrine to person 18 years of age or older without prescription. Allows pharmacist, pharmacy technician or intern to swipe person's driver license for purpose of transferring drug containing pseudoephedrine or ephedrine without prescription. Extends sunset on provisions regulating sharing of COVID-19 data to one year after date on which state of emergency declared by Governor on March 8, 2020, for COVID-19 pandemic, and any extension of state of emergency, is no longer in effect. Extends requirements related to biological products to January 1, 2026. Authorizes Oregon Health Authority to implement reproductive health services and education programs. Allows physicians and physician assistants to use telemedicine. Defines "telemedicine." Prohibits Oregon Medical Board from establishing standards for telemedicine that are stricter than standards for in-person delivery of health care services. ] Allows pharmacist, pharmacy technician or intern to access pharmacy's electronic database from inside pharmacy or remotely. Prohibits State Board of Pharmacy from establishing standards for telepharmacy that are stricter than standards for in-person delivery of pharmacy services. Allows authority to select up to 10 school districts or education service districts to receive specified grants relating to school-based health centers. Directs authority to award up to four grants to school districts or education service districts for mobile school-linked health centers. Allows pharmacist to delegate and pharmacy technician to perform final verification of prescription. Defines "final verification." Declares emergency, effective on passage.

HB 4010: Relating to kratom; and prescribing an effective date.

Prohibits sale of kratom products by processor unless processor is registered with Department of Revenue. Directs department to adopt rules to carry out regulations. Authorizes imposition of civil penalty for certain violations. Creates crime of unlawful distribution, sale or exposure for sale to individual under 21 years of age. Punishes by maximum of 30 days' imprisonment, $1,250 fine, or both. Appropriates moneys from General Fund to Department of Revenue for carrying out provisions of Act. Takes effect on 91st day following adjournment sine die.

HB 4153: Relating to the promotion of media industries in Oregon; and declaring an emergency.

Directs Oregon Film and Video Office to establish Creative Opportunity Program to promote film, television, interactive, animation and media industries in Oregon. Dedicates two percent of moneys in Oregon Production Investment Fund to making payments to media industry entities for creation and funding of projects under program. Declares emergency, effective on passage.

SB 1567: Relating to energy infrastructure resilience; and prescribing an effective date.

Requires owners or operators of bulk oils and liquid fuels terminals located in Columbia, Multnomah or Lane County to conduct and submit to Department of Environmental Quality seismic vulnerability assessments. Requires department to review and approve seismic vulnerability assessments. Requires owner or operator of existing bulk oils or liquid fuels terminal to submit seismic vulnerability assessment by June 1, 2024. Requires department to submit report on seismic vulnerability assessments and make recommendations on expansion of program to interim committees of Legislative Assembly by November 1, 2024. Requires owner or operator of bulk oils or liquid fuels terminal to properly implement seismic risk mitigation implementation plan approved by department. Directs Environmental Quality Commission to, by rule, adopt seismic risk mitigation implementation program for bulk oils or liquid fuels terminals. Prohibits owner or operator of bulk oils or liquid fuels terminal from retaliating against employee who provides information regarding violation of law or safety risks. Establishes Seismic Risk Mitigation Fund. Requires State Department of Energy to develop energy security plan by June 1, 2024, and provide report on implementation or revision of plan to interim committees of Legislative Assembly by September 15 of each even-numbered year. Takes effect on 91st day following adjournment sine die.

HB 4095: Relating to veterans; and prescribing an effective date.

Establishes Veterans Dental Program in Oregon Health Authority to provide oral health care to low-income veterans who reside in Oregon beginning in 2023. Specifies eligibility requirements for program. Provides that character of discharge does not affect eligibility. Directs Department of Veterans' Affairs to create criteria for waiver to eligibility requirement that veteran be discharged or released under honorable conditions when discharge or release is result of discriminatory policies or practices. Authorizes county or tribal veterans' service officer to grant waiver in accordance with department criteria. ] Takes effect on 91st day following adjournment sine die.

HB 4134: Relating to insurance; and declaring an emergency.

Requires insurer and health care service contractor to cover labor and delivery services provided at out-of-network health care facility , and medical transport of individual presenting with signs of labor from in-network facility to out-of-network facility, if services provided at out-of-network facility due solely to diversion of patient from in-network health care facility for reasons related to state or federal declaration of public health emergency. Prescribes rate of reimbursement and prohibits deductible, out-of-pocket maximum, copayment or coinsurance requirement in excess of such requirements applicable to in-network providers. Exempts Public Employees' Benefit Board and Oregon Educators Benefit Board. Requires health benefit plan coverage of emergency medical services transport of pregnant woman presenting with signs of labor between medical facilities. ] Declares emergency, effective on passage.

HB 4096: Relating to volunteer health care practitioners; and prescribing an effective date.

Authorizes health care practitioner authorized in another state or United States territory to practice in this state without compensation for specified number of days without obtaining licensure in this state. Defines "health care practitioner." Requires health care practitioner to submit specified information to health professional regulatory board , including proof that health care practitioner is in good standing in all jurisdictions in which health care practitioner is authorized to practice . Exempts health care practitioner from licensure requirements of this state. Prohibits hospital or other health care facility from using services of health care practitioner to meet staffing needs during labor dispute. Takes effect on 91st day following adjournment sine die.

SB 1560: Relating to noncitizens.

Updates statutory references to individual who is not citizen or national of United States to replace "alien" with "noncitizen." Directs state agencies to use "noncitizen" in rules and regulations to reference individual who is not citizen or national of United States and to update rules and regulations that use "alien" to use "noncitizen." Authorizes agencies to amend rule without prior notice or hearing for purpose of changing term or phrase in order to conform with change made by law. Makes nonsubstantive changes.
