What changed between versions
The definition of 'Employee' was updated to explicitly include persons who 'immediately manage, direct, supervise, or control' the sale of alcohol, broadening the scope of who counts as an employee for liability purposes.
A new rebuttable presumption was added: if an employee performs a prohibited act three or more times within a twelve-month period, it is presumed the establishment indirectly encouraged the violations, shifting the burden of proof to the establishment.
A new subsection clarifies that if an employee does not possess a valid license, their actions are automatically attributable to the establishment, removing any potential defense based on the employee's lack of credentials.
Requirements for the affirmative defense were tightened; establishments must now provide an affidavit within ten days of a violation notice and may be required to present additional evidence at hearings to prove compliance.
The effective date for the act was set to November 1, 2025, and the bill includes a codification section specifying where the new laws will appear in the Oklahoma Statutes.
