HB 3212 allows Oklahoma distillers with valid licenses to serve free samples of their spirits at public events like trade shows and festivals, in addition to their licensed premises. It limits samples to 3 fluid ounces per visitor per day within a designated area, requires a floor plan on file with the ABLE Commission, and prohibits minors from entering sampling zones. The bill imposes a combined annual limit of 15,000 gallons for all on-premise sales, off-premise sales, and public event samples by a distiller. Samples served under this provision are not considered sales for tax purposes but still count toward excise tax reporting requirements. The bill takes effect November 1, 2026.
