Closing the Law Enforcement Consent Loophole Act of 2021 This bill establishes a framework to prohibit law enforcement officers at the federal, state, and local levels from engaging in sexual acts with individuals who are in custody. At the federal level, the bill makes it unlawful for a federal law enforcement officer who is acting under color of law to engage in a sexual act with an individual who is under arrest, in detention, or in custody. Consent is not a defense to prosecution for unlawful conduct. A violator is subject to criminal penalties—a fine, a prison term of up to 15 years, or both. At the state and local level, the bill conditions eligibility for funds under the Community Oriented Policing Services program on the enactment of a similar law.
Jaime Zapata and Victor Avila Federal Law Enforcement Protection Act This bill explicitly grants extraterritorial jurisdiction over criminal conduct involving the killing (or attempted killing) of a federal officer or employee. The United States may prosecute such conduct that occurs outside the United States.
Criminalize Fleeing from Immigration Enforcement Act of 2021 This bill revises the federal criminal offense involving flight from an immigration checkpoint or other law enforcement checkpoint at high speed in a motor vehicle. Specifically, the bill retains the existing prohibition on flight from an immigration or other law enforcement checkpoint, but it removes the qualifier that such flight must be at high speed in a motor vehicle. The bill also expands the scope of unlawful flight offenses to include flight from a law enforcement officer who is enforcing immigration laws. An unlawful flight offense is generally punishable by a fine, a prison term of up to five years, or both. However, an unlawful flight offense that involves high-speed flight in a motor vehicle is punishable by a fine, prison term of up to eight years, or both.
Common-Sense Census Act of 2021 This bill provides for the collection of citizenship status information for the population of the United States. Specifically, the bill directs the Census Bureau to collect statistics on the citizenship status of persons permanently residing in the United States. Further, beginning with the questionnaire for the 2020 decennial census and thereafter, the Census Bureau must include a checkbox or other similar option for the respondent to indicate whether such individual, and each member of that individual's household, is a U.S. citizen or national. Additionally, the Department of Commerce must establish the Citizenship Data Interagency Working Group to develop and submit recommendations to maximize the percentage of the U.S. population about which Commerce has citizenship status information.
Help Extract Animals from Red Tape Act of 2021 or the HEART Act of 2021 This bill modifies notice requirements in a civil forfeiture proceeding that involves the seizure of an animal involved in animal fighting. Specifically, the government must notify interested parties of an animal's seizure within 30 days (currently, 60 days). The notice period may be extended only if a delay is warranted after considering certain factors, including the cost to the government of providing shelter for the animal, the health of the animal and the effect of a delay on its rehabilitation, any increased risk that a delay could necessitate the euthanasia of the animal, and any psychological harm incurred by the animal's owner due to the delay in disposition. Additionally, the bill authorizes amounts in the Department of Justice Assets Forfeiture Fund to be used to pay for costs associated with a seized animal, including transportation, shelter, care, veterinary services, and humane euthanasia.
COVID-19 Border Protection (CBP) Act This bill requires the Department of Homeland Security (DHS) to devise and implement a strategy to ensure that no alien with COVID-19 (i.e., coronavirus disease 2019) in DHS or Department of Health and Human Services custody may be released into the community during a public health emergency related to COVID-19. Funds previously provided to the Department of State for supporting international efforts to help migrants and refugees respond to COVID-19 shall be transferred to DHS to implement this strategy.
Energy Security Cooperation with Allied Partners in Europe Act of 2021 This bill establishes requirements related to U.S. international energy strategy. Applications to export natural gas to North Atlantic Treaty Organization (NATO) member countries, Japan, and certain other countries shall be granted on an expedited basis without modification or delay. The President shall impose sanctions on a person that provides certain equipment, investment, or services to the Russian government or related entities for constructing or servicing Russian energy export pipelines. The Department of State shall report to Congress on a strategy to enhance the energy security of NATO member countries and increase exports of U.S. energy (and related technologies and services) to such countries.
Asylum Abuse Reduction Act This bill places restrictions on aliens seeking asylum and contains provisions related to immigration enforcement. Under this bill, an asylum seeker who arrives at a U.S. land port of entry without entry documents may not be admitted unless an asylum officer at a U.S. embassy or consulate has interviewed the alien and has concluded that the alien (1) has been persecuted in the alien's country of nationality due to their race, religion, or other characteristics; (2) has a credible fear of persecution if they returned to that country; or (3) would be tortured by the government upon return to that country. (Currently, an alien arriving at a port of entry may apply for asylum and an immigration officer there typically will give the alien a credible fear interview.) Furthermore, an alien who traveled through a third country to enter the United States through the southern border shall be ineligible for asylum unless (1) the alien has applied for and been denied asylum or protection in that third country, (2) the alien was a victim of severe human trafficking, or (3) the third country is not party to certain international agreements relating to refugees. Each federal judicial district shall appoint at least one judge to issue arrest warrants for individuals violating orders to depart, upon a showing of probable cause. Under this bill, the Flores agreement (a lawsuit settlement which imposes various requirements relating to the treatment of alien minors detained for immigration-related purposes) shall not apply.
Bolstering Infectious Outbreaks Preparedness Workforce Act of 2021 or the BIO Preparedness Workforce Act of 2021 This bill establishes a student loan repayment program for health care and related professionals who are engaged in either bio-preparedness and response activities or infectious disease care in underserved communities. For each year that a professional meets the work requirements of the program, the Health Resources and Services Administration may pay up to $50,000 of the professional's student loan principal and interest, up to a maximum amount of $150,000.
Public Safety and Wildlife Protection Act This bill bans steel-jaw leghold traps and Conibear traps and establishes penalties for violating this ban. Steel-jaw leghold traps are certain spring-powered devices with steel jaws that are designed to snap closed on animals. Conibear traps consist of metal frames hinged at the center point and powered by two torsion springs that create a scissor-like action designed to kill an animal by snapping its spine. Cage traps, box traps, suitcase-type live beaver traps, and mouse or rat snap traps are not included in the ban. The Department of the Interior must pay a reward for information that leads to a conviction of a violation of this bill, unless the information was provided by on duty officers or employees of federal, state, or local governments. The reward must be 50% of the penalty paid.
PrEP Assistance Program Act This bill establishes a grant program to provide pre-exposure prophylaxis (PrEP) and related services to individuals at no cost. PrEP is medication given to individuals at risk of HIV to reduce their likelihood of contracting the virus. The Department of Health and Human Services must award the grants to state, tribal, and local governments; certain health clinics; and community-based organizations.
Cybersecurity Opportunity Act This bill requires the Department of Homeland Security to establish a grant program to promote cybersecurity training and education at institutions of higher education with an enrollment of needy students, historically Black colleges and universities, and minority-serving institutions.
