Enacts the "New York fundamental artificial intelligence requirements in (FAIR) news act"; provides transparency requirements for news media content composed, authored, or otherwise created through generative AI.
This bill restricts the use of smart access systems in multiple dwellings by prohibiting the collection and use of biometric data, such as fingerprints or facial scans, for entry purposes. It requires that all tenants and lawful occupants receive physical or digital keys at no cost and mandates that owners provide a non-electronic entry method upon request for religious reasons. Additionally, the legislation limits the number of free keys available for guests and employees while requiring owners to establish clear policies explaining how these systems operate and are managed.
Places a one year moratorium on the issuance of data center permits; requires utilities to establish an independent classification of service for large data centers; sets energy efficiency goals for data centers; provides for benefits for host communities; sets labor standards for the construction of data centers.
Prohibits electric scooter service platforms operating a digital network from operating electric scooters in this state unless such platform displays a warning that persons under 18 years of age are not allowed to operate electric scooters through the platform; imposes a penalty for violations.
Requires the consumer protection division to promulgate a policy governing the use of automatic license plate reader systems by non-law enforcement agencies and non-government entities; requires such non-law enforcement agencies and non-government entities to conspicuously post such policy on their website or in their place of business.
Prohibits motor vehicle manufacturers and dealers from charging a subscription fee for certain functions of a motor vehicle after the vehicle is sold; provides that any manufacturer, dealer, or agent of a manufacturer or dealer that fails to comply with such requirements shall be assessed a civil penalty not to exceed two hundred fifty dollars per point of sale for each violation.
Relates to certain procedural protections granted to third-party sellers and seller profiles of online marketplaces; provides that online marketplaces must provide notice and an opportunity to respond before a seller or profile is suspended; provides that a suspended third-party seller or seller profile shall have the right to appeal the determination of the online marketplace in seeking account reinstatement.
Provides for the protection of health information; establishes requirements for communications to individuals about their health information; requires either written consent or a designated necessary purpose for the processing of an individual's health information.
Establishes the NY digital choice act requiring social media companies to provide covered users with a copy of the covered user's social graph at the request of the covered user; defines terms; provides requirements for the interoperability of covered users' data; grants the attorney general the authority to promulgate rules and regulations and enforce such provisions.
Requires covered businesses to annually report to the department of labor regarding the impact of artificial intelligence on hiring and the nature of artificial intelligence use for the previous year; requires the department of labor to file an annual report on the impact of artificial intelligence on hiring and the nature of artificial intelligence use in the state; establishes penalties for covered business that fail to submit such reports.
