New York Bills

This bill exempts New York City from state regulations governing frozen desserts by adding a specific provision to the Agriculture and Markets Law. The key mechanism is a population threshold that removes cities with one million or more residents from the rules outlined in Article 4-A of the law. As a result, New York City would no longer be subject to the state's oversight on frozen dessert sales and distribution. The change takes effect immediately upon passage.

Requires the commissioner of health and the superintendent of insurance to develop standards for an electronic prior authorization program for the utilization review of health care services.

Directs the division of state police to establish and administer a purple alert program to assist in the location and safe recovery of missing vulnerable persons.

Prohibits certain employees with the state from using nonpublic information to gain advantage on prediction markets; establishes penalties for using nonpublic information on prediction markets.

Provides that any person, firm, association, corporation, campaign, committee, or organization found guilty of knowingly disseminating or publishing media without the consent of the person depicted and who knew or should have known that it was materially deceptive shall forfeit to the state board of elections a sum not exceeding ten thousand dollars for each and every offense and three times the total amount spent on creating and promoting the materially deceptive media.

Requires landlords of non-owner occupied, one-six family dwellings in the city of New York to provide fire extinguishers in all rented apartments; authorizes the promulgation of standards related thereto.

Regulates certain bounty websites which offer meme currency in exchange for completing tasks are consistent with New York state law; defines "meme currency"; authorizes the attorney general to ensure bounty websites are compliant with the law.

Requires the filling of elective positions be done publicly and transparently in open meetings after giving notice to the public; prohibits the use of executive sessions to fill elective positions.

Requires the department of agriculture and markets to maintain a publicly available database of the results of its graded inspections on its website; requires the department to provide information as to where a customer may file a consumer report; requires the department to facilitate and coordinate the planning and implementation of an awareness and educational program to inform the general public on the standards retail food stores shall meet and how consumers may report retail food stores with poor sanitary conditions.

Prohibits local laws from requiring certain storefront security gates or grilles comply with certain conditions; extends the provisions concerning existing storefront security gates or grilles.

Directs the commissioner of taxation and finance to help entities to elect to participate in the federal tax credit for elementary and secondary scholarships known as the Educational Choice for Children Act of 2025.

Establishes a state library of pre-approved residential construction plans which are in compliance with the uniform code and certified by climate region.
