relative to the sale of tobacco products, e-cigarettes, devices, e-liquids, or alternative nicotine products and relative to the licensure and sale of certain liquor products.

A new subsection is added to RSA 178:18 (combination licenses) stating that the fee for a combination license shall be as determined in RSA 178:29, II(b).

A new subsection is added to RSA 178:19 (retail wine licenses) stating that the fee for a retail wine license shall be as determined in RSA 178:29, II(a).

The scope of amendments to each section was expanded (e.g., RSA 178:18 from I-III to I-IV, RSA 178:19 from I-IV to I-V, RSA 178:19-d from I-VI to I-VII) to accommodate the new fee provisions.

The entire restaurant delivery license system was removed. The Senate version had created a $250/year restaurant delivery license allowing on-premises licensees to deliver alcohol with meals, including requirements for sealed containers, W-2 employees over 21, signed receipts, and restrictions on delivering to schools and parks.

A new fine is created for persons under 21 who violate laws related to use of tobacco products, e-cigarettes, devices, e-liquids, or alternative nicotine products.

Licensees found in possession of illegal, untaxed, or contraband tobacco products face an administrative fine equal to the amount of state tobacco tax that would have been due had the products been lawfully purchased and taxed.

Holders of retail tobacco licenses, tobacco product manufacturers, and tobacco product wholesalers are now required to report inventory, loss, purchases, and sales data to the liquor commission.

A new commission (RSA 175:12) is established to develop a regulatory framework for tincture products containing alcohol. This is an entirely new policy area not present in the introduced version.

The commission must develop requirements for licensing, testing, inspections, and auditing of alcoholic tincture products, and must identify existing federal or state laws regulating such products including age restrictions.
