Mainstreaming Addiction Treatment Act of 2021 This bill removes the requirement that a health care practitioner apply for a separate waiver through the Drug Enforcement Administration (DEA) to dispense certain narcotic drugs (e.g., buprenorphine) for maintenance or detoxification treatment (i.e., substance use disorder treatment). Further, a community health aide or community health practitioner may dispense certain narcotic drugs for maintenance or detoxification treatment without registering with the DEA if the drug is prescribed by a health care practitioner through telemedicine. It preempts state laws related to licensure for this activity. The bill also directs the Substance Abuse and Mental Health Services Administration to conduct a national campaign to educate health care practitioners and encourage them to integrate substance use disorder treatment into their practices.
Countering Chinese Propaganda Act This bill directs the President to impose asset- and visa-blocking sanctions on foreign individuals and entities engaged in certain acts of malign disinformation. Specifically, the President shall impose sanctions on an individual or entity that knowingly commits a significant act of malign disinformation on behalf of a foreign government or political party to influence certain activities in the United States for the purpose of harming (1) U.S. national security, or (2) the safety and security of a U.S. citizen or legal permanent resident. The Department of State shall report to Congress a determination of whether the Chinese Communist Party's United Front Work Department, which engages in disinformation campaigns and other activities, or any of its officials, falls within the sanctions provided under this bill.
Return Excessive Migrants and Asylees to International Neighbors in Mexico Act of 2021 or the REMAIN in Mexico Act of 2021 This bill requires the Department of Homeland Security (DHS) to implement the Migrant Protection Protocols as outlined in the January 25, 2019, memo titled Policy Guidance for Implementation of the Migrant Protection Protocols . (The protocols generally required aliens who are not clearly admissible, including those seeking asylum, arriving by land along the U.S.-Mexico border to be returned to Mexico while their immigration proceedings are pending, rather than remain in the United States. On January 21, 2021, DHS stopped applying the protocols to newly-arrived individuals.)
Eliminate Network Distribution of Child Exploitation Act or the END Child Exploitation Act This bill modifies the reporting requirements for electronic communication service providers and remote computing service providers (providers) that report information to the CyberTipline of the National Center for Missing and Exploited Children on crimes involving the sexual exploitation of children. Specifically, the bill increases the amount of time—from 90 days to 180 days—that a provider must preserve the contents of a report. Additionally, the bill permits a provider to voluntarily retain the contents for longer than 180 days to reduce the proliferation of or to prevent the online sexual exploitation of children.
Juror Non-Discrimination Act of 2021 This bill prohibits the exclusion of individuals from jury service on the basis of their sexual orientation or gender identity.
Pain-Capable Unborn Child Protection Act This bill establishes a new criminal offense for performing or attempting to perform an abortion if the probable post-fertilization age of the fetus is 20 weeks or more. A violator is subject to criminal penalties—a fine, a prison term of up to five years, or both. The bill provides exceptions for an abortion (1) that is necessary to save the life of the pregnant woman, or (2) when the pregnancy is the result of rape or incest. A physician who performs or attempts to perform an abortion under an exception must comply with specified requirements. A woman who undergoes a prohibited abortion may not be prosecuted for violating or conspiring to violate the provisions of this bill.
Animal Freedom from Testing, Experiments, and Research Act of 2021 or the AFTER Act of 2021 This bill requires departments, agencies, or instrumentalities that operate federal research facilities or exhibit animals to promulgate regulations that facilitate and encourage the adoption of certain animals that are suitable for retirement.
Back to Work Bonus Act This bill permits states to provide a one-time lump sum payment, through July 1, 2021, to individuals who (1) were eligible for COVID-19 pandemic unemployment compensation during any week after enactment of this bill, and (2) are no longer eligible as a result of becoming thereafter reemployed. Payments of $1,200 shall be paid to individuals who work at least 30 hours and $600 to individuals who work at least 20 hours but less than 30. The payments are available for claimants (1) who are not employed by a government entity, (2) who return to work for at least four consecutive weeks, and (3) whose annual salary does not exceed $75,000. Before receipt of a payment, the individuals' employers must verify their hours and earnings. Additionally, the bill (1) accelerates a scheduled increase in funding for reemployment services and eligibility assessments (RESEA), (2) allows states to use RESEA funds to serve all workers receiving unemployment benefits, and not just those most likely to exhaust their benefits; and (3) allows states to provide reemployment services to individuals receiving pandemic unemployment assistance and pandemic emergency unemployment compensation. Finally, the bill reinstates the requirement that unemployment claimants certify they are able, available, and actively seeking work.
Abortion Providers Loan Elimination Act This bill makes abortion providers ineligible to receive a loan under the Paycheck Protection Program, which was established to support small businesses in response to COVID-19. This prohibition shall not apply to hospitals or entities that exclusively provide abortions (1) where the pregnancy is the result of rape or incest, or (2) where the pregnancy endangers the life of the mother. The Inspector General of the Small Business Administration must report on the number of paycheck protection loans made to the Planned Parenthood Federation of America and to other abortion providers.
Student Athlete Level Playing Field Act This bill generally prohibits an institution of higher education or a covered athletic organization (e.g., an athletic association, a conference, or an organization with authority over intercollegiate athletics) from restricting the ability of a student athlete to enter into an endorsement or agency contract, with exceptions. It also provides for enforcement by the Federal Trade Commission, preempts state laws relating to endorsement or agency contracts, and establishes the Covered Athletic Organization Commission.
America Grows Act of 2021 This bill permanently funds several agencies that perform agriculture research. The bill provides specified funding for the following agencies within the Department of Agriculture: the Agricultural Research Service, the Economic Research Service, the National Agricultural Statistics Service, and the National Institute of Food and Agriculture. The bill exempts the funding from sequestration, which is a process of automatic, usually across-the-board spending reductions under which budgetary resources are permanently cancelled to enforce specific budget policy goals. It also exempts the budgetary effects of the funding from the Statutory Pay-As-You-Go Act of 2010 (PAYGO) and the Senate PAYGO rule.
Pharmacy and Medically Underserved Areas Enhancement Act This bill provides for Medicare coverage and payment with respect to certain pharmacist services that (1) are furnished by a pharmacist in a health-professional shortage area, and (2) would otherwise be covered under Medicare if furnished by a physician.
