Veterans Justice Outreach Improvement Act This bill updates the Department of Veterans Affairs (VA) Veterans Justice Outreach Program, which is a program through which the VA identifies justice-involved veterans and provides them with access to VA services. Justice-involved veterans are those with active, ongoing, or recent contact with some component of a local criminal justice system. Specifically, the bill requires the VA to conduct program outreach to justice-involved veterans, military and veterans service organizations, and relevant stakeholders in the criminal justice community (e.g., local law enforcement). The VA must increase the number of program specialists responsible for supporting justice-involved veterans in rural, remote, or underserved areas. Additionally, the VA must establish performance goals, measures, and implementation time lines for the program, specialists, and providing support for research regarding justice-involved veterans. Program specialists must receive training, at least annually, on (1) veteran eligibility for the program, and (2) best practices for identifying and conducting outreach to justice-involved veterans and relevant stakeholders in the criminal justice community.

The President may waive this prohibition for national security interests. (Under the bill, gain-of-function research generally involves the enhancement of potential pandemic pathogens or related risky research with potentially dangerous pathogens.) Furthermore, if the Office of the Inspector General of the Department of Health and Human Services determines that a National Institutes of Health official, employee, or grantee has intentionally misled or omitted information in a relevant disclosure (e.g., to Congress) about federal funding for international gain-of-function research, such a person shall be ineligible for any federal funding or federal employment.

Ending the Monopoly of Power Over Workplace Harassment through Education and Reporting Act or the EMPOWER Act This bill makes it an unlawful labor practice for an employer to enter into, or attempt to enforce, a contract with an employee or job applicant that contains a nondisparagement or nondisclosure clause that covers workplace or sexual harassment, including retaliation for participating in a workplace harassment proceeding. The bill exempts certain settlement or separation agreements from such prohibition. The bill also requires the Securities and Exchange Commission to promulgate a regulation that requires any issuer of securities to submit a report for the most recent five-year period with respect to workplace and sexual harassment. The commission must provide for the development and dissemination of training programs and information regarding workplace and sexual harassment. The bill denies a tax deduction for amounts related to judgments and expenses in connection with litigation related to workplace or sexual harassment. It also excludes from gross income, for income tax purposes, any amount received in connection with a claim or settlement related to workplace or sexual harassment, or other unlawful discrimination.

With respect to excluding procedures from the approved list for ASCs, the CMS may not cite as a basis for exclusion that a procedure can only be reported using an unlisted surgical procedure code. (Physicians sometimes use unlisted codes when performing new procedures or services if no existing code is adequately descriptive.) The bill also limits the copayment amount for ASC services under Medicare to that of the inpatient hospital deductible.
